LEGGERE QUESTO DOCUMENTO CON ATTENZIONE PRIMA DI INSTALLARE
IL SOFTWARE. L'INSTALLAZIONE E L'USO DEL SOFTWARE IMPLICA
L'ACCETTAZIONE DEI TERMINI DEL PRESENTE ACCORDO. SE NON SI
CONDIVIDONO I TERMINI DELL'ACCORDO, NON INSTALLARE N╔ USARE
IL SOFTWARE, RESTITUIRE ENTRO 15 GIORNI IL SOFTWARE, TUTTA LA
DOCUMENTAZIONE E GLI ELEMENTI DI ACCOMPAGNAMENTO AL
RIVENDITORE PER OTTENERE UN RIMBORSO.
Il presente costituisce l'accordo legale fra l'utente e la Creative
Technology Ltd. e le sue consociate ("Creative"). Questo accordo
stabilisce i termini e le condizioni in base ai quali la Creative
concede la licenza del software incluso nella confezione insieme
alla relativa documentazione includendo, senza limitazione, i
programmi, i driver, le librerie e i file di dati associati a tali
programmi (definiti "Software").
LICENZA
1. Concessione della licenza
Il Software non viene venduto, bens∞ concesso in licenza
all'utente in conformitα ai termini di questo Accordo.
L'acquirente Φ proprietario del disco e dei supporti in
cui viene originariamente o successivamente registrato il
Software, ma il titolo e la proprietα del Software e la
documentazione correlata restano della Creative, la quale si
riserva tutti i diritti non esplicitamente concessi
all'utente.
La licenza di cui alla sezione 1 Φ concessa a condizione che
venga rispettata la conformitα a tutti gli obblighi previsti
dal presente Contratto. Creative concede il diritto di
utilizzare il software, interamente o in parte, purchΘ:
(a) il Software non sia distribuito per profitto;
(b) il Software sia utilizzato solo con la famiglia di
prodotti Creative;
(c) il software NON venga modificato;
(d) vengano rispettati tutti i diritti di copyright sul
Software e
(e) il licenziatario/utente finale concordi di essere
vincolato ai termini del presente contratto.
2. Utilizzo su un solo computer
Il Software pu≥ essere utilizzato su un solo computer alla
volta da un solo utente. ╚ consentito trasferire la porzione
del Software leggibile dalla macchina da un computer ad
un altro, a condizione che
(a) il Software (compresa qualsiasi porzione o copia dello
stesso) venga cancellato dal primo computer e che
(b) non esista la possibilitα che il Software sia
utilizzato su pi∙ computer contemporaneamente.
3. Stand-alone
L'utilizzo del Software Φ consentito solo su base
stand-alone, ossia il Software e le funzioni da esso fornite
devono essere accessibili solo alle persone fisicamente
presenti alla postazione del computer dove Φ caricato il
Software. Non Φ consentito l'accesso remoto del Software
o delle funzioni da esso fornite o la trasmissione di tutto
o parte del Software mediante rete o linee di comunicazione.
4. Copyright
Il Software Φ di proprietα della Creative ed Φ protetto
dalle leggi del copyright degli Stati Uniti e dai termini
dei trattati internazionali. L'utente non Φ autorizzato a
rimuovere le note di copyright da nessuna copia del Software
nΘ da nessuna copia del materiale scritto di accompagnamento
al Software, se esistente.
5. Copia di riserva
╚ consentito effettuare una (1) copia di riserva della
porzione del Software leggibile dalla macchina, solo in
supporto all'uso del Software su un solo computer, a
condizione che sulla copia siano riprodotte tutte le note di
copyright e dei diritti proprietari incluse negli originali
del Software.
6. Inserimento e integrazione non consentiti
Non Φ consentito inserire o integrare alcuna porzione del
Software con altri programmi, tranne che nei limiti
consentiti dalle norme delle singole giurisdizioni.
Qualsiasi porzione del Software inserita o integrata ad
altro programma continuerα ad essere soggetta ai termini
e alle condizioni di questo Accordo. Le note di copyright e
dei diritti proprietari presenti negli originali devono
essere riprodotte sulla porzione inserita o integrata.
7. Versione di rete
Se Φ stata acquistata una versione del Software per la rete,
questo Accordo si riferisce all'installazione del Software
su un solo "file server". Il Software non pu≥ essere copiato
su pi∙ sistemi. Ciascun "nodo" collegato al "file server"
deve disporre della propria "copia" del Software e della
relativa licenza per quell'utente specifico.
8. Trasferimento della licenza
╚ consentito trasferire la licenza del Software, a
condizione che
(a) siano trasferite tutte le porzioni del Software o copie
dello stesso,
(b) non siano conservate porzioni del Software o copie dello
stesso e
(c) il cessionario legga e accetti i termini e le condizioni
di questo Accordo.
9. Limiti di utilizzo, copia e modifica del Software
Non Φ possibile utilizzare, copiare o modificare il Software
nΘ concedere in sublicenza alcuno dei diritti contemplati
nel presente Accordo salvo nei limiti espressamente
consentiti dal presente Accordo o dalle norme vigenti nelle
singole giurisdizioni. Il software pu≥ essere utilizzato
solo per uso personale e non per la creazione di
videocassette di visione pubblica.
