  1. NETFINITY VERSION 5.20   90-Day Demonstration Part # 84H0220
  2. (HEREINAFTER REFERRED TO AS "DEMONSTRATION")

  5. GRANT OF LICENSE: International Business Machines Corporation,
  6. or the applicable IBM country organization (IBM) hereby grants
  7. You a non-exclusive license to copy and use as many copies of
  8. the Demonstration as you wish solely for evaluation purposes.
  9. You may also choose to distribute copies of the Demonstration to
  10. others and permit them to exercise the rights granted under this
  11. Agreement, provided You do not charge for doing so.  If You
  12. choose to distribute the Demonstration You also agree to insure
  13. that whomever the Demonstration is distributed to accepts the
  14. terms and conditions of this Agreement before using the code.
  15. A copy of the license governing the Demonstration can also be
  16. found in the LICENSE.TXT file distributed with the Demonstration.

  18. In addition, you agree not to reverse assemble, reverse compile,
  19. modify or otherwise translate or discover the source code of the
  20. Demonstration.  Unless otherwise provided, you may not rent,
  21. lease, sublicense or transfer the Demonstration.

  23. TERM AND TERMINATION:  Unless IBM notifies you of an earlier
  24. date, your license for the Demonstration terminates 90 days from
  25. installation of the code. You may terminate your license any
  26. time by destroying all copies of the Demonstration. IBM may
  27. terminate your license if you fail to comply with the terms and
  28. conditions of this Agreement.

  30. DISCLAIMER OF WARRANTY:  THE DEMONSTRATION WILL AUTOMATICALLY
  31. TERMINATE 90 DAYS AFTER INSTALLATION AND MUST NOT BE USED FOR
  32. PRODUCTIVE PURPOSES.

  34. THE DEMONSTRATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY
  35. KIND EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE
  36. IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
  37. PURPOSE.  THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE
  38. OF THIS PROGRAM AND DOCUMENTATION REMAINS WITH YOU.  IN NO EVENT
  39. WILL IBM BE LIABLE FOR ANY LOST PROFITS, LOST SAVINGS,
  40. INCIDENTAL OR INDIRECT DAMAGES OR OTHER ECONOMIC CONSEQUENTIAL
  41. DAMAGES, EVEN IF IBM OR ITS AUTHORIZED SUPPLIER HAS BEEN ADVISED
  42. OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION IBM AND ITS
  43. SUPPLIERS WILL NOT BE LIABLE FOR ANY DAMAGES CLAIMED BY YOU
  44. BASED ON ANY THIRD PARTY CLAIM.

  46. Some jurisdictions do not allow the exclusion of implied
  47. warranties, or the limitation for consequential damages, so the
  48. above may not apply to you.

  50. The Demonstration may not be shipped, transferred or reexported,
  51. directly or indirectly into any country prohibited by the United
  52. States Export Administration Act and the regulations thereunder,
  53. and may not be used for any purpose prohibited by the Act.
  54.  
  55. This Agreement is governed by the substantive laws of the State
  56. of New York without regard to conflict of laws principles.
