  29. INSTALLING CLOCKMAN

  31. Installing ClockMan is simple:
  32.  
  33. 1) Run SETUP.EXE from within Windows.  Setup will let you
  34.    choose the destination directory and which parts of the
  35.    ClockMan package you wish to install (program files
  36.    only, .HLP file, updated CLOCKMAN.INI file, etc.).
  37.  
  38. 2) Run CLOCKMAN.EXE.  It comes with an alarm file already
  39.    filled with sample alarms for you to try.
  40.  
  41. 3) Choose Help from the System menu to read our comprehen-
  42.    sive online manual.

  147.                     EVALUATION AGREEMENT

  149. Clock Manager ("ClockMan") is not and has never been public
  150. domain software, nor is it free software.  ClockMan is
  151. copyrighted by Graphical Dynamics, Inc.
  152.  
  153. You are granted a limited license to use ClockMan on a
  154. 30-day trial basis for the purpose of determining whether
  155. ClockMan is suitable for your needs.  After this initial
  156. 30-day trial license expires, you must register the program
  157. to continue using it.  The use of unlicensed copies of
  158. ClockMan by any person, business, corporation, government
  159. agency or any other entity is strictly prohibited.
  160.  
  161. A single user license permits a user to use ClockMan only
  162. on a single computer at a time.
  163.  
  164. No one may modify or patch the ClockMan executable files in
  165. any way, including but not limited to decompiling, disas-
  166. sembling, changing the icon or string resources, or
  167. otherwise reverse engineering the program.
  168.  
  169. A limited license is granted to copy and distribute
  170. ClockMan only for the trial use of others, subject to the
  171. above limitations, and also the following:
  172.  
  173. 1) ClockMan must be copied in unmodified form, complete
  174.    with the file containing this license information.
  175.  
  176. 2) The full machine-readable ClockMan documentation must be
  177.    included with each copy.
  178.  
  179. 3) ClockMan may not be distributed in conjunction with any
  180.    other product without a specific license to do so from
  181.    Graphical Dynamics.

  183. 4) No fee, charge, or other compensation may be requested
  184.    or accepted, except as authorized below:

  186.    A) Operators of electronic bulletin board systems
  187.       (sysops) may make ClockMan available for downloading

  189.       or time-dependent charge for the use of the bulletin
  190.       board system is permitted as long as there is not a

  193.    B) Vendors of shareware software may distribute ClockMan
  194.       ONLY AFTER OBTAINING WRITTEN PERMISSION from
  195.       Graphical Dynamics.  Such permission is usually
  196.       granted.  Vendors may charge a reasonable disk
  197.       duplication and handling fee.

  201.                  WARRANTIES AND DISCLAIMERS

  204. LIMITED WARRANTY

  206. Graphical Dynamics guarantees your satisfaction with this
  207. product for a period of 90 days from the date of original
  208. purchase.  If you are unsatisfied with ClockMan within that
  209. time period, return the package in saleable condition to
  210. the place of purchase for a full refund.  Graphical
  211. Dynamics warrants that all disks provided are free from
  212. defects in material and workmanship, assuming normal use,
  213. for a period of 90 days from the date of purchase.
  214.  
  215. Graphical Dynamics warrants that the program will perform
  216. in substantial compliance with the documentation supplied
  217. with the software product.  If a significant defect in the
  218. product is found, you may return the product for a refund.
  219. In no event will such a refund exceed the purchase price of
  220. the product.

  222. EXCEPT AS PROVIDED ABOVE, GRAPHICAL DYNAMICS DISCLAIMS ALL
  223. WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT
  224. LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND
  225. FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE
  226. PRODUCT.  SHOULD THE PROGRAM PROVE DEFECTIVE, THE PURCHASER
  227. ASSUMES THE RISK OF PAYING THE ENTIRE COST OF ALL NECESSARY
  228. SERVICING, REPAIR, OR CORRECTION AND ANY INCIDENTAL OR CON-
  229. SEQUENTIAL DAMAGES.  IN NO EVENT WILL GRAPHICAL DYNAMICS BE
  230. LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMIT-
  231. ATION DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTER-
  232. RUPTION, LOSS OF BUSINESS INFORMATION AND THE LIKE) ARISING
  233. OUT OF THE USE OR THE INABILITY TO USE THIS PRODUCT EVEN IF
  234. GRAPHICAL DYNAMICS HAS BEEN ADVISED OF THE POSSIBILITY OF
  235. SUCH DAMAGES.  THIS LIMITED WARRANTY GIVES YOU SPECIFIC
  236. LEGAL RIGHTS.  YOU MAY HAVE OTHERS, WHICH VARY FROM STATE
  237. TO STATE.

  239. Use of this product for any period of time constitutes your
  240. acceptance of this agreement and subjects you to its
  241. contents.  This agreement is governed by the laws of the
  242. State of Washington.

  244. U.S. GOVERNMENT RESTRICTED RIGHTS

  246. This product is provided with restricted rights.  Use,
  247. duplication, or disclosure by the government is subject to
  248. restrictions set forth in subdivision (c)(1)(ii) of the
  249. Rights in Technical Data and Computer Software clause at
  250. 48 CFR 252.227-7013, or in subdivision (c)(1) and (2) of
  251. the Commercial Computer Software--Restricted Rights clause
  252. at 48 CFR 52.27-19, as applicable.  The contractor/