10. Decompilazione, disassemblaggio e retroingegnerizzazione
L'utente riconosce che il Software contiene segreti
commerciali e altre informazioni proprietarie della Creative
e dei relativi licenziatori. Tranne che nei limiti
consentiti dal presente Accordo e dalle norme delle singole
giurisdizioni, non sono permessi la decompilazione, il
disassemblaggio e la retroingegnerizzazione del Software, nΘ
Φ consentito intraprendere attivitα allo scopo di ottenere
informazioni non accessibili all'utente durante il normale
utilizzo del Software.
In particolare non Φ consentito, per nessuno scopo,
trasmettere il Software, visualizzare il codice oggetto del
Software sullo schermo di qualsiasi computer o creare copie
cartacee del contenuto della memoria relativo al codice
oggetto del Software. Qualora siano necessarie informazioni
sull'interoperabilitα del Software con altri programmi, non
decompilare nΘ disassemblare il Software ma richiedere tali
informazioni alla Creative all'indirizzo riportato di
seguito. Al ricevimento di tale richiesta, la Creative
stabilirα se queste informazioni sono necessarie per uno
scopo legittimo e, in caso affermativo, le fornirα entro un
lasso di tempo e a condizioni ragionevoli.
In ogni caso, l'utente Φ tenuto a notificare alla Creative
qualsiasi informazione ottenuta mediante
retroingegnerizzazione o attivitα similari, i risultati
delle quali saranno ritenuti informazioni confidenziali
di proprietα della Creative che possono essere utilizzate
solo in connessione con il Software.
11. Per il software con funzioni CDDB.
Questa applicazione pu≥ contenere software di CDDB, Inc. of
Berkeley, California, societα in affari come Gracenote
("Gracenote"). Il software di Gracenote (il "Client CDDB
Gracenote") consente all'applicazione di effettuare
l'identificazione del disco online e ottenere dati musicali,
quali titolo, artista e traccia, ("Dati Gracenote") dai
server online ("Server CDDB Gracenote") ed eseguire altre
funzioni. I Dati Gracenote possono essere utilizzati solo
per mezzo delle funzioni dell'applicazione software
destinate all'Utente finale.
L'utente accetta di utilizzare i Dati Gracenote, il Client
CDDB Gracenote e i Server CDDB Gracenote solo per scopi
personali e non commerciali. L'utente accetta di non
assegnare, copiare, trasferire o trasmettere a terzi il
Client CDDB Gracenote o i Dati Gracenote. L'UTENTE ACCETTA
DI NON UTILIZZARE O SFRUTTARE I DATI GRACENOTE, IL CLIENT
CDDB GRACENOTE O I SERVER CDDB GRACENOTE IN MODI DIVERSI DA
QUANTO QUI ESPRESSAMENTE CONSENTITO.
L'utente accetta che la sua licenza non esclusiva
all'utilizzo dei Dati Gracenote, del Client CDDB
Gracenote e dei Server CDDB Gracenote sarα revocata qualora
non rispetti queste restrizioni. In caso di revoca della
licenza, l'utente accetta di cessare ogni e qualsiasi
utilizzo dei Dati Gracenote, del Client CDDB Gracenote e dei
Server CDDB Gracenote. Gracenote riserva tutti i diritti sui
Dati Gracenote, sul Client CDDB Gracenote e sui Server CDDB
Gracenote, inclusi tutti i diritti di proprietα. L'utente
accetta che CDDB, Inc. pu≥ far valere i propri diritti in
base al presente Contratto direttamente a nome proprio.
Il Client CDDB Gracenote e ogni elemento dei Dati Gracenote
sono concessi in licenza "COS╠ COME SONO".
Gracenote non dichiara alcunchΘ nΘ offre alcuna garanzia,
espressa o implicita, relativamente all'accuratezza dei Dati
Gracenote provenienti dai Server CDDB Gracenote. Gracenote
si riserva il diritto di eliminare i dati dai Server CDDB
Gracenote o di modificare le categorie di dati per qualsiasi
regione ritenga sufficiente. Gracenote non garantisce in
alcun modo che il Client CDDB Gracenote o i Server
CDDB Gracenote siano privi di errori o che il loro
funzionamento sarα ininterrotto. Gracenote non Φ tenuta
a fornire all'utente tipi o categorie di dati migliorati o
addizionali che decida di introdurre in futuro ed Φ libera
di interrompere i suoi servizi online in qualunque momento.
GRACENOTE NEGA QUALSIASI GARANZIA ESPRESSA O IMPLICITA,
COMPRESE, IN VIA ESEMPLIFICATIVA, LE GARANZIE IMPLICITE DI
COMMERCIABILIT└, IDONEIT└ AD USO SPECIFICO, TITOLO E NON
VIOLAZIONE DEI DIRITTI ALTRUI. Gracenote non garantisce i
risultati ottenuti con l'uso del Client CDDB Gracenote
o dei Server CDDB Gracenote. IN NESSUNA CIRCOSTANZA
GRACENOTE POTR└ ESSERE RITENUTA RESPONSABILE PER
DANNI CONSEQUENZIALI O INCIDENTALI O PER MANCATI PROFITTI.
RESCISSIONE
La licenza concessa all'utente Φ valida fino a quando non viene
rescissa. ╚ possibile rescindere dalla licenza in qualsiasi momento
restituendo il Software alla Creative con tutte le porzioni e copie
dello stesso. La licenza termina automaticamente e senza notifica
della Creative in caso di mancato adempimento da parte dell'utente
dei termini e delle condizioni di questo Accordo. Al termine della
licenza, l'utente deve restituire alla Creative il Software,
comprese eventuali porzioni e copie dello stesso. Al termine della
licenza, la Creative pu≥ impugnare i diritti consentiti dalla legge.
