Important: Please read this license agreement carefully. This agreement between you, the end user and Sybex Inc. is a legal document. If you do not agree to the terms of this license agreement, return the package, accompanying materials and the CD-ROM disk(s) with proof of payment, to the authorized dealer from whom you obtained it, for a full refund of the price you paid. Using the CD-ROM constitutes your acceptance of this license agreement.
1. GRANT OF LICENSE. In consideration of the purchase price paid by you, Sybex, Inc. (''SYBEX'') grants to you, as Licensee (''Licensee''), a single-user, non-exclusive, nontransferable, perpetual license to use this copy of its Software Program and related documentation (together the ''Software'') subject to the provisions of this agreement. SYBEX reserves all rights not expressly granted to Licensee.
2. PERMITTED USES. You are granted the following rights in the Software:
(a) Right to Install and Use. You may install and use the Software on any hard disk drive of any single compatible computer that you own. However, you may not under any circumstances have the Software installed onto the hard drives of two or more computers at the same time, nor may you install the Software onto the hard drive of one computer and then use the original CD-ROM on another computer. If you wish to use the Software on a computer which is not the computer where the Software was first installed, you must either erase the Software from the first hard drive before you install it onto a second hard drive, or else license an additional copy of the Software for each additional computer on which you want to use it.
(b) Right to Modify. You may not modify the Software and /or merge it into another computer program.
(c) Right to Transfer. You may not rent, lend or lease this Software. However, you may transfer this license to use the Software to another party on a permanent basis by transferring this copy of the License Agreement, copy of the Software and all documentation. You must, at the same time, either transfer to the other party or destroy all your copies of the Software. Such transfer of possession terminates your license from use. Such other party shall be licensed under terms of this agreement upon the acceptance of this agreement by the initial use of the Software. If you transfer the Software, you must remove the Software from your hard disk and you may not retain any copies of the Software for your own use.
3. PROHIBITED USES. You may not, without written permission from Sybex, Inc.:
(a) Use, copy, modify, merge or transfer copies of the Software or documentation except as provided by this agreement;
(b) Disassemble, decompile, ''unlock'', reverse translate, or in any manner decode the Software for any reason; or
(c) Sub-license, lease or rent the Software.
(d) Use any backup or archival copies of the Software, or allow someone else to use such copies, for any purpose other than to replace the original copy in the event it is destroyed or becomes defective.
4. WARRANTY AND DISCLAIMER. SYBEX makes no warranties, express or implied, with respect to the Software or its performance, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. SYBEX warrants only that the software media is free of physical defects for a period of ninety (90) days from the date of purchase listed on the original invoice or bill of sale. SYBEXÆs total liability, and Licensee's sole remedy, under this warranty shall be limited to, at SYBEXÆs option, correction or replacement of the defective media.
If you discover a defect in the media during this warranty period, you may obtain a replacement of identical format at no charge by sending the defective media, postage prepaid, with proof of purchase to: Sybex, Inc., Customer Service Department, 1151 Marina Village Parkway, Alameda, CA 94501. After the 90-day period, you can obtain replacement media of identical format by sending us the defective disk, proof of purchase, and a check or money order for $10, payable to SYBEX. In no event shall SYBEX be liable for any special, indirect or consequential damages arising out of or in connection with the use of or inability to use the Software or its contents even if advised of the possibility of such damage. (Some states do not allow the exclusion of implied warranties or liability for the incidental or consequential damages, therefore the limitations stated above may not apply to Licensee.)
5. EXPORT CONTROLS. You agree to comply with all export laws and regulations of the United States as such laws and regulations may exist from time to time.
6. CANADIAN TRANSACTION. If you acquire this Software in Canada, you agree to the following: The Parties hereto have expressly required that the present agreement and any amendments be drawn up in the English language.
7. TERMINATION. This license and your right to use this Software automatically terminate if you fail to comply with any provisions of this agreement, destroy the copies of the Software in your possession, or voluntarily return the Software to us. Upon termination, you will destroy all copies of the Software and documentation. Otherwise, the restrictions on your rights to use the Software will expire upon expiration of the copyright of the Software.
8. MISCELLANEOUS PROVISIONS. This agreement will be governed by and constructed in accordance with the substantive laws of California, and not by the 1980 United Nations Convention on Contracts for the International Sale of Goods, as amended. This is the entire agreement between us relating to the
contents of this package, and supersedes any prior purchase order, communications, advertising, or representation concerning the contents of this package. No change or modification of this agreement will be valid unless it is in writing, and is signed by us.
