  1. Go Ahead Got It! Software License Agreement
  2.  
  3. This is a License Agreement between Go Ahead Software, Inc. ("Go Ahead") 
  4. and you, the end user.  
  5.  
  6. 1. Agreement
  7.     By installing the software package you acknowledge that 
  8.     you have read this agreement, understand it and agree to be 
  9.     bound by its terms and conditions.
  10.  
  11. 2. License
  12.     This agreement allows you to use one copy of the supplied Go 
  13.     Ahead Got It software program ("Software") on a connected to a 
  14.     single computer.  The Software is for your own use for evaluation 
  15.     purposes only and not for use by or for others. Any other use 
  16.     requires the purchase of a license.
  17.     You may not:-
  18.     (a) network the Software or otherwise use it on more than one 
  19.         computer or computer terminal at any one time;
  20.     (b) rent or lease any copy of the Software to others;
  21.     (c) modify, adapt or translate the Software;
  22.     (d) create derivative works based upon the Software;
  23.     (e) reverse engineer, decompile or disassemble the Software; and
  24.     (f) copy the Software (other than by making a single copy 
  25.         solely for back-up or archival purposes).

  27. 3. Transfer
  28.     You may only transfer your rights under this agreement where:
  29.     (a) you do so on a permanent basis;
  30.     (b) you transfer all copies of the Software and written materials 
  31.         to the recipient; and
  32.     (c) the recipient agrees to be bound by this agreement.

  34. 4. Term
  35.     This agreement is effective until terminated.  If you fail to 
  36.     comply with any provision of this agreement, the license will 
  37.     terminate automatically without the need for Go Ahead to give 
  38.     you notice.  You may terminate this license at any time by 
  39.     destroying the Software and any copies you have made.  If this 
  40.     license is terminated for any reason:-
  41.  
  42.     (a) you are not entitled to a refund of the whole or any part 
  43.         of the license fees paid; and
  44.     (b) you must destroy the Software and any copies you have made.

  46. 5. Copyright and other laws
  47.     The Software is owned by Go Ahead and is protected by 
  48.     international copyright and any other applicable laws.  You 
  49.     must comply with the terms of any copyright notice in the 
  50.     Software and must never remove any notice or product 
  51.     identification from the Software.  You may not copy any written 
  52.     materials which accompany the Software.  "Go Ahead Got It!" is 
  53.     a trade mark owned by Go Ahead and you must not use or deal with 
  54.     the Software in breach of Go Ahead's rights in that name.  Trade 
  55.     mark applications are pending.

  57. 6. Dual Media Software
  58.     If the Software package contains both 3╜" and 5╝" disks, then 
  59.     you may only use one set of the disks provided.  You may not 
  60.     use the other set of disks on any other computer, or loan, 
  61.     rent, lease or transfer them to another user.  
  62.  
  63. 7. Limited Warranty
  64.     Go Ahead warrants that the diskettes in which the Software is 
  65.     recorded are free from defects in materials and faulty 
  66.     workmanship under normal use for a period of 90 days from the 
  67.     date of purchase (as evidenced by a copy of the receipt).  
  68.     During this warranty period, Go Ahead will, at its option 
  69.     either:-
  70.  
  71.     (a) return the price paid; or
  72.     (b) repair or replace, free of charge, the defective diskettes 
  73.         upon which the Software has been supplied.

  75. 8. No Other Warranties
  76.     To the full extent permitted by law, Go Ahead excludes all 
  77.     conditions and warranties not set out in this agreement.  The 
  78.     Software, and any accompanying written materials, are supplied 
  79.     "as is", without warranty of any kind (other than the limited 
  80.     warranty contained in clause 7).  Go Ahead does not warrant, 
  81.     guarantee or make any representations regarding the use of or 
  82.     the results of the use of the Software or as to its 
  83.     correctness, accuracy, reliability, currentness or otherwise.  
  84.     The entire risk as to results and performance of the Software 
  85.     is assumed by you.  
  86.  
  87.     Where legislation does not permit such exclusion of liability, 
  88.     Go Ahead's liability is limited to:
  89.     (a) replacement of the Software; or
  90.     (b) correction of defects in the Software, at its option.
  91.  
  92. 9. No Liability for Consequential Damages
  93.     In no event shall Go Ahead or any of its authorised 
  94.     representatives be liable to you for any damages (including, 
  95.     damages for loss of business profits, business interruption and 
  96.     loss of business information or computer programs) because of 
  97.     your use or inability to use the Software, even if Go Ahead has 
  98.     been advised by you of the possibility of such damages.  In any 
  99.     event, Go Ahead's entire liability under any provision of this 
  100.     agreement shall be limited to the amount actually paid by you 
  101.     for the Software.

  103. 10. Entire Agreement
  104.     This agreement contains the entire agreement between you and Go 
  105.     Ahead and supersedes all prior agreements, negotiations or 
  106.     other communications between the parties relating to the 
  107.     Software.
  108.  
  109. 11. Applicable Law
  110.     This Agreement will be governed by the laws of Washington USA 
  111.     and the parties submit to the non-exclusive jurisdiction of the 
  112.     courts of that state.