I termini dell'Accordo che tutelano i diritti proprietari della
Creative saranno validi anche dopo la rescissione della licenza.
NESSUNA GARANZIA
La Creative non garantisce che le funzioni contenute nel Software
soddisferanno i requisiti dell'utente o che il funzionamento del
Software sarα continuo, privo di errori e privo di codici maligni.
Per codice maligno si intenda qualsiasi codice di programma
progettato per contaminare altri programmi del computer, per
modificare, distruggere, registrare o trasmettere dati o in
qualsiasi altro modo alterare il normale funzionamento del computer,
del sistema o della rete. In questa denominazione rientrano anche i
virus, come cavalli di Troia, dropper, worm, logic bomb e virus
simili.
INDENNIZZO DA PARTE DELL'UTENTE
Se si distribuisce il Software in violazione del presente Contratto,
si Φ tenuti a indennizzare, proteggere e difendere Creative da
qualsiasi eventuale reclamo o procedimento legale, nonchΘ a
rimborsare eventuali spese legali o costi incorsi, derivati o
relativi all'uso o alla distribuzione del Software in violazione del
presente Contratto.
IL SOFTWARE ╚ FORNITO COME ╚, SENZA GARANZIE DI ALCUN TIPO,
ESPLICITE O IMPLICITE, COMPRESE, MA NON ESCLUSIVAMENTE, EVENTUALI
GARANZIE IMPLICITE DI COMMERCIABILIT└ O IDONEIT└ A UNO SCOPO
PARTICOLARE, TITOLO O NON VIOLAZIONE DI DIRITTI. LA CREATIVE NON
RICONOSCE ALCUN OBBLIGO DI FORNIRE AGGIORNAMENTI O SUPPORTO
TECNICO PER IL SOFTWARE.
Inoltre, la Creative non Φ responsabile dell'accuratezza delle
informazione fornite dal Supporto tecnico Creative o di terzi nΘ dei
danni causati, sia direttamente che indirettamente, da azioni
intraprese o omissioni commesse dall'utente in seguito alla
consulenza fornita dal Supporto tecnico.
L'utente si assume la piena responsabilitα della scelta del Software
per il raggiungimento dell'esito desiderato, e dell'installazione,
utilizzo e risultati ottenuti dal Software. L'utente si assume
inoltre l'intero rischio per quanto riguarda la qualitα e le
prestazioni del Software. Se il Software dovesse rivelarsi
danneggiato, l'utente (e non la Creative, i distributori o i
rivenditori) si assume l'intero costo dei servizi necessari alla
riparazione o alla correzione del difetto.
Alcuni Paesi o Stati non consentono l'esclusione di garanzie
implicite, quindi l'esclusione sopra menzionata potrebbe non essere
applicabile. La Creative nega qualsiasi garanzia se il Software Φ
stato personalizzato, riconfezionato o modificato in qualsiasi modo
da terzi.
LIMITAZIONE DEI PROVVEDIMENTI E RISARCIMENTO DANNI
IN NESSUN CASO CREATIVE O I SUOI CONCESSIONARI SARANNO RESPONSABILI
DUI DANNI, INDIRETTI, ACCIDENTALI, PARTICOLARI O CONSEGUENTI, O PER
DANNI O LESIONI PERSONALI (INCLUSO IL DECESSO) ASCRIVIBILI A
NEGLIEGENZA DA PARTE DI CREATIVE, O DI EVENTUALI PERDITE DI
PROFITTI, RISPARMI,UTILIZZO, ENTRATE O DATI DERIVATI O RELATIVI AL
SOFTWARE O AL PRESENTE CONTRATTO, ANCHE NEL CASO IN CUI CREATIVE O
I SUOI CONCESSIONARI SIANO STATI INFORMATI DELLAPOSSIBILIT└ DI
TALI DANNI. IN NESSUN CASO LA RESPONSABILIT└ O IL RISARCIMENTO DEI
DANNI SUPERER└ LA SOMMA VERSATA DALL'ACQUIRENTE PER L'UTILIZZO DEL
SOFTWARE, INDIPENDENTEMENTE DALLA FORMA DEL RECLAMO.
Alcuni Paesi/Stati non consentono la limitazione o l'esclusione
della responsabilitα per danni incidentali o consequenziali, quindi
l'esclusione sopra menzionata potrebbe non essere applicabile.
RESTITUZIONE DEL PRODOTTO
In caso sia necessario inviare il Software alla Creative o ad un
distributore o rivenditore autorizzato, effettuare la spedizione
porto franco e assicurare il Software o assumere il rischio di
perdita o danni durante il trasporto.
"RESTRICTED RIGHTS" DEL GOVERNO USA
Il Software e la relativa documentazione vengono forniti con
"restricted rights". L'utilizzo, la duplicazione e la divulgazione
da parte del governo USA sono soggetti alle restrizioni di cui alla
clausola 252.227-7013, (b)(3)(ii) di "Rights in Technical Data and
Computer Software". In caso di concessione di sottolicenza o
di utilizzo del Software al di fuori degli Stati Uniti, la legge
applicabile sarα quella locale, la normativa di controllo delle
esportazioni USA e la versione inglese del presente Accordo.

