  5. Kermit 95 communications software for Windows 95, Windows 98, Windows NT,
  6. Windows 2000, and OS/2

  8. I. GENERAL TERMS
  9.  
  10. Kermit 95 software and the accompanying documentation are copyrighted and
  11. protected by law. They may be used only under license. The licensed
  12. material may not be posted in public download areas, submitted to user
  13. groups, placed on CDROMs, included with any product, or redistributed in
  14. any other form without license to do so.
  15.  
  16. All prices, terms, and conditions are subject to change.
  17.  
  18. All prices are in US dollars.
  19.  
  20. Kermit 95 is available for Microsoft Windows 95 and Windows 98 (which run
  21. only on Intel platforms); for Microsoft Windows NT (3.51 or later) on Intel
  22. and Alpha platforms; for Microsoft Windows 2000 (which runs only on Intel
  23. platforms); and for IBM OS/2 3.0 or later on Intel platforms only. NOTE:
  24. Kermit 95 does not run under Windows 3.x or Win32s.

  34. II. INDIVIDUAL AND SMALL-QUANTITY ORDERS
  35.  
  36. Quantities under 100 are available only in the retail shrink-wrapped
  37. package, which contains the Kermit 95 CDROM (which contains the Kermit 95
  38. software for all supported platforms plus the Kermit 95 online HTML
  39. manual), the C-Kermit CDROM, and the technical reference manual, Using
  40. C-Kermit, second edition, as a PDF file. The unit price is $64.00 US, plus
  41. shipping. Quantity discounts are available as follows:

  57. III. KERMIT 95 BULK RIGHT-TO-COPY LICENSES
  58.

  62. Minimum quantity: 100.
  63. Minimum extension: 100.
  64.  
  65. The licensee is entitled to make the licensed number of copies of the
  66. software for internal use (or, under terms of Section V, for customers or
  67. clients).
  68.  
  69. A bulk right-to-copy license consists of:
  70.  
  71.   1. A CDROM containing a preregistered copy of the Kermit 95 software
  72.   2. The Kermit 95 manual, also on CDROM in HTML format
  73.   3. One copy of the technical reference manual, Using C-Kermit, in printed
  74.      book form.
  75.   4. A Kermit 95 Bulk License form for the number of copies purchased
  76.  
  77. All users within (or clients of) the licensed organization share the same
  78. registration and serial number. The license covers employees (and in the
  79. case of academic institutions, also students) of the licensed organization,
  80. including contractors during the period of their contract. The Discount
  81. column shows the discount against the single-copy retail street price of
  82. $64.

  95. Any number of copies (100 or more) may be purchased by paying the unit
  96. price per copy appropriate to the range, and Windows 95/98, Windows
  97. NT/2000, and OS/2 copies may be mixed and matched within the given discount
  98. range.

  100. "Site" or "unlimited" licenses are available only to academic institutions
  101. (see Section IV). To achieve freedom from copy counting and license
  102. administration, simply purchase sufficient licenses to cover the maximum
  103. expected number of users.
  104.  
  105. The licensee must assume responsibility of preventing all manner of
  106. external access to the software, including, but not limited to,
  107. unauthorized redistribution of the software in any form by employees, or
  108. placing of the software on file servers, ftp servers, or Web pages that are
  109. accessible from outside the licensed organization.
  110.  
  111. III.A. GOVERNMENT AND NONPROFIT DISCOUNT
  112.  
  113. Government agencies (but not for-profit government contractors) and
  114. nonprofit tax-exempt organizations are entitled to a twenty percent (20%)
  115. discount on the final price. This discount applies only to bulk
  116. right-to-copy licenses.
  117.  
  118. III.B. ADDITIONAL DISCOUNTS
  119.  
  120. Printed, published copies of technical reference manual, Using C-Kermit,
  121. may be ordered in any quantity by bulk-right-to-copy licensees at a the
  122. following discounted prices:
  123.

  130. The Government and Nonprofit discount may not be used in combination with
  131. this discount.

  133. III.C. LICENSE UPGRADES
  134.  
  135. The licensee may increase the size of its license by paying for additional
  136. copies at the rate appropriate for the total number of copies licensed,
  137. including those in the upgrade. The mininum size of an ugrade is 100
  138. copies. For example, if 999 copies were originally licensed at $7.20 per
  139. copy, then 100 to 1500 additional licenses may be purchased at $6.00 per
  140. copy; 1501 to 4000 licenses at $5.00 per copy, and so on.

