  5. COPYRIGHT IN THE ACCOMPANYING SOFTWARE ("THE SOFTWARE") IS OWNED
  6. BY INTERNATIONAL BUSINESS MACHINES AND/OR THIRD PARTIES
  7. (COLLECTIVELY "IBM").  YOU, THE END USER, MAY NOT LOAD THE
  8. SOFTWARE INTO ANY COMPUTER, USE IT FOR ANY PURPOSE OR COPY IT
  9. WITHOUT A LICENSE FROM IBM.
  10.  
  11. BEFORE USING THIS SOFTWARE, YOU SHOULD CAREFULLY READ THE
  12. FOLLOWING TERMS AND CONDITIONS.
  13.  
  14. IBM OR THE APPLICABLE IBM COUNTRY ORGANIZATION OFFERS YOU A
  15. NON-EXCLUSIVE LICENSE FOR THE SOFTWARE ON THE TERMS OF THIS
  16. LICENSE AGREEMENT ONLY IN THE COUNTRY WHERE YOU ACQUIRED THE
  17. SOFTWARE.  BY OPENING THE SEALED DISK PACKAGE OR BY LOADING THE
  18. SOFTWARE INTO A COMPUTER, YOU ARE AGREEING TO BE BOUND BY THESE
  19. TERMS.  IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT YOU
  20. MAY, WITHIN 14 DAYS OF PURCHASE, RETURN THE UNOPENED DISK
  21. PACKAGE CONTAINING THE SOFTWARE, TOGETHER WITH ITS OTHER
  22. PACKAGING AND DOCUMENTATION UNUSED AND INTACT TO YOUR SUPPLIER,
  23. IN COMPLIANCE WITH THEIR RETURNS PROCEDURES, FOR A FULL REFUND.

  25. AS USED HEREIN, THE TERM "SOFTWARE" MEANS THE ORIGINAL AND ALL
  26. WHOLE OR PARTIAL COPIES OF IT, INCLUDING MODIFIED COPIES OR
  27. PORTIONS MERGED INTO OTHER PROGRAMS.  IBM OWNS OR HAS LICENSED
  28. FROM THE OWNER, COPYRIGHTS IN THE SOFTWARE.

  30. YOU ARE SOLELY RESPONSIBLE FOR THE INSTALLATION OF, USE AND
  31. RESULTS OBTAINED FROM, THE SOFTWARE.
  32.  
  33.  
  34. Grant of License
  35.  
  36. The Software is licensed, and not sold, for use by you only on a
  37. computer that is directly or indirectly coupled to an IBM
  38. printer in which either a PostScript or PCL feature has been
  39. validly enabled.  In addition, you may use the Software on a
  40. computer, network or system which permits electronic access to
  41. it by more than one user, provided that said computer, network
  42. or system is connected to an IBM printer in which either a
  43. PostScript or PCL feature has been validly enabled.  No other use
  44. is permitted.
  45.  
  46. You obtain no rights to the software other than those granted
  47. you under this license.  IBM and/or its third party suppliers
  48. retain title to the Software, its documentation and any full or
  49. partial copies thereof.  You are not permitted to sublicense,
  50. assign, rent or lease the Software.
  51.  
  52. You may transfer the Software and your rights under this license
  53. to another party.  In order for the transfer to be valid, the
  54. other party agrees to all of the terms and conditions of this
  55. license agreement by its first use of the Software.
  56.  
  57. If you transfer the software, you must transfer an unaltered
  58. copy of this license, all related contract documentation all
  59. other documentation and at least one complete, unaltered copy of
  60. the software to the other party.  You must, at the same time,
  61. either transfer all your other copies of the Software and its
  62. documentation to the other party or destroy them.  Your license
  63. to utilize the Software in any manner is terminated once you
  64. transfer a copy of the Software to another party.
  65.  
  66. You must reproduce the copyright and any proprietary notice(s)
  67. on each copy or partial copy of the Software or its
  68. documentation that you make.
  69.  
  70. You may not make any copies of the Software except such copies
  71. as are necessary for licensed use and operational security.
  72. For this purpose, one archival copy may be made.  Any such copy
  73. is subject to the conditions of this license.  Documentation,
  74. including help files, may not be copied for any purpose without
  75. IBM's consent.
  76.  
  77. You may not copy, modify, adapt, merge, translate, reverse
  78. engineer, decompile, disassemble or create derivative works
  79. based on the whole or any part of the Software or its associated
  80. documentation except as provided in this license.
  81.  
  82. You may be held legally responsible for any copyright
  83. infringement, unauthorized transfer, reproduction or use of the
  84. Software or its documentation.