INFORMAZIONI DI CARATTERE GENERALE
Il presente Accordo Φ vincolante per l'utente, gli eventuali
dipendenti, datori di lavoro, fornitori e rappresentanti,
nonchΘ per qualsiasi successore e cessionario. NΘ il Software nΘ
altre informazioni da esso derivanti possono essere esportate, se
non in conformitα alle leggi degli Stati Uniti o ad altre
disposizioni applicabili. Questo Accordo va interpretato secondo le
leggi dello Stato della California, ad eccezione della legge ederale
che regola il copyright e i marchi registrati. Il presente Contratto
rappresenta l'intero accordo tra Creative e l'utente. Si concorda
che Creative non avrα alcuna responsabilitα in caso di informazioni
o dichiarazioni errate rese da Creative, dai suoi agenti o da
chiunque altro (in buona fede o per negligenza) utilizzate dagli
utenti a seguito del presente Contratto, a meno che tali
informazioni o dichiarazione errate siano rese con intenzioni
dolose. Il presente Contratto sostituisce qualsiasi altra intesa o
accordo, compresi, ma non esclusivamente, gli accordi pubblicitari
in merito al Software. Qualora una clausola dell'Accordo fosse
ritenuta contraria alle norme di legge da un Foro competente, tale
clausola verrα modificata in modo da divenire valida, mentre le
restanti disposizioni rimarranno in vigore. Per domande relative
all'Accordo, contattare la Creative all'indirizzo riportato sopra.
Per domande di natura tecnica o relative al prodotto, contattare il
Centro di assistenza tecnica Creative pi∙ vicino.
Questo pacchetto pu≥ contenere software con funzionalitα Audio-DVD
per la riproduzione di dischi audio-DVD a contenuto protetto. La
funzionalitα di questo Software pu≥ essere compromessa dal
mancato funzionamento del sistema di protezione. In tale evenienza,
l'unico modo per ripristinare la funzionalitα consiste nello
scaricare un aggiornamento del prodotto dal sito Web di Creative;
se l'utente non dispone di accesso a Internet, Creative ricorrerα a
un altro metodo commercialmente accettabile per fornirgli un
software sostitutivo.
AGGIUNTA AL CONTRATTO MICROSOFT PER IL PRODOTTO SOFTWARE

IMPORTANTE: Utilizzando i file del software Microsoft (il "Software
Microsoft") forniti con questa Aggiunta, l'utente si impegna a
rispettare le condizioni riportate in questa Aggiunta. Se non si
accetta di rispettare queste condizioni, non Φ possibile utilizzare
il Software Microsoft.
Il Software Microsoft Φ fornito al solo scopo di sostituire i file
corrispondenti forniti con una copia in licenza precedente del
prodotto software Microsoft ("PRODOTTO ORIGINALE"). Al momento
dell'installazione, i file del Software Microsoft diventano parte
del PRODOTTO ORIGINALE e sono quindi soggetti agli stessi termini
e condizioni di garanzia e licenza del PRODOTTO ORIGINALE. Se non si
dispone di una licenza valida per l'uso del PRODOTTO ORIGINALE, non
Φ possibile utilizzare il Software Microsoft. L'uso del Software
Microsoft per scopi diversi da quelli qui indicati Φ vietato.
Nessuna parte del presente Contratto potrα essere interpretata
come un sostegno o un'autorizzazione da parte di Creative a
violare le leggi locali e/o internazionali applicabili alla
propria giurisdizione.
ADDENDUM DRM AL CONTRATTO MICROSOFT WMFSDK9 SERIES
==================================================================
I fornitori di contenuti utilizzano la tecnologia digitale di
Microsoft di gestione dei diritti per Windows Media ("WM-DRM"),
distribuita con questo software, per proteggere l'integritα dei
propri contenuti ("Contenuto protetto") in modo da prevenire
l'abuso delle proprie proprietα intellettuali, inclusi i copyright,
su tali contenuti. Porzioni di questo software e altre applicazioni
di terze parti utilizzano WM-DRM per la riproduzione del Contenuto
protetto ("Software WM-DRM"). Se la sicurezza del Software WM-DRM
viene compromessa, i proprietari del Contenuto protetto
("Proprietari del Contenuto protetto") possono richiedere a Microsoft
di revocare i diritti di copia, visualizzazione e/o riproduzione
del Contenuto protetto attribuiti al Software WM-DRM. Tale revoca
non impedisce la riproduzione di contenuti non protetti da parte
del Software WM-DRM. Quando si scarica una icenza per Contenuto
protetto da Internet, viene inviato al computer un elenco di
Software WM-DRM revocato. Microsoft pu≥ anche scaricare sul
computer, assieme alla licenza, un elenco di revoche da parte dei
Proprietari del Contenuto protetto. I Proprietari del Contenuto
protetto possono inoltre richiedere all'utente di aggiornare alcuni
dei componenti WM-DRM distribuiti con questo software
("Aggiornamento WM-DRM") prima di concedere l'accesso ai loro
contenuti. Quando si cerca di riprodurre tali contenuti, il Software
WM-DRM sviluppato da Microsoft avvisa l'utente che Φ necessario un
Aggiornamento WM-DRM e richiede il consenso dell'utente prima di
scaricare l'Aggiornamento WM-DRM. Il Software WM-DRM non
sviluppato da Microsoft potrebbe operare in modo analogo. Se
l'utente rifiuta di effettuare l'Aggiornamento WM-DRM, non sarα
in grado di accedere al contenuto che lo richiede, anche se potrα
continuare ad accedere ai contenuti non protetti e al Contenuto
protetto che non richiede l'aggiornamento. Le funzioni WM-DRM che
accedono a Internet, ad esempio per l'acquisizione di nuove
licenze e/o degli Aggiornamenti WM-DRM necessari, possono essere
disattivate. Quando tali funzioni sono disattivate, l'utente pu≥
continuare a riprodurre il Contenuto protetto per il quale dispone
di una licenza valida memorizzata sul computer.
