  10.      This document supersedes the documents of the same name with
  11.      earlier dates, and all other earlier statements of terms and
  12.      conditions, including those found in Kermit manuals and other
  13.      documentation published prior to the date shown above. This
  14.      document will be updated from time to time as new software and
  15.      manuals become available, or when pricing or other conditions
  16.      change.

  18.    Kermit software is distributed and supported by Columbia University.
  19.    The nonprofit Kermit Project is self-sustaining, funded by income from
  20.    licenses and sales.
  21.    
  22.    Except where permitted by the license of a specific Kermit software
  23.    program, Kermit software may not be distributed, remarketed, bundled,
  24.    embedded, adapted, given away, or otherwise redistributed by
  25.    commercial enterprises to their customers, clients, prospective
  26.    clients, or anyone else external to their organization without a
  27.    license to do so from the Kermit Project at Columbia University.
  28.    Commercial distribution includes, but is not necessarily limited to,
  29.    bundling of Kermit software with hardware or software products;
  30.    furnishing Kermit software to institutions, government agencies, or
  31.    corporations under contract; including Kermit software on CD-ROM
  32.    distributions of any kind (except when explicitly permitted);
  33.    inclusion of Kermit software by Internet Access Providers in software
  34.    kits provided to their customers; embedding of Kermit software in
  35.    industry-specific applications such as medical claims submission
  36.    packages; or any other arrangement in which Kermit software is
  37.    furnished to customers, clients, or prospective clients for any
  38.    purpose.

  40.   KERMIT 95
  41.   
  42.    [1]Kermit 95 is the Kermit software for Windows 95, Windows 98,
  43.    Windows ME, Windows NT, Windows 2000, Windows XP, and OS/2. Since all
  44.    copies of Kermit 95 must be licensed, whether for own use or
  45.    redistribution or resale, the conditions for furnishing Kermit 95 to
  46.    customers or clients are automatically fulfilled when you license it

  50.   C-KERMIT AND MS-DOS KERMIT
  51.   
  52.    C-Kermit and MS-DOS Kermit software are not in the public domain. They
  53.    are copyright by the Trustees of Columbia University in the City of
  54.    New York. They may be downloaded for own use, or for use within one's
  55.    own organization, and under [3]certain conditions can be redistributed
  56.    without explicit license, but in general can be redistributed only
  57.    under the following conditions (in which the "supplier" is the
  58.    company, organization, or person who is doing the redistributing):
  59.  
  60.     1. The supplier must purchase license seats in sufficient quantity to
  61.        cover the number of copies of the software that will be deployed.
  62.        As of 1 January 2002, a new commercial redistribution ("omnibus")
  63.        license goes into effect, which is far less expensive than the
  64.        previous one (which required a book to accompany each copy of the
  65.        software). The new license is exactly like the [4]Kermit 95 Bulk
  66.        Right-to-Copy License, except that each seat may be fulfilled with
  67.        Kermit 95, C-Kermit, or MS-DOS Kermit, according to each
  68.        computer's operating system. Thus this license is appropriate for
  69.        sites with a mixture of platforms, or in which operating systems
  70.        change (e.g. DOS upgraded to Windows; Windows replaced by Linux),
  71.        but it can be used just as well for a site that needs only
  72.        C-Kermit or only MS-DOS Kermit. [5]CLICK HERE for the new order
  73.        form. The minimum size for an omnibus license is 100 seats. To
  74.        license a smaller number of copies, order them individually in the
  75.        desired quantity: [6]Kermit 95, [7]C-Kermit, or [8]MS-DOS Kermit.

  77.     2. The supplier must provide support to its users or customers. In
  78.        turn, the Kermit Project supports the supplier.
  79.  
  80.     3. Source code is included with or available for C-Kermit and MS-DOS
  81.        Kermit, but not Kermit 95. The supplier must not modify the Kermit
  82.        software source code without consent of the Kermit Project at
  83.        Columbia University. If changes are needed, they must be
  84.        coordinated through Columbia University so they can be supported
  85.        and carried forward in new releases. The supplier can, of course,
  86.        produce tailored initialization files, command files, macros,
  87.        scripts, tip sheets, and similar material that does not involve
  88.        changes to the Kermit software source code.

  90.     4. The supplier must not modify, remove, or obscure any copyright
  91.        notices or disclaimers that appear in the software or
  92.        documentation.

  94.     5. All standard disclaimers apply, in particular those that accompany
  95.        each Kermit software program. In general, the supplier
  96.        acknowledges that the Kermit software and documentation are
  97.        provided as is; no other warranty is provided, express or implied,
  98.        including without limitation, any implied warranty of
  99.        merchantability or implied warranty of fitness for a particular
  100.        purpose. Neither the supplier nor the end-users shall hold liable
  101.        the authors of any Kermit software programs, publications or
  102.        documentation nor Columbia University, Digital Press, Manning
  103.        Publications, nor any other contributing institution or individual
  104.        for program or documentation errors.

  106.     6. Suppliers in the United States of America and Canada are subject
  107.        to USA and Canadian law and treaties, in particular regarding
  108.        export of strong encryption algorithms and software. It is the
  109.        supplier's responsibility to conform to all applicable regulations
  110.        and statutes.

  112.   OTHER KERMIT VERSIONS
  113.   
  114.    Kermit software other than Kermit 95, C-Kermit, and MS-DOS Kermit that
  115.    are in release and on the Kermit Project Web and FTP site as of the
  116.    date of this document (examples: Kermit-370 for IBM mainframes;
  117.    Kermit-11 for PDP-11s) may be redistributed without explicit license,
  118.    but any changes to the source code should be cleared through the
  119.    Kermit Project. This clause does not necessarily apply to Kermit
  120.    software releases that might appear in the future.

  122.   SOURCE CODE
  123.   
  124.    Companies may license Kermit source code for purposes of adapting it
  125.    to, or integrating it into, products or services. Contact the Kermit
  126.    Project's Business Manager to negotiate the terms of the license.
  127.    However, it should be emphasized that this course is not recommended
  128.    in environments where an existing Kermit program can operate on its
  129.    own, since your product will not be able to benefit from bug fixes and
  130.    improvements that take place afterwards, nor can it be supported by
  131.    us. Most versions of Kermit software are easy to imbed in other
  132.    applications, so please think twice before choosing a source code
  133.    license.
