  1. By virtue of you using these Photo CD Images, you agree to abide by the following terms and
  2. conditions of use.  All images (Images) provided by Nintendo of America Inc. (Nintendo) to the
  3. recipient are provided subject to the following Agreement between the parties.

  5. 1.  Nintendo owns and retains copyrights to the Images.  No copyright license (either express or
  6. implied) is granted to the recipient, except that the recipient is authorized to reproduce the
  7. Images without alteration for non-promotional/commercial or editorial purposes only.

  9. 2. ¬, ¿ and ⌐ are intellectual properties of Nintendo (except at otherwise indicated below*),
  10. and no trademark license (either express or implied) is granted to the recipient.

  12. 3. THE IMAGES ARE PROVIDE TO THE RECIPIENT AS IS.  ALL IMPLIED
  13. WARRANTIES ARE HEREBY DISCLAIMED, INCLUDING, WITHOUT LIMITATION,
  14. THE WARRANTIES OF TITLE, INFRINGEMENT, MERCHANTABILITY, AND FITNESS
  15. FOR A PARTICULAR PURPOSE.

  17. 4. To the extent the images include any (a) trade name, trademark or service mark owned by a
  18. third party, or (b) likeness of or reference to a third party, recipient is responsible for obtaining
  19. appropriate permissions and licenses from such third party.
  20. 5. This Agreement (a) will be governed by the law of the State of Washington, exclusive of
  21. Washington's choice of law rules; (b) constitutes the entire agreement, and supersedes any and
  22. all other agreements, understandings, and communications between parties related to Images;
  23. and (c) may only be amended or otherwise modified by a written instrument executed by an
  24. authorized representative of Nintendo.