CLAUSOLE SPECIALI PER L'UNIONE EUROPEA

SE IL SOFTWARE ╚ STATO ACQUISTATO IN UN PAESE DELL'UNIONE EUROPEA,
SONO VALIDE ANCHE LE CLAUSOLE RIPORTATE DI SEGUITO. iN CASO DI
INCONGRUENZA TRA I TERMINI DELL'ACCORDO DI LICENZA RIPORTATO SOPRA
E LE CLAUSOLE SEGUENTI, QUEST'ULTIME AVRANNO LA PRIORIT└.
DECOMPILAZIONE
Non Φ consentito, per nessuno scopo, trasmettere il Software,
visualizzare il codice oggetto del Software sullo schermo di
qualsiasi computer o creare copie cartacee del contenuto della
memoria relativo al codice oggetto del Software. Qualora siano
necessarie informazioni sull'interoperabilitα del Software con altri
programmi, non decompilare nΘ disassemblare il Software ma
richiedere tali informazioni alla Creative all'indirizzo riportato
in precedenza. Una volta ricevuta tale richiesta, la Creative
stabilirα se queste informazioni sono necessarie per uno scopo
legittimo e, in caso affermativo, le fornirα entro un lasso di tempo
e a condizioni ragionevoli.
GARANZIA LIMITATA
AD ECCEZIONE DI QUANTO PRECEDENTEMENTE INDICATO NEL PRESENTE
CONTRATTO E COME INDICATO NELLA SEZIONE RELATIVA AI DIRITTI LEGALI,
IL SOFTWARE ╚ FORNITO COME ╚ SENZA GARANZIA DI ALCUN TIPO, ESPLICITA
O IMPLICITA, COMPRESE, MA NON ESCLUSIVAMENTE, EVENTUALI GARANZIE
IMPLICITE O CONDIZIONI DI COMMERCIABILIT└, QUALIT└ O IDONEIT└ A
UNO SCOPO PARTICOLARE, TITOLO O NON VIOLAZIONE DI DIRITTI.
LIMITI DEI RIMEDI E DEI RISARCIMENTI DANNI I LIMITI DEI RIMEDI E DEI
RISARCIMENTI DANNI PREVISTI NEL PRESENTE ACCORDO NON SONO VALIDI IN
CASO DI LESIONI PERSONALI (INCLUSO IL DECESSO) CAUSATE DALLA
NEGLIGENZA DELLA CREATIVE E SONO SOGGETTI ALLE CLAUSOLE RIPORTATE
NEL PARAGRAFO INTITOLATO "DIRITTI STATUTARI".
DIRITTI STATUTARI

CREATIVE END-USER SOFTWARE LICENSE AGREEMENT
Version 2.6, March 2003

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE INSTALLING THE SOFTWARE.
BY INSTALLING AND USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE
TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS
AGREEMENT, DO NOT INSTALL OR USE THE SOFTWARE. PROMPTLY RETURN,
WITHIN 15 DAYS, THE SOFTWARE, ALL RELATED DOCUMENTATION AND
ACCOMPANYING ITEMS TO THE PLACE OF ACQUISITION FOR A REFUND.
This is a legal agreement between you and Creative Technology Ltd.
and its subsidiaries ("Creative"). This Agreement states the terms
and conditions upon which Creative offers to license the software
sealed in the disk package together with all related documentation
and accompanying items including, but not limited to, the
executable programs, drivers, libraries and data files associated
with such programs (collectively, the "Software").
LICENSE
1. Grant of License
The Software is licensed, not sold, to you for use only
under the terms of this Agreement. You own the disk or other
media on which the Software is originally or subsequently
recorded or fixed; but,as between you and Creative (and, to
the extent applicable, its licensors), Creative retains all
title to and ownership of the Software and reserves all
rights not expressly granted to you. The license under this
Section 1 is conditioned upon your compliance with all of
your obligations under this Agreement. Creative grants to you
the right to use all or a portion of this Software provided that
(a) the Software is not distributed for profit;
(b) the Software is used only in conjunction with Creative's
family of products;
(c) the Software may NOT be modified;
(d) all copyright notices are maintained on the Software; and
(e) the licensee/end-user agrees to be bound by the terms of
this agreement.
2. For Use on a Single Computer
The Software may be used only on a single computer by a
single user at any time. You may transfer the machine-readable
portion of the Software from one computer to another computer,
provided that
(a) the Software (including any portion or copy thereof) is
erased from the first computer and
(b) there is no possibility that the Software will be used on
more than one computer at a time.
3. Stand-Alone Basis
You may use the Software only on a stand-alone basis, such
that the Software and the functions it provides are accessible
only to persons who are physically present at the location of the
computer on which the Software is loaded. You may not allow the
Software or its functions to be accessed remotely, or transmit
all or any portion of the Software through any network or
communication line.
4. Copyright
The Software is owned by Creative and/or its licensors and is
protected by United States copyright laws and international
treaty provisions. You may not remove the copyright notice
from any copy of the Software or any copy of the written
materials, if any, accompanying the Software.
5. One Archival Copy
You may make one (1) archival copy of the machine-readable
portion of the Software for backup purposes only in support
of your use of the Software on a single computer, provided
that you reproduce on the copy all copyright and other
proprietary rights notices included on the originals of the
Software.
