  1. In order to run this CD-ROM you should first understand and agree with the

  7. END-USER LICENSE AGREEMENT

  9. READ THIS AGREEMENT CAREFULLY. BY BUYING THE BOOK AND USING THE
  10. PROGRAMLISTINGS,CD-ROM, AND PROGRAMS REFERRED TO BELOW, YOU
  11. ACCEPT THE TERMS OF THIS AGREEMENT. The program listings included in
  12. this book and the programs included on the CD-ROM are proprietary
  13. products of Macmillan Computer Publishing USA and/or third party
  14. suppliers ("Suppliers"). The program listings and programs are hereinafter
  15. collectively referred to as the "Programs." Macmillan Computer Publishing
  16. USA and the Suppliers retail ownership of the CD-ROM and copyright to the
  17. Programs, as their respective interests may appear. The Programs and the
  18. copy of the CD-ROM provided are licensed (not sold) to you under the
  19. conditions set forth herein.

  21. License. You may use the CD-ROM on any compatible computer, provided
  22. that the CD-ROM is used on only one computer and by one user at a time.
  23.  
  24. Restrictions. You may not commercially distribute the CD-ROM or the
  25. Programs or otherwise reproduce, publish, or distribute or otherwise use
  26. the CD-ROM or the Programs in any manner that may infringe any copyright
  27. or other proprietary right of Macmillan Computer Publishing USA, the
  28. Suppliers, or any other party or assign, sublicense, or otherwise transfer
  29. the CD-ROM or
  30. this agreement to any other party unless such party agrees to accept the
  31. terms and conditions of this agreement. This license and your right to use
  32. the CD-ROM and the Programs automatically terminates if you fail to
  33. comply with any provision of this agreement.

  35. U.S. GOVERNMENT RESTRICTED RIGHTS. The CD-ROM and the programs are
  36. provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the
  37. Government is subject to restrictions
  38. as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and
  39. Computer Software Clause at DFARS (48 CFR 252.277-7013). The
  40. Proprietor of the compilation of the Programs and the CD-ROM is Ziff-Davis
  41. Press, an imprint of Macmillan Computer Publishing USA, 5903 Christie
  42. Avenue, Emeryville, CA 94608.

  44. Limited Warranty. Macmillan Computer Publishing USA warrants the
  45. physical CD-ROM to be free of defects in materials and workmanship under
  46. normal use for a period of 30 days from the purchase date. If Macmillan
  47. Computer Publishing USA receives written notification within the
  48. warranty period of defects in materials or workmanship in the physical
  49. CD-ROM, and such
  50. notification is determined by Macmillan Computer Publishing USA to be
  51. correct, Macmillan Computer Publishing USA will, at its option, replace the
  52. defective CD-ROM or refund a prorata portion of the purchase price of the
  53. book. THESE ARE YOUR SOLE REMEDIES FOR ANY BREACH OF WARRANTY.

  55. EXCEPT AS SPECIFICALLY PROVIDED ABOVE, THE CD-ROM AND THE
  56. PROGRAMS ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND.
  57. NEITHER MACMILLAN COMPUTER PUBLISHING USA NO THE SUPPLIERS MAKE
  58. ANY WARRANTY OF ANY KIND AS TO THE ACCURACY OR COMPLETENESS OF
  59. THE CD-ROM OR THE PROGRAMS OR THE RESULTS TO BE OBTAINED FROM
  60. USING THE CD-ROM OR THE PROGRAMS AND NEITHER MACMILLAN COMPUTER
  61. PUBLISHING USA NOR THE SUPPLIERS SHALL BE RESPONSIBLE FOR ANY
  62. CLAIMS ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN
  63. THE CD-ROM OR THE PROGRAMS. THE ENTIRE RISK AS TO THE RESULTS AND
  64. PERFORMANCE OF THE CD-ROM AND THE PROGRAMS IS ASSUMED BY THE
  65. USER.

  67. FURTHER, NEITHER MACMILLAN COMPUTER PUBLISHING USA NOR THE
  68. SUPPLIERS MAKE ANY REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS
  69. OR IMPLIED, WITH RESPECT TO THE CD-ROM
  70. OR THE PROGRAMS,

  72. INCLUDING BUT NOT LIMITED TO, THE QUALITY, PERFORMANCE,
  73. MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OF THE CD-ROM
  74. OR THE PROGRAMS. IN NO EVENT SHALL MACMILLAN
  75. COMPUTER PUBLISHING USA OR THE SUPPLIERS BE LIABLE FOR DIRECT,
  76. INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT
  77. THE USE OF OR INABILITY TO USE THE CD-ROM OR THE PROGRAMS OR FOR ANY
  78. LOSS OR DAMAGE OF ANY NATURE CAUSED TO ANY PERSON OR PROPERTY AS A
  79. RESULT OF THE USE OF THE CD-ROM OR THE PROGRAMS, EVEN IF MACMILLAN
  80. COMPUTER PUBLISHING USA OR THE SUPPLIERS HAVE BEEN SPECIFICALLY
  81. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NEITHER MACMILLAN
  82. COMPUTER PUBLISHING USA NOR THE SUPPLIERS ARE RESPONSIBLE FOR ANY
  83. COSTS INCLUDING, BUT NOT LIMITED TO, THOSE INCURRED AS A RESULT OF
  84. LOST PROFITS OR REVENUE, LOSS OF USE OF THE CD-ROM OR THE 
  85. PROGRAMS, LOSS OF DATA, THE COSTS OF RECOVERING SOFTWARE OR DATA,
  86. OR THIRD-PARTY CLAIMS. IN NO EVENT WILL MACMILLAN COMPUTER
  87. PUBLISHING USA' OR THE SUPPLIERS' LIABILITY FOR ANY DAMAGES TO YOU
  88. OR ANY OTHER PARTY EVER EXCEED THE PRICE OF THIS BOOK. NO SALES
  89. PERSON OR OTHER REPRESENTATIVE OF ANY PARTY INVOLVED IN THE
  90. DISTRIBUTION OF THE CD-ROM IS AUTHORIZED TO MAKE ANY MODIFICATIONS
