  1. Licence Agreement, Disclaimer and Terms and Conditions of Use. 8th April 1998

  4. These are the terms and conditions for acceptable use of this Software
  5. "Paladin". Any breach or abuse of these conditions should be reported to the
  6. appropriate authorities and/or Paladin Corporation. We reserve the right to
  7. refuse to sell to or support those that violate these terms and conditions.

  9. This Software is not to be used for sending Unsolicited 'Bulk' or 'Commercial'
  10. Email (UBE/UCE) otherwise known as 'spam'. If this software is used for UCE or
  11. UBE then you will be in breach of the Paladin licencing agreement. Spam is an
  12. abuse of the Internet and we reserve the right to refuse to sell to or support
  13. those that violate this agreement, under the Terms and Conditions of use for 
  14. Paladin IMAP4 Email.

  16. This software must not be used for sending email in a fraudulent manner. Sending
  17. email in a way intended to mask your identity or masquerading as another person,
  18. known as 'faking mail' is a violation of the Paladin licencing agreement and we
  19. reserve the right to refuse to sell to or support those that violate this 
  20. agreement, under the Terms and Conditions of use for Paladin IMAP4 Email.

  22. You must not use this Software for harrassing other individuals or parties or 
  23. causing Denial of Service through sending vast amounts of email, known 
  24. as 'mailbombs' These actions constitute a violation of the Paladin licencing 
  25. agreement and we reserve the right to refuse to sell to or support those that 
  26. violate this agreement, under the Terms and Conditions of use for 
  27. Paladin IMAP4 Email.

  29. You shall not disclose the results of any benchmark test to any third party
  30. without prior written approval by Paladin Corporation and you will not publish
  31. reviews of the product without prior consent from Paladin Corporation.

  33. You may not sell or distribute this software without the express permission of
  34. Paladin Corporation All original files included in the archive must not be
  35. removed or modified.

  37. You shall not de-compile, reverse engineer or disassemble Paladin or any
  38. programs contained therein. You are expressively prohibited from replacing or
  39. otherwise altering the command utilities and/or the libraries.

  41. You are granted a non-exclusive, non-sublicensable, license to use this version
  42. of Paladin (the "Software"), in binary executable form for a period of 30 days
  43. for evaluation purposes, but must then register the Software or remove it from
  44. your computer.

  46. This Agreement is personal between Paladin Corporation and you. You may not
  47. accept this Agreement on behalf of any company, corporation or other
  48. organization. No ownership interest in Paladin is transferred to you. Paladin
  49. Corporation may assign or transfer to any company or person, or grant to any
  50. company or person a license or sublicense under, all or part of its interest in
  51. any rights to the Software, this Agreement, or any license granted to Paladin
  52. Corporation hereunder. You may not assign, transfer or sublicense your rights
  53. hereunder without the written consent of Paladin Corporation.

  55. PALADIN CORPORATION MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THIS
  56. SOFTWARE OR ABOUT ANY CONTENT OR INFORMATION MADE ACCESSIBLE BY THE SOFTWARE,
  57. FOR ANY PURPOSE. THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT EXPRESS OR IMPLIED
  58. WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
  59. PURPOSE OR NONINFRINGEMENT. THIS SOFTWARE IS PROVIDED GRATUITOUSLY AND,
  60. ACCORDINGLY, NORMAN WIDDERS SHALL NOT BE LIABLE UNDER ANY THEORY FOR ANY DAMAGES
  61. SUFFERED BY YOU OR ANY USER OF THE SOFTWARE.

  63. All content accessed through the Software is the property of the applicable
  64. content owner and may be protected by applicable copyright law. This License
  65. gives you no rights to such content. Title, ownership rights, and intellectual
  66. property rights in and to the Software shall remain with Paladin Corporation.
  67. You agree to abide by the copyright law and all other applicable laws of
  68. Australia including, but not limited to, export control laws. You acknowledge
  69. that the Software in source code form remains a confidential trade secret of
  70. Paladin Corporation and therefore you agree not to modify the Software or
  71. attempt to decipher, decompile, disassemble or reverse engineer the Software,
  72. except to the extent applicable laws specifically prohibit such restriction.

  74. PALADIN CORPORATION SHALL NOT BE LIABLE FOR (a) INCIDENTAL, CONSEQUENTIAL,
  75. SPECIAL OR INDIRECT DAMAGES OF ANY SORT, WHETHER ARISING IN TORT, CONTRACT OR
  76. OTHERWISE, EVEN IF NORMAN WIDDERS HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH
  77. DAMAGES, OR (b) FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITATION OF LIABILITY
  78. SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT
  79. APPLICABLE LAW PROHIBITS SUCH LIMITATION. FURTHERMORE, SOME COUNTRIES DO NOT
  80. ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
  81. THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.
