  10. You should carefully read the following terms and conditions before using
  11. this software. Use of this software indicates your acceptance of these terms
  12. and conditions. If you do not agree with them, do not use the software.

  15. Non-registered Version
  16.  
  17. The Non-registered Version of E! for Windows is a version on which the
  18. Registration procedure has not been applied. To run the registration
  19. procedure you need a registration code which will be sent to you after
  20. payment. This procedure disables the reminder dialog box and allows you to
  21. disable the CRC checking feature of E!.
  22.  
  23. You are hereby licensed to: use the Non-registered Version of the software
  24. for a 60-day evaluation period; make as many copies of the Non-registered
  25. Version of this software and documentation as you wish; give exact copies of
  26. the original installation diskette to anyone; and distribute the
  27. Non-registered Version of the software and documentation in its unmodified
  28. form via electronic means. There is no charge for any of the above.

  30. You are specifically prohibited from charging, or requesting donations, for
  31. any such copies, however made and from distributing the software and/or
  32. documentation with other products (commercial or otherwise) without prior
  33. written permission, with one exception: Disk Vendors are permitted to
  34. redistribute E! for Windows, subject to the conditions in this license and
  35. in the limited licence detailed in VENDOR.TXT without specific written
  36. permission.

  38. However, Disk Vendors are not allowed to charge more than $5 (or its
  39. equivalent in their local currency) for a disk containing the Non-registered
  40. Version of E! for Windows. Moreover, E! for Windows may not be distributed
  41. on diskettes containing other products, even in compressed form unless
  42. instructions are given describing how to build an installation diskette from
  43. the distributed disk.

  45. Unregistered use of E! for Windows after the 60-day evaluation period is in
  46. violation of federal and european copyright laws.

  49. Registered Version

  51. The registered version of E! for Windows as well as the API documentation
  52. may not be distributed/uploaded in any form and for any reason by
  53. individuals or Disk Vendors. Violations of this agreement will be
  54. prosecuted.

  57. Evaluation and Registration
  58.  
  59. This is not free software. This license allows you to use this software for
  60. evaluation purposes without charge for a period of 60 days. If you use this
  61. software after the 60-day evaluation period a registration fee is required
  62. (please see ORDER.FRM). Payments must be in US dollars or in german Marks
  63. (DM) and should be sent to the address mentioned in ORDER.FRM. Credit card
  64. ordering and quantity discounts are available.

  66. When payment is received you will be sent a registered copy of the latest
  67. version of E! for Windows, a printed documentation and the E! for Windows
  68. API documentation. You will also benefit from a fax hot-line service at the
  69. following fax number in Germany:

  77. Your registration code will be valid for all future versions of E! for
  78. Windows (unless a major change occurs, in which case information will be
  79. given on how to receive a new registration code).

  81. One registered copy of E! for Windows may be dedicated to a single person
  82. who uses the software on one or more computers or to a single workstation
  83. used by multiple people.

  85. You may access the registered version of E! for Windows through a network,
  86. provided that you have obtained individual licenses for the software
  87. covering all workstations that will access the software through the network.
  88. However, E! for Windows has not been tested with all networks, so we cannot
  89. guarantee that this will be possible in all cases.

  92. Governing Law

  94. This agreement shall be governed by the German law.

  97. Disclaimer of Warranty

  99. This software and the accompanying files are sold "as is" and without
  100. warranties as to performance of merchantability or any other warranties
  101. whether expressed or implied. In particular, there is no warranty for the
  102. optional virus scanning (CRC verification) feature. Because of the various
  103. hardware and software environments into which E! for Windows may be put, no
  104. warranty of fitness for a particular purpose is offered.

  106. The user must assume the entire risk of using the program. Any liability of
  107. the seller will be limited exclusively to product replacement or refund of
  108. purchase price.
