  1. This legal document is an agreement between you, the user, and 
  2. DBS GmbH. For questions regarding this agreement please apply 
  3. in writing to:
  4. DBS GmbH - Digital Bildverarbeitung und Systementwicklung, 
  5. Kohlhoekerstrasse 61, 28203 Bremen, Germany.

  7. 1. Subject of Agreement
  8. Subject of the agreement are the computer programs and the data, 
  9. stored on the enclosed data storage material, the operating manuals 
  10. and all other accompanying material. The computer programs will be 
  11. referred to henceforth as The Software. By using The Software, you 
  12. are agreeing to be bound by the terms of this agreement.

  14. 2. Rights of the User
  15. For the period of this agreement DBS grants you the non-exclusive 
  16. and personal right to use The Software on one single computer. As 
  17. license holder you may; copy The Software in a physical form, store 
  18. it on data storage material, or transfer it via a local data network 
  19. from one computer to another. For this latter operation it must be 
  20. ensured that at any given moment The Software is only being used at 
  21. a single workstation, and that the restrictions outlined in 4. 
  22. (copyright) are adhered to.

  24. 3. Additional Rights of the User
  25. Provided that DBS grants additional rights for certain parts of The 
  26. Software, these parts can be modified and integrated into your own 
  27. programs. You may only distribute these parts in a compiled form and 
  28. as a component part of your program. For this, the DBS copyright 
  29. remark is to be included with your program. Your program must be 
  30. significantly different to The Software.

  32. 4. Copyright
  33. The Software is the property of DBS or the suppliers of DBS. With 
  34. this purchase you receive only the ownership of the physical data 
  35. storage material.
  36. DBS reserves all rights to the publishing, duplication, processing 
  37. and utilisation of The Software. If The Software is not copy 
  38. protected, a single copy may be made exclusively for security and 
  39. archiving purposes.
  40. Without the express written permission of DBS it is forbidden to
  41. - alter, translate, decompile, or to disassemble The Software.
  42. - copy The Software┤s accompanying written documentation.
  43. - hire out or to lease The Software.
  44. A permanent transference of The Software is only permitted when you 
  45. retain no copies and the recipient declares his acceptance of the 
  46. conditions of this agreement.

  48. 5. Warranty
  49. Since The Software is supplied to Sam┤s Publishing by DBS free of 
  50. charge for distribution together with their literature, DBS cannot 
  51. supply any  kind of warranty.

  53. 6. Liability
  54. With the exception of damage caused by wilful or gross negligence, 
  55. neither DBS nor its distributors are responsible for any damage 
  56. whatsoever which is put down to the use of The Software. This is 
  57. valid without exception, including ensuing loss of profits, lost 
  58. working time, lost company information or other financial losses. 
  59. In any event the liability of DBS is limited to that which the 
  60. purchaser paid for the product.
  61. This limited liability gives you special legal rights. Some 
  62. jurisdictions provide other rights, and some jurisdictions do not 
  63. allow the exclusion or limitation of implied warranties or limitation 
  64. of liability for incidental or consequential damages. As a result, 
  65. the above limitations and/or exclusions may not apply to you.

  67. 7. Duration of Agreement
  68. This agreement is valid for an indefinite period of time. Your rights 
  69. as a user automatically expire if the conditions of this agreement 
  70. are in any way violated. In this event all copies of The Software 
  71. you have created so far, inclusive of any possibly altered examples, 
  72. are to be destroyed.
