  62. NOT IN LIEU OF ANY CRIMINAL, CIVIL OR OTHER REMEDIES AVAILABLE TO

  66. LIMITED WARRANTY

  68.  EXCEPT AS SPECIFICALLY STATED IN THIS AGREEMENT, THE PROGRAM IS
  69. PROVIDED AND LICENSED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER
  70. EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED
  71. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

  73. Steven Barcus does not warrant that the functions contained in the Program
  74. will meet your requirements or that the operation of the Program will be
  75. entirely error free or appear precisely as described in the Program documentation.

  77.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT
  78. WILL STEVEN BARCUS BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING LOST
  79. PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES,
  80. ARISING OUT OF THE USE OR INABILITY TO USE THE PROGRAM, EVEN IF
  81. STEVEN BARCUS HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  84. GENERAL

  86. If any provision of this Agreement is held to be unenforceable, the
  87. enforceability of the remaining provisions shall in no way be affected or
  88. impaired thereby. This Agreement shall be governed by the laws of the State
  89. of Pennsylvania.

  91. Any questions concerning this Agreement should be referred in writing to
  92. Steven Barcus, 440 Wassergass Road, Hellertown, PA 18055-9718

  94.  YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND, BY INSTALLING
  95. THE PROGRAM, INDICATE YOUR ACCEPTANCE OF ITS TERMS AND CONDITIONS.
  96. YOU ALSO AGREE THAT, UNLESS SPECIFICALLY COVERED BY ANOTHER WRITTEN
  97. LICENSE AGREEMENT, IT IS THE COMPLETE AGREEMENT BETWEEN US AND IT
  98. SUPERSEDES ANY INFORMATION YOU RECEIVED RELATING TO THE SUBJECT
  99. MATTER OF THIS AGREEMENT.