6. No Merger or Integration
You may not merge any portion of the Software into, or
integrate any portion of the Software with, any other
program, except to the extent expressly permitted by the
laws of the jurisdiction where you are located. Any portion
of the Software merged into or integrated with another
program, if any, will continue to be subject to the terms
and conditions of this Agreement, and you must reproduce on
the merged or integrated portion all copyright and other
proprietary rights notices included in the originals of
the Software.
7. Network Version
If you have purchased a "network" version of the Software,
this Agreement applies to the installation of the Software
on a single "file server". It may not be copied onto
multiple systems. Each "node" connected to the "file server"
must also have its own license of a "node copy" of the
Software, which becomes a license only for that specific
"node".
8. Transfer of License
You may transfer your license of the Software, provided that
(a) you transfer all portions of the Software or copies
thereof,
(b) you do not retain any portion of the Software or any
copy thereof, and
(c) the transferee reads and agrees to be bound by the
terms and conditions of this Agreement.
9. Limitations on Using, Copying, and Modifying the Software
Except to the extent expressly permitted by this Agreement
or by the laws of the jurisdiction where you acquired the
Software, you may not use, copy or modify the Software. Nor
may you sub-license any of your rights under this Agreement.
You may use the software for your personal use only, and not
for public performance or for the creation of publicly
displayed videotapes.
10. Decompiling, Disassembling, or Reverse Engineering.
You acknowledge that the Software contains trade secrets and
other proprietary information of Creative and its licensors.
Except to the extent expressly permitted by this Agreement
or by the laws of the jurisdiction where you are located,
you may not decompile, disassemble or otherwise reverse
engineer the Software, or engage in any other activities to
obtain underlying information that is not visible to the
user in connection with normal use of the Software.
In particular, you agree not for any purpose to transmit the
Software or display the Software's object code on any
computer screen or to make any hardcopy memory dumps of the
Software's object code. If you believe you require
information related to the interoperability of the Software
with other programs, you shall not decompile or disassemble
the Software to obtain such information, and you agree to
request such information from Creative at the address listed
below. Upon receiving such a request, Creative shall
determine whether you require such information for a
legitimate purpose and, if so, Creative will provide such
information to you within a reasonable time and on
reasonable conditions.
In any event, you will notify Creative of any information
derived from reverse engineering or such other activities,
and the results thereof will constitute the confidential
information of Creative that may be used only in connection
with the Software.
11. For Software With CDDB Features.
This application may contain software from CDDB, Inc. of
Berkeley, California d/b/a Gracenote ("Gracenote"). The
software from Gracenote (the "Gracenote CDDB Client")
enables the application to do online disc identification
and obtain music-related information, including name,
artist, track, and title information ("Gracenote Data")
from online servers ("Gracenote CDDB Servers") and to
perform other functions. You may use Gracenote Data
only by means of the intended End User functions of the
application software.
You agree that you will use Gracenote Data, the Gracenote
CDDB Client, and Gracenote CDDB Servers for your own
personal non-commercial use only. You agree not to
assign, copy, transfer or transmit the Gracenote CDDB
Client or any Gracenote Data to any third party. YOU
AGREE NOT TO USE OR EXPLOIT GRACENOTE DATA, THE
GRACENOTE CDDB CLIENT, OR GRACENOTE CDDB SERVERS,
EXCEPT AS EXPRESSLY PERMITTED HEREIN.
You agree that your non-exclusive license to use the
Gracenote Data, the Gracenote CDDB Client, and Gracenote
CDDB Servers will terminate if you violate these
restrictions. If your license terminates, you agree to
cease any and all use of the Gracenote Data, the
Gracenote CDDB Client, and Gracenote CDDB Servers.
Gracenote reserves all rights in Gracenote Data, the
Gracenote CDDB Client, and the Gracenote CDDB Servers,
including all ownership rights. You agree that CDDB,
Inc. may enforce its rights under this Agreement against
you directly in its own name.
The Gracenote CDDB Client and each item of Gracenote
Data are licensed to you "AS IS." Gracenote makes no
representations or warranties, express or implied,
regarding the accuracy of any Gracenote Data from in
the Gracenote CDDB Servers. Gracenote reserves the
right to delete data from the Gracenote CDDB Servers
or to change data categories for any cause that
Gracenote deems sufficient. No warranty is made that
the Gracenote CDDB Client or Gracenote CDDB Servers
are error-free or that functioning of Gracenote CDDB
Client or Gracenote CDDB Servers will be uninterrupted.
Gracenote is not obligated to provide you with any new
enhanced or additional data types or categories that
Gracenote may choose to provide in the future and is
free to discontinue its online services at any time.
GRACENOTE DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED,
INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
TITLE, AND NON-INFRINGEMENT. Gracenote does not warrant
the results that will be obtained by your use of the
Gracenote CDDB Client or any Gracenote CDDB Server. IN NO
CASE WILL GRACENOTE BE LIABLE FOR ANY CONSEQUENTIAL
OR INCIDENTAL DAMAGES OR FOR ANY LOST PROFITS OR
LOST REVENUES.
TERMINATION
The license granted to you is effective until terminated. You may
terminate it at any time by returning the Software (including any
portions or copies thereof) to Creative. The license will also
terminate automatically without any notice from Creative if you
fail to comply with any term or condition of this Agreement. You
agree upon such termination to return the Software (including any
portions or copies thereof) to Creative. Upon termination,
Creative may also enforce any rights provided by law. The
provisions of this Agreement that protect the proprietary rights
of Creative will continue in force after termination.
