  1. LICENSE AGREEMENTBy virtue of you using these Photo CD Images, you agree to abide by the following terms andconditions of use.  All images (Images) provided by Nintendo of America Inc. (Nintendo) to therecipient are provided subject to the following Agreement between the parties.
  2. 1.  Nintendo owns and retains copyrights to the Images.  No copyright license (either express or implied) is granted to the recipient, except that the recipient is authorized to reproduce theImages without alteration for non-promotional/commercial or editorial purposes only.
  3. 2. Γäó, ┬« and ┬⌐ are intellectual properties of Nintendo (except at otherwise indicated below*),and no trademark license (either express or implied) is granted to the recipient.
  4. 3. THE IMAGES ARE PROVIDE TO THE RECIPIENT AS IS.  ALL IMPLIEDWARRANTIES ARE HEREBY DISCLAIMED, INCLUDING, WITHOUT LIMITATION,THE WARRANTIES OF TITLE, INFRINGEMENT, MERCHANTABILITY, AND FITNESSFOR A PARTICULAR PURPOSE.
  5. 4. To the extent the images include any (a) trade name, trademark or service mark owned by athird party, or (b) likeness of or reference to a third party, recipient is responsible for obtainingappropriate permissions and licenses from such third party.
  6. 5. This Agreement (a) will be governed by the law of the State of Washington, exclusive ofWashington's choice of law rules; (b) constitutes the entire agreement, and supersedes any andall other agreements, understandings, and communications between parties related to Images;and (c) may only be amended or otherwise modified by a written instrument executed by anauthorized representative of Nintendo.
