  1. MICROSOFT UNIMODEM V DRIVER(S)
  2.  
  3. MICROSOFT SOFTWARE LICENSE
  4.  
  5.  
  6. 1.     GRANT OF LICENSE.  Microsoft grants to you the 
  7. right to use and to reproduce all or a portion of the 
  8. Unimodem V Driver(s) (collectively, "Software") for 
  9. your internal use only provided that (i) the Software 
  10. is not distributed for profit; (ii) the Software is 
  11. used only in conjunction with licensed copies of 
  12. Microsoft Windows 95 products; (iii) the Software may 
  13. not be modified; (iv) all copyright notices are 
  14. maintained on the Software; and (v) the licensee/end 
  15. user agrees to be bound by the terms of this Agreement.

  17. 2.    REDISTRIBUTION OF THE UNIMODEM V DRIVER(S).  
  18. To obtain rights to distribute the Software as part of 
  19. your software application or hardware product for 
  20. profit, you must print out, sign and return a copy of 
  21. this agreement (located at License.txt) to Microsoft 
  22. Corporation, Dona Ouellette, One Microsoft Way, 
  23. Redmond, WA  98052-6399.  Upon Microsoft's receipt of 
  24. the signed License Agreement, Microsoft grants you a 
  25. non-exclusive royalty-free right to reproduce and 
  26. distribute the object code version of the Software 
  27. provided that you: (a) distribute the Software only in 
  28. conjunction with and as a part of your software 
  29. application or hardware product which is designed, 
  30. developed, and tested to operate with the Microsoft 
  31. Windows 95 operating system; (b) adhere to the 
  32. installation guidelines provided with the Software; 
  33. (c) do not use Microsoft's name, logo, or trademarks to 
  34. market your software application or hardware product; 
  35. and (d) agree to indemnify, hold harmless, and defend 
  36. Microsoft from and against any claims or lawsuits, 
  37. including attorney's fees, that arise or result from the 
  38. use or distribution of your software application or 
  39. hardware product. You have no right to modify the Software.

  41. 3.    COPYRIGHT.  The Software is owned by Microsoft 
  42. or its suppliers and is protected by United States 
  43. copyright laws and international treaty provisions. 
  44. You may not remove the copyright notice from any copy 
  45. of the Software or any copy of the written materials, 
  46. if any, accompanying the Software.

  48. 4.    OTHER RESTRICTIONS.  This Microsoft License 
  49. Agreement is your proof of license to exercise the 
  50. rights granted herein and must be retained by you.  
  51. You may not rent or lease the Software.  You may not 
  52. reverse engineer, decompile or disassemble the 
  53. Software except to the extent such foregoing restriction
  54. is expressly prohibited by applicable law.
  55.  
  56.     NO WARRANTY.  ANY USE BY YOU OF THE SOFTWARE IS 
  57. AT YOUR OWN RISK.  THE SOFTWARE IS PROVIDED FOR USE 
  58. ONLY WITH MICROSOFT WINDOWS 95 PRODUCTS AND RELATED 
  59. APPLICATION SOFTWARE AND/OR HARDWARE PRODUCTS.  THE 
  60. SOFTWARE IS PROVIDED FOR USE "AS IS" WITHOUT WARRANTY 
  61. OF ANY KIND.  TO THE MAXIMUM EXTENT PERMITTED BY LAW, 
  62. MICROSOFT AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES OF 
  63. ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT 
  64. LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS 
  65. FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. MICROSOFT 
  66. IS NOT OBLIGATED TO PROVIDE ANY UPDATES TO THE SOFTWARE.

  68.     NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  In no 
  69. event shall Microsoft or its suppliers be liable for 
  70. any damages whatsoever (including, without limitation, 
  71. incidental, direct, indirect special and consequential 
  72. damages, damages for loss of business profits, 
  73. business interruption, loss of business information, 
  74. or other pecuniary loss) arising out of the use or 
  75. inability to use this Microsoft product, even if 
  76. Microsoft has been advised of the possibility of such 
  77. damages.  Because some states/countries do not allow 
  78. the exclusion or limitation of liability for 
  79. consequential or incidental damages, the above 
  80. limitation may not apply to you.

  82.     INDEMNIFICATION BY YOU.  If you distribute the 
  83. Software in violation of this Agreement, you agree to 
  84. indemnify, hold harmless and defend Microsoft and its 
  85. suppliers from and against any claims or lawsuits, 
  86. including attorney's fees that arise or result from 
  87. the use or distribution of the Software in violation 
  88. of this Agreement.

  90. U.S. GOVERNMENT RESTRICTED RIGHTS
  91.  
  92. The Software and documentation are provided with 
  93. RESTRICTED RIGHTS.  Use, duplication, or disclosure by 
  94. the Government is subject to restrictions as set forth 
  95. in subparagraph (c)(1)(ii) of The Rights in Technical 
  96. Data and Computer Software clause at DFARS 252.227-
  97. 7013 or subparagraphs (c)(1) and (2) of the Commercial 
  98. Computer Software - Restricted Rights at 48 CFR 
  99. 52.227-19, as applicable.  Manufacturer is Microsoft 
  100. Corporation/One Microsoft Way/Redmond, WA  98052-6399.

  102. If you acquired this product in the United States, 
  103. this Agreement is governed by the laws of the State of 
  104. Washington.