  142. III.D. SOFTWARE SUPPORT AND UPGRADES
  143.  
  144. The licensee is entitled to technical support, software patches, and
  145. version upgrades at no additional cost for one year. After that, these
  146. services are available only to licensees who have paid an annual
  147. maintenance fee of twenty-five percent (25%) of the original license fee,
  148. for which bills are sent around the license anniversary.
  149.  
  150. The licensed organization must provide technical support to its users, and
  151. may, in turn, obtain technical support from Columbia University through a
  152. designated single point of contact.
  153.  
  154. If support lapses, and the licensee wishes to renew it, this may be done
  155. by:
  156.  
  157.    * purchasing a new license of the desired size, or:
  158.    * paying the maintenance fees for all years for which they were not
  159.      paid, including the current year.
  160.  
  161. III.E. SERVER LICENSES
  162.  
  163. Kermit 95 may be run from a central file server, as long as the number of
  164. concurrent users does not exceed the size of the license, and the server is
  165. not accessible from outside the licensed organization.

  169. IV. ACADEMIC SITE LICENSES
  170.

  174. An academic site license consists of:
  175.  
  176.   1. A CDROM containing a preregistered copy of the Kermit 95 software
  177.   2. The Kermit 95 manual, also on CDROM
  178.   3. Five copies of the technical reference manual, Using C-Kermit, in
  179.      printed book form.
  180.   4. A Kermit 95 Academic Site License form
  181.  
  182. Kermit 95 academic site licenses are available at the rates listed below.
  183. An academic site license entitles all students, faculty, and staff at the
  184. licensed institution to individual, non-transferable use of Kermit 95, with
  185. no copy counting required, as long as they are students at or employed by
  186. the institution. End-user technical support must be furnished by the
  187. institution. Technical support to the instition is furnished through a
  188. single technical point of contact with the Kermit Project at Columbia
  189. University.

  191. For any single college or university:
  192.  
  193.   First year:       $  2,000
  194.   Subsequent years: $  1,000
  195.  
  196. For a large university system, such as a statewide system (e.g. all of
  197. SUNY):
  198.  
  199.   First year:       $ 10,000
  200.   Subsequent years: $  5,000
  201.  
  202. Multiple Platforms: All Kermit 95 platforms, Windows and OS/2, are covered
  203. by the same license.
  204.  
  205. All prices are in US dollars and apply worldwide. Rates are subject to
  206. adjustment. Prior Kermit 95 purchases -- shrink-wrap or bulk -- are not
  207. creditable towards the academic site license.
  208.  
  209. Technical support and upgrades are included int the first year's license.
  210. The license remains active in subsequent years only if the annual
  211. maintenance is paid. An active license entitles the institution to
  212. continuing single-point-of-contact technical support and to software
  213. upgrades at no additional cost.
  214.  
  215. If support lapses, and the licensee wishes to renew it, this may be done

  218.    * purchasing a new license:

  230. V. BUNDLING AND RESELLING
  231.  
  232. Kermit 95 may be purchased under the terms given in sections I, II, and III
  233. (but not IV) for the purposes of resale or redistribution, with the
  234. following additional provisos:
  235.  
  236.   1. The given number of licenses is transferred from the supplier to the
  237.      customer. The supplier no longer owns those licenses, and the customer
  238.      is not entitled to more than that number of copies of the software.
  239.  
  240.   2. Customers must be informed that they have been provided with Kermit 95
  241.      software from Columbia University, and all relevant copyright notices
  242.      must be displayed.
  243.  
  244.   3. The supplier must either:
  245.  
  246.         o Purchase a bulk right-to-copy license and provide all technical
  247.           support for their customers, or:
  248.  
  249.         o Provide their end users with the full retail shrink-wrapped
  250.           package.
  251.  
  252. Bulk licenses are not intended for single-copy retail distribution.
  253. Individual end users must receive the fully documented and supported shrink
  254. wrapped retail package. Redistribution of bulk licenses is appropriate in a
  255. consulting, contracting, bundling, or embedding framework.
  256.  
  257. If the licensee has purchased shrink-wrapped copies for resale or
  258. redistribution, then each end user registers each individual copy of the
  259. software using the serial number provided. If the lincensee has purchased a
  260. bulk right-to-copy license, then a single serial number and registration
  261. applies to all copies. It is up to the buyer of the bulk license to specify
  262. how it is to be registered.
