  2. for the Belarc Advisor ("Advisor")

  4. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE FIRST USING
  5. THE BELARC ADVISOR.  THIS AGREEMENT PROVIDES IMPORTANT
  6. INFORMATION CONCERNING THE BELARC ADVISOR, PROVIDES
  7. YOU WITH A LICENSE TO USE THE BELARC ADVISOR AND
  8. CONTAINS WARRANTY AND LIABILITY INFORMATION.  TO ACCEPT
  9. THIS AGREEMENT AND INSTALL THE BELARC ADVISOR, SELECT
  10. THE "I Agree" BUTTON AT THE BOTTOM OF THE PAGE.  TO
  11. CANCEL AND NOT INSTALL THE BELARC ADVISOR, SELECT THE
  12. "I Don't Agree" BUTTON.

  14. 1.  Notice
  15. The Belarc Advisor ("Advisor") is a unique application that works
  16. with your Internet browser.  It automatically shows your installed
  17. software and hardware.  This Advisor is for personal use only.  
  18. The Advisor, or any output from it, may not be used for commercial, 
  19. educational or government purposes or to aggregate information about
  20. multiple computers.  Licensing information for those purposes is 
  21. available at http://www.belarc.com or by calling Belarc
  22. at +1-978-461-1103.

  24. 2.  License
  25. This Agreement allows you to use the Advisor with the following 
  26. restrictions:  Unless Belarc has authorized you to distribute the Advisor,
  27. you may not make or distribute copies of the Advisor or electronically
  28. transfer the Advisor from one computer to another.  The Advisor is for 
  29. personal use only.  The Advisor, or any output from it, may not be used
  30. to aggregate information about multiple computers or for any 
  31. commercial, government or educational purposes.  You may not 
  32. decompile, reverse engineer, disassemble, or otherwise reduce the 
  33. Advisor to a human-perceivable form.  You may not modify, rent, resell 
  34. for profit, distribute or create derivative works based upon the Advisor.

  36. 3.  Ownership
  37. This license gives you limited rights to use the Advisor.  You do not own 
  38. and Belarc retains ownership of the Advisor and all copies of it.  All rights 
  39. not specifically granted in this Agreement, including Federal and 
  40. International Copyrights, are reserved by Belarc.

  42. 4.  Disclaimer of Warranties.
  43. The Advisor is provided to you free of charge, and on an "AS IS" basis.  
  44. Belarc makes no warranty of any kind with respect to the accuracy of 
  45. the Advisor. Belarc specifically disclaims all warranties, express, 
  46. implied or otherwise, including without limitation, all warranties of 
  47. merchantability and fitness for a particular purpose.  SOME STATES 
  48. DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO
  49. THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.  YOU MAY ALSO
  50. HAVE OTHER LEGAL RIGHTS WHICH VARY FROM STATE TO
  51. STATE.

  53. 5.  Limitation of Damages
  54. BELARC SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, 
  55. INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY 
  56. DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA 
  57. OR PROFITS, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF 
  58. DAMAGE, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR 
  59. IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS DATA 
  60. OR THE ADVISOR.  SOME STATES DO NOT ALLOW THE 
  61. LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OF 
  62. CONSEQUENTIAL DAMAGES, SO THIS LIMITATION OR EXCLUSION 
  63. MAY NOT APPLY TO YOU.  The limited warranty, exclusive remedies 
  64. and limited liability set forth above are fundamental elements of the basis 
  65. of the bargain between Belarc and you.  You agree that Belarc would not 
  66. be able to provide the Advisor on an economic basis without such 
  67. limitations.

  69. 6.  Government End Users, RESTRICTED RIGHTS LEGEND
  70. The Advisor is "Restricted Computer Software".  Use, duplication or 
  71. disclosure by the Government is subject to restrictions as set forth in 
  72. subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer 
  73. Software clause at DFARS 252.227-7013.  Manufacturer: Belarc, Inc.,

  76. 7.  General
  77. This Agreement shall be governed by the internal laws of the State of 
  78. Massachusetts.  This Agreement contains the complete agreement 
  79. between the parties with respect to the subject matter hereof, and 
  80. supersedes all prior or contemporaneous agreements or understandings, 
  81. whether oral or written.  All questions concerning this Agreement shall 
  82. be directed to: Belarc, Inc., Two Clock Tower Place, Suite 520, Maynard, 
  83. MA  01754, Attention: Legal.