NO WARRANTY
Creative does not warrant that the functions contained in the
Software will meet your requirements or that the operation of the
Software will be uninterrupted, error-free or free from malicious
code. For purposes of this paragraph, "malicious code" means any
program code designed to contaminate other computer programs or
computer data, consume computer resources, modify, destroy,
record, or transmit data, or in some other fashion usurp the
normal operation of the computer, computer system, or computer
network, including viruses, Trojan horses, droppers, worms, logic
bombs, and the like.
INDEMNIFICATION BY YOU
If you distribute the Software in violation of this Agreement, you
hereby indemnify, hold harmless and defend Creative from and
against any and all claims or lawsuits, including attorney's fees
and costs that arise, result from or are connected with the use or
distribution of the Software in violation of this Agreement.
THE SOFTWARE IS PROVIDED AS-IS WITHOUT WARRANTY OF ANY KIND,
EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY
IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE, TITLE OR NONINFRINGEMENT. CREATIVE IS NOT
OBLIGATED TO PROVIDE ANY UPDATES, UPGRADES OR TECHNICAL SUPPORT
FOR THE SOFTWARE.
Further, Creative shall not be liable for the accuracy of any
information provided by Creative or third party technical support
personnel, or any damages caused, either directly or indirectly,
by acts taken or omissions made by you as a result of such
technical support.
You assume full responsibility for the selection of the Software
to achieve your intended results, and for the installation, use
and results obtained from the Software. You also assume the entire
risk as it applies to the quality and performance of the Software.
Should the Software prove defective, you (and not Creative, or its
distributors or dealers) assume the entire cost of all necessary
servicing, repair or correction.
Some countries/states do not allow the exclusion of implied
warranties, so the above exclusion may not apply to you. Creative
disclaims all warranties of any kind if the Software was customized,
repackaged or altered in any way by any third party other than
Creative.
LIMITATION OF REMEDIES AND DAMAGES
IN NO EVENT WILL CREATIVE OR ITS LICENSORS BE LIABLE FOR ANY
INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR
ANY BODILY INJURY (INCLUDING DEATH) TO ANY PERSONS CAUSED BY
CREATIVE'S NEGLIGENCE, OR FOR ANY LOST PROFITS, LOST SAVINGS,
LOSS OF USE, LOST REVENUES OR LOST DATA ARISING FROM OR RELATING
TO THE SOFTWARE OR THIS AGREEMENT, EVEN IF CREATIVE OR ITS
LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL CREATIVE'S LIABILITY OR DAMAGES TO YOU OR ANY
OTHER PERSON EVER EXCEED THE AMOUNT PAID BY YOU TO USE THE
SOFTWARE, REGARDLESS OF THE FORM OF THE CLAIM.
Some countries/states do not allow the limitation or exclusion of
liability for incidental or consequential damages, so the above
limitation or exclusion may not apply to you.
PRODUCT RETURNS
IF YOU MUST SHIP THE SOFTWARE TO CREATIVE OR AN AUTHORIZED
Creative DISTRIBUTOR OR DEALER, YOU MUST PREPAY SHIPPING AND
EITHER INSURE THE SOFTWARE OR ASSUME ALL RISK OF LOSS OR DAMAGE
IN TRANSIT.
U.S. GOVERNMENT RESTRICTED RIGHTS
All Software and related documentation are provided with
restricted rights. Use, duplication or disclosure by the U.S.
Government is subject to restrictions as set forth in subdivision
(b)(3)(ii) of the Rights in Technical Data and Computer Software
Clause at 252.227-7013. If you are sub-licensing or using the
Software outside of the United States, you will comply with the
applicable local laws of your country, U.S. export control law,
and the English version of this Agreement.

GENERAL
This Agreement is binding on you as well as your employees,
employers, contractors and agents, and on any successors and
assignees. Neither the Software nor any information derived
therefrom may be exported except in accordance with the laws of
the U.S. or other applicable provisions. This Agreement is governed
by the laws of the State of California (except to the extent federal
law governs copyrights and federally registered trademarks). This
Agreement is the entire agreement between us and you agree that
Creative will not have any liability for untrue statement or
representation made by it, its agents or anyone else (whether
innocently or negligently) upon which you relied upon entering this
Agreement, unless such untrue statement or representation was made
fraudulently. This Agreement supersedes any other understandings or
agreements, including, but not limited to, advertising, with
respect to the Software. If any provision of this Agreement is
deemed invalid or unenforceable by any country or government agency
having jurisdiction, that particular provision will be deemed
modified to the extent necessary to make the provision valid and
enforceable, and the remaining provisions will remain in full force
and effect.

matters, contact the Creative technical support center nearest you.
This package may include software with DVD-Audio functionality for
you to play content-protected DVD-Audio discs. The functionality
of this Software may be lost if the content protection system is
compromised. In this event, your sole remedy to restore such
functionality is to download a product update from Creative's
website, of if you do not have internet access, Creative will use
commercially reasonable means to provide replacement software.
ADDENDUM TO THE MICROSOFT SOFTWARE LICENSE AGREEMENT

IMPORTANT: By using the Microsoft software files (the "Microsoft
Software") provided with this Addendum, you are agreeing to be
bound by the following terms. If you do not agree to be bound by
these terms, you may not use the Microsoft Software.
The Microsoft Software is provided for the sole purpose of
replacing the corresponding files provided with a previously
licensed copy of the Microsoft software product ("ORIGINAL
PRODUCT"). Upon installation, the Microsoft Software files become
part of the ORIGINAL PRODUCT and are subject to the same warranty
and license terms and conditions as the ORIGINAL PRODUCT. If you do
not have a valid license to use the ORIGINAL PRODUCT, you may not
use the Microsoft Software. Any other use of the Microsoft Software
is prohibited.
