  4. Before proceeding with installation, you
  5. must indicate your willingness to accept
  6. the terms of the following Software
  7. License Agreement.
  8.  
  9.      SOFTWARE LICENSE AGREEMENT
  10. Grant of Rights
  11. Novell, Inc. (Novell), grants you the
  12. right to make and use unlimited copies of
  13. the accompanying  Novell Envoy
  14. Distributable Viewer software product
  15. (Software); distribute copies to other
  16. persons or entities provided each copy
  17. contains this Agreement and the same
  18. copyright and other proprietary notices
  19. that appear on the Software; and make an
  20. archival copy of the Software.  This
  21. Agreement supersedes any prior version
  22. license.

  24. Restrictions
  25. You may not rent or lease the Software
  26. without the written permission of Novell. 
  27. You may not decompile, disassemble,
  28. reverse engineer, copy, create a
  29. derivative work, or otherwise use the
  30. Software except as stated in this
  31. Agreement. 
  32.  
  33. LIMITED WARRANTY/LIMITATION OF LIABILITY
  34. THIS SOFTWARE IS LICENSED AS IS. THIS
  35. WARRANTY IS IN LIEU OF ANY OTHER
  36. WARRANTIES, EXPRESS OR IMPLIED, INCLUDING
  37. THE IMPLIED WARRANTIES OF MERCHANTABILITY
  38. AND FITNESS FOR A PARTICULAR PURPOSE.  IN
  39. NO EVENT WILL NOVELL BE LIABLE TO YOU FOR
  40. DAMAGES, INCLUDING ANY LOST PROFITS, LOST
  41. SAVINGS, OR OTHER INCIDENTAL OR
  42. CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR
  43. USE OF OR INABILITY TO USE THE SOFTWARE,
  44. EVEN IF NOVELL OR AN AUTHORIZED NOVELL
  45. REPRESENTATIVE HAS BEEN ADVISED OF THE
  46. POSSIBILITY OF SUCH DAMAGES.

  48. Some jurisdictions do not allow excluding
  49. or limiting implied warranties or limiting
  50. liability for incidental or consequential
  51. damages, and some jurisdictions have
  52. special statutory consumer protection
  53. provisions that may supersede this
  54. limitation of liability.  As a result,
  55. these limitations may not apply to you if
  56. prohibited by the laws of your
  57. jurisdiction.
  58.  
  59. General
  60. Any provision of this Agreement found to
  61. be unlawful, void, or unenforceable shall
  62. be severed from this Agreement and will
  63. not affect the validity and enforceability
  64. of any of the remaining provisions.  This
  65. Agreement shall be governed by the laws of
  66. the State of Utah.
  67.  
  68. U.S. Government Restricted Rights
  69. The Software and any accompanying
  70. materials are provided with Restricted
  71. Rights.  Use, duplication, or disclosure
  72. by the Government is subject to
  73. restrictions as set forth in subparagraph
  74.   (1) (ii) of The Rights in Technical Data
  75. and Computer Software clause at DFARS
  76. 252.227-7013 or subparagraphs   (1) and
  77. (2) of the Commercial Computer
  78. Software Restricted Rights at 48 CFR
  79. 52.227-19, as applicable.
