  1. This is a license agreement and not an agreement for sale. Imspace
  2. Systems hereby grants to you a non-exclusive, non-transferable license
  3. to use only one copy of the Software in the manner specified below
  4. according to the following terms and conditions:

  6. STANDARD USE LICENSE
  7.  
  8. For stand-alone/single computer use of software you may:
  9.  
  10. * install the Software on one computer; or
  11.  
  12. * transfer the Software from one computer to another (either by
  13. electronically downloading the Software or by making a copy of the
  14. Software diskettes) provided that the software is installed on one
  15. computer at a time.
  16.  
  17. - OR - For concurrent use of the software on a LAN you may:
  18.  
  19. install the Software on only one network server and concurrently have
  20. a single user access the Software from such network; or
  21.  
  22. increase by one (1) count the number of concurrent users entitled to
  23. use the Software on a network server.
  24.  
  25. YOU MAY NOT:
  26.  
  27. * Simultaneously use the Software on more than one computer at a time,
  28. regardless of whether such computer is a stand-alone unit, a portable
  29. unit or part of a computer network.
  30.  
  31. * Use, copy, transfer copies of this Software except as provided in
  32. this License Agreement.
  33.  
  34. * Alter, merge, modify or adapt this Software in any way including
  35. disassembling or decompiling .
  36.  
  37. * Loan, rent, lease, or sub license this Software or any copy.

  39.  
  40. LIMITED WARRANTY
  41.  
  42. You assume all responsibility for the selection of the Software as
  43. appropriate to achieve the results you intend. Imspace Systems
  44. warrants that the enclosed diskette medium upon which the Software is
  45. recorded shall be free from defects in material and workmanship under
  46. normal use and condition, and that the Software shall perform
  47. substantially as described in its documentation for a period of thirty
  48. (30) days from purchase. EXCEPT FOR THE FORGOING LIMITED WARRANTY, THE
  49. SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND
  50. EITHER EXPRESSED OR IMPLIED, STATUTORY OR IN ANY COMMUNICATION WITH
  51. YOU, AND SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF
  52. NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR
  53. PURPOSE.

  55. The warranty and remedies set forth above are exclusive and in lieu of
  56. all others, oral, written, express or implied. No Imspace Systems
  57. dealer, distributor, agent or employee is authorized to make any
  58. modification or addition to this warranty.

  60. LIMITATION OF LIABILITY

  62. IMSPACE SYSTEMS CORPORATION'S TOTAL LIABILITY ARISING OUT OF THIS
  63. LICENSE AND YOUR USE OF THE SOFTWARE AND DOCUMENTATION PURSUANT TO
  64. THIS LICENSE WILL BE LIMITED TO THE AMOUNT YOU PAID FOR THIS SOFTWARE
  65. LICENSE. IN NO EVENT WILL IMSPACE SYSTEMS CORPORATION BE LIABLE FOR
  66. ANY LOSS OF DATA, LOST PROFITS, COST OF COVER OR OTHER SPECIAL,
  67. INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF THIS
  68. LICENSE OR THE USE OF THE PROGRAM OR ACCOMPANYING DOCUMENTATION,
  69. HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY. THIS LIMITATION WILL
  70. APPLY EVEN IF IMSPACE SYSTEMS CORPORATION OR AN AUTHORIZED DEALER HAS
  71. BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, AND NOTWITHSTANDING
  72. ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. YOU
  73. ACKNOWLEDGE THAT THE LICENSE FEE REFLECTS THIS ALLOCATION OF RISK.

  75. U.S. GOVERNMENT RESTRICTED RIGHTS

  77. The enclosed software and documentation are provided with RESTRICTED
  78. AND LIMITED RIGHTS. Use, duplication, or disclosure by the Government
  79. is subject to restrictions as set forth in FAR 52.227-14 (June 1987)
  80. Alternate 111(g)(3) (June 1987), FAR 52.227-19(June 1987), or DFARS
  81. 252.227-013 (c)(1)(ii)(June 1988), as applicable.

  85. GENERAL This Agreement will be governed by the law of the State of
  86. California, without reference to conflict of laws principles. . This
  87. Agreement is the entire agreement between us and supersedes any other
  88. communications or advertising with respect to the program and
  89. accompanying documentation. . If any provision of this Agreement is
  90. held invalid, the remainder of this Agreement shall continue in full
  91. force and effect. . The export of this product is restricted by U.S.
  92. Export regulations.