Nothing in this Agreement shall be construed on the part of
Creative as advocating or authorizing the infringement of local
and/or international laws applicable to your jurisdiction.
DRM ADDENDUM TO THE MICROSOFT WMFSDK9 SERIES AGREEMENT

Content providers are using the Microsoft digital rights management
technology for Windows Media distributed with this software ("WM-DRM")
to protect the integrity of their content ("Secure Content") so that
their intellectual property, including copyright, in such content is
not misappropriated. Portions of this software and other third party
applications use WM-DRM to play Secure Content ("WM-DRM Software").
If the WM-DRM Software's security has been compromised, owners of
Secure Content ("Secure Content Owners") may request that Microsoft
revoke the WM-DRM Software's right to copy, display and/or play
Secure Content. Revocation does not alter the WM-DRM Software's
ability to play unprotected content. A list of revoked WM-DRM
Software is sent to your computer whenever you download a license
for Secure Content from the Internet. Microsoft may, in conjunction
with such license, also download revocation lists onto your computer
on behalf of Secure Content Owners. Secure Content Owners may also
require you to upgrade some of the WM-DRM components distributed
with this software ("WM-DRM Upgrades") before accessing their content.
When you attempt to play such content, WM-DRM Software built by
Microsoft will notify you that a WM-DRM Upgrade is required and then
ask for your consent before the WM-DRM Upgrade is downloaded.
Non-Microsoft WM-DRM Software may do the same. If you decline the
upgrade, you will not be able to access content that requires the
WM-DRM Upgrade; however, you will still be able to access unprotected
content and Secure Content that does not require the upgrade. WM-DRM
features that access the Internet, such as acquiring new licenses
and/or performing a required WM-DRM Upgrade, can be switched off.
When these features are switched off, you will still be able to play
Secure Content if you have a valid license for such content already
stored on your computer.
SPECIAL PROVISIONS APPLICABLE TO THE EUROPEAN UNION

If you acquired the Software in the European Union (EU), the
following provisions also apply to you. If there is any
inconsistency between the terms of the Software License Agreement
set out EARLIER and IN the following provisions, the following
provisions shall take precedence.
Decompilation
You agree not for any purpose to transmit the Software or display
the Software's object code on any computer screen or to make any
hard copy memory dumps of the Software's object code. If you
believe you require information related to the interopretability
of the Software with other programs, you shall not decompile or
disassemble the Software to obtain such information, and you agree
to request such information from Creative at the address listed
earlier. Upon receiving such a request, Creative shall determine
whether you require such information for a legitimate purpose and,
if so, Creative will provide such information to you within a
reasonable time and on reasonable conditions.
Limited Warranty
EXCEPT AS STATED EARLIER IN THIS AGREEMENT, AND AS PROVIDED UNDER
THE HEADING "STATUTORY RIGHTS", THE SOFTWARE IS PROVIDED AS-IS
WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING,
BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OR CONDITIONS OF
MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE,
TITLE OR NONINFRINGEMENT.
Limitation of Remedy and Damages
THE LIMITATIONS OF REMEDIES AND DAMAGES IN THE SOFTWARE LICENSE
AGREEMENT SHALL NOT APPLY TO PERSONAL INJURY (INCLUDING DEATH) TO
ANY PERSON CAUSED BY CREATIVE'S NEGLIGENCE AND ARE SUBJECT TO THE
PROVISION SET OUT UNDER THE HEADING "STATUTORY RIGHTS".
Statutory rights
Irish law provides that certain conditions and warranties may be
implied in contracts for the sale of goods and in contracts for the
supply of services. Such conditions and warranties are hereby
excluded, to the extent such exclusion, in the context of this
transaction, is lawful under Irish law. Conversely, such conditions
and warranties, insofar as they may not be lawfully excluded, shall
apply. Accordingly nothing in this Agreement shall prejudice any
rights that you may enjoy by virtue of Sections 12, 13, 14 or 15
of the Irish Sale of Goods Act 1893 (as amended).
General
This Agreement is governed by the laws of the Republic of Ireland.
The local language version of this agreement shall apply to
Software acquired in the EU. This Agreement is the entire agreement
between us, and you agree that Creative will not have any liability
for any untrue statement or representation made by it, its agents
or anyone else (whether innocently or negligently) upon which you
relied upon entering this Agreement, unless such untrue statement
or representation was made fraudulently.
Copyright Information for users of Creative products
Certain Creative products are designed to assist you in reproducing
material for which you own the copyright or are authorized to copy
by the copyright owner or by exemption in applicable law. Unless
you own the copyright or have such authorization, you may be
violating copyright law and may be subject to payment of damages
and other remedies. If you are uncertain about your rights, you
should contact your legal advisor. It is your responsibility when
using a Creative product to ensure there is no infringement of
applicable laws on copyright whereby the copying of certain
materials may require the prior consent of the copyright owners.
Creative disclaims any liability with regard to any illegal use of
the Creative product and Creative shall in no event be liable with
regard to the origin of any data stored in a compressed audio file.
You acknowledge and agree that the exportation or use of MP3 Codecs
in real-time broadcasting (terrestrial, satellite, cable or other
media) or broadcasting via Internet or other networks, such as but
not limited to intranets etc., in pay-audio or pay-on-demand
applications, is not authorized and/or licensed (see also
http://www.iis.fhg.de/amm/).
