  1. Quote Ticker Bar Corporation SHAREWARE License Agreement 
  2.  
  3. BEFORE YOU USE QTB, CAREFULLY READ THE TERMS AND CONDITIONS 
  4. OF THIS AGREEMENT.  BY USING QTB FOR THE FIRST TIME, YOU ARE
  5. CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS 
  6. AGREEMENT.  IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS
  7. AGREEMENT, DO NOT USE THE SOFTWARE.  
  8.  
  9. 1.  Quote Ticker Bar Corporation ("QTB") grants to you a 
  10. non-exclusive, non-sublicensable, license to use this Shareware 
  11. version of the Quote Ticker Bar network stock retrieval software
  12. (the "Software"), in binary executable form for evaluation 
  13. and trial use purposes only.  
  14.  
  15. 2.  QTB MAKES NO REPRESENTATIONS ABOUT THE 
  16. SUITABILITY OF THIS SOFTWARE OR ABOUT ANY CONTENT OR 
  17. INFORMATION MADE ACCESSIBLE BY THE SOFTWARE, FOR ANY 
  18. PURPOSE.  THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT 
  19. EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF 
  20. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR 
  21. NONINFRINGEMENT.  THIS SOFTWARE IS PROVIDED 
  22. GRATUITOUSLY AND, ACCORDINGLY, QTB SHALL NOT BE 
  23. LIABLE UNDER ANY THEORY OR ANY DAMAGES SUFFERED BY YOU 
  24. OR ANY USER OF THE SOFTWARE.  QTB WILL NOT SUPPORT 
  25. THIS SOFTWARE AND WILL NOT ISSUE UPDATES TO THIS 
  26. SOFTWARE.  
  27.  
  28. 3.  All content accessed through the Software is the 
  29. property of the applicable content owner and may be 
  30. protected by applicable copyright law.  This License 
  31. gives you no rights to such content.  
  32.  
  33. 4.  While QTB intends to distribute a commercial 
  34. release of the Software, QTB reserves the right at 
  35. any time not to release a commercial release of the 
  36. Software or, if released, to alter prices, features, 
  37. specifications, capabilities, functions, licensing 
  38. terms, release dates, general availability or other 
  39. characteristics of the commercial release.  
  40.  
  41. 5.  Title, ownership rights, and intellectual property 
  42. rights in and to the Software shall remain in QTB 
  43. and/or its suppliers.  You agree to abide by the 
  44. copyright law and all other applicable laws of the 
  45. United States including, but not limited to, export 
  46. control laws.  You acknowledge that the Software in 
  47. source code form remains a confidential trade secret of 
  48. QTB and/or its suppliers and therefore you agree 
  49. not to modify the Software or attempt to decipher, 
  50. decompile, disassemble or reverse engineer the 
  51. Software, except to the extent applicable laws 
  52. specifically prohibit such restriction.  
  53.  
  54. 6.  QTB may terminate this License at any time by 
  55. delivering notice to you and you may terminate this 
  56. License at any time by destroying or erasing your copy 
  57. of the Software.  Upon termination of this License, or 
  58. in any event within thirty (30) days following 
  59. QTB's release of a new commercial version of the 
  60. Software, you agree to destroy or erase the Software.  
  61. In the event of termination, the following sections of 
  62. this License will survive: 2, 3, 4, 5, 6, 7 and 8.  
  63. This License is personal to you and you agree not to 
  64. assign your rights herein.  This License shall be 
  65. governed by and construed in accordance with the laws 
  66. of the State of California and, as to matters affecting 
  67. copyrights, trademarks and patents, by U.S.  federal 
  68. law.  This License sets forth the entire agreement 
  69. between you and QTB.  
  70.  
  71. 7.  Use, duplication or disclosure by the Government is 
  72. subject to restrictions set forth in subparagraphs (a) 
  73. through (d) of the Commercial Computer-Restricted 
  74. Rights clause at FAR 52.227-19 when applicable, or in 
  75. subparagraph (c) (1) (ii) of the Rights in Technical 
  76. Data and Computer Software clause at DFARS 
  77. 252.227-7013, and in similar clauses in the NASA AR 
  78. Supplement.  
  79.  
  80. 8.  You may not download or otherwise export or 
  81. reexport the Software or any underlying information or 
  82. technology except in full compliance with all United 
  83. States and other applicable laws and regulations.  In 
  84. particular, but without limitation, none of the 
  85. Software or underlying information or technology may be 
  86. downloaded or otherwise exported or reexported (i) into 
  87. (or to a national or resident of) Cuba, Haiti, Iraq, 
  88. Libya, Yugoslavia, North Korea, Iran, or Syria or (ii) 
  89. to anyone on the US Treasury Department's list of 
  90. Specially Designated Nationals or the US Commerce 
  91. Department's Table of Deny Orders.  By downloading the 
  92. Software, you are agreeing to the foregoing and you are 
  93. representing and warranting that you are not located 
  94. in, under control of, or a national or resident of any 
  95. such country or on any such list.  
  96.  
  97. 9.  QTB OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR 
  98. (a) INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT 
  99. DAMAGES OF ANY SORT, WHETHER ARISING IN TORT, CONTRACT 
  100. OR OTHERWISE, EVEN IF QTB HAS BEEN INFORMED OF THE 
  101. POSSIBILITY OF SUCH DAMAGES, OR (b) FOR ANY CLAIM BY 
  102. ANY OTHER PARTY.  THIS LIMITATION OF LIABILITY SHALL 
  103. NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO 
  104. THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION.  
  105. FURTHERMORE, SOME STATES DO NOT ALLOW THE EXCLUSION OR 
  106. LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO 
  107. THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.