  87. Acceptance
  88.  
  89. You shall be deemed to have accepted the terms of this Agreement
  90. by opening the package in which the media containing the
  91. Software is sealed or by loading the Software into a computer.
  92.  
  93.  
  94. Termination
  95.  
  96. This license is effective until terminated.  You may terminate
  97. your license at any time.  In addition, IBM may terminate the
  98. license if you fail to comply with the terms of this Agreement.
  99. In either event, upon termination, you agree to destroy all
  100. copies of the Software and its documentation.
  101.  
  102.  
  103. Limited Warranty
  104.  
  105. IBM warrants to the original user that the Software, if
  106. unaltered, will perform substantially in accordance with its
  107. accompanying documentation, provided that the Software is
  108. properly used on a computer and with an unmodified operating
  109. system for which it was designed.  Except for the foregoing
  110. warranty, IBM is licensing the software to you "as is."  The
  111. express terms of this Agreement are in lieu of all warranties,
  112. conditions, undertakings, terms and obligations implied by
  113. statute, common law, trade usage, course of dealing or
  114. otherwise, all of which are hereby excluded to the fullest
  115. extent permitted by law.
  116.  
  117. If you notify IBM of significant errors in the Software or its
  118. documentation within ninety days from the date of purchase, IBM
  119. will, at its option, correct any such demonstrable errors in the
  120. Software or its documentation within a reasonable time or
  121. provide or authorize a refund of the price paid for the Software
  122. upon return of the Software and its documentation.
  123.  
  124. IBM does not warrant that the Software will meet your
  125. requirements or that the operation of the Software will be
  126. uninterrupted or error-free or that defects in the Software will
  127. be corrected.  You shall load and use the Software at your own
  128. risk and in no event shall IBM be liable for any loss, damage or
  129. expense (including indirect and consequential loss or damage) of
  130. any nature (except personal injury or death resulting from IBM's
  131. negligence) howsoever arising and including but not limited to
  132. any loss resulting directly or indirectly from the use of the
  133. Software.
  134.  
  135. This limited warranty for the media and Software will apply
  136. only if the Software is licensed and located in the United
  137. States and Puerto Rico.  Outside the United States, contact your
  138. local IBM supplier for information on warranty.
  139.  
  140. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR
  141. IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES
  142. OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
  143.  
  144. Some countries and states in the U.S. do not allow the exclusion
  145. of implied warranties, so the above exclusion may not apply to
  146. you.  This limited warranty gives you specific legal rights, and
  147. you may also have other rights which vary from state to state.
  148.  
  149.  
  150. Limitation of Remedies
  151.  
  152. IBM's liability or that of its third party suppliers under this
  153. license is as follows:
  154.  
  155. IBM will provide any warranty described in this license or, if
  156. included with the Software, IBM's Statement of Limited Warranty.
  157. IBM will (a) replace defective media, or (b) make a warranted
  158. program operate or replace the Software with functionally
  159. equivalent Software, as such options may be warranted.
  160. Otherwise, you may terminate your license, return all copies of
  161. the Software and its documentation, and IBM will refund the
  162. amount you paid to license the Software.
  163.  
  164. For any claim, including fundamental breach, in any form,
  165. related in any way to this license, IBM's entire liability in
  166. the aggregate will be for actual damages only and shall be
  167. limited to the IBM's then generally available license fee for
  168. the Software or the license fee you paid, whichever is greater.
  169.  
  170. This limitation will not apply to claims for bodily injury or
  171. damages to real or tangible personal property for which IBM is
  172. legally liable.
  173.  
  174. IBM will not be liable for any lost profits, lost savings, or
  175. incidental damages or other economic consequential damages, even
  176. if IBM, or its suppliers, has been advised of the possibility of
  177. such damages.  IBM will not be liable for any damages claimed by
  178. you on any third party claim.
  179.  
  180. This limitation of remedies also applies to any supplier of
  181. software or data supplied to IBM and included in the Software.
  182. IBM's and the supplier's limitations of remedies are not
  183. cumulative.  Such developer is an intended beneficiary of this
  184. section regarding Limitation of Remedies.
  185.  
  186. Some jurisdictions do not allow these limitations or exclusions,
  187. so they may not apply to you.
  188.  
  189.  
  190. General
  191.  
  192. If any provision or portion of this Agreement shall be found to
  193. be illegal, invalid or unenforceable, the remaining provisions
  194. or portions shall remain in full force and effect.  This
  195. Agreement shall be governed by the law of the jurisdiction in
  196. which the Software is acquired.
  197.  
  198. You are responsible for payment of taxes, including personal
  199. property taxes, resulting from this license.
  200.  
  201. No party to this license agreement may bring an action,
  202. regardless of form, more than two years after the cause of the
  203. action arose.
  204.  
  205. If you acquired the Software in the United States, this license
  206. is governed by the laws of the State of New York.  If you
  207. acquired the software in Canada, this license is governed by the
  208. laws of the Province of Ontario.  Otherwise, this license is
  209. governed by the laws of the country in which you acquired the
  210. Software.
