  33.      WHEREAS, certain disputes have occurred between the parties 
  34. hereto, and,

  36.      WHEREAS, they desire to amicably resolve these disputes,

  40. That in consideration of this agreement, the parties mutually 
  41. release one another from all claims of any kind whatsoever from 
  42. the beginning of time to the date of the execution of this 
  43. agreement, and that this mutual release shall be valid and binding 
  44. and insure for the benefit of the heirs, successors and assigns of 
  45. both parties.
