  3. CHAOSOFT  LICENSE  AGREEMENT - SHAREWARE EDITION
  4.  
  5. Please,  read this before using the software!
  6.  
  7. This is a legal agreement between you and ChaoSoft. By using the
  8. software you are agreeing to be bound by the terms of this
  9. agreement.
  10.  
  11. ChaoSoft software license (shareware edition)
  12.  
  13. 1. Grant of license. ChaoSoft grants to you the right to use the
  14. ChaoSoft software program File Manager StepUp (the "SOFTWARE") for
  15. a period of up to 14 days. After that time, you are required to
  16. purchase the SOFTWARE through registration or else discontinue its
  17. use. The software is in "use" on a computer when it is loaded into
  18. the temporary memory (i.e., RAM) or installed into the permanent
  19. memory (e.g., hard disk, CD-ROM, or other storage device) of that
  20. computer. Unregistered use of the SOFTWARE after the evaluation
  21. period is in violation of federal copyright laws.

  23. 2. Copyright. The SOFTWARE is owned by ChaoSoft and is protected
  24. by United States copyright laws and international treaty
  25. provisions.
  26.  
  27. 3. Distribution. You are allowed to make as many copies of the
  28. Shareware version of the SOFTWARE as you wish; give exact copies
  29. of the original Shareware version to anyone; and distribute the
  30. Shareware version of the SOFTWARE in its unmodified form, as long
  31. as the product is not distributed for profit (handling fees up to
  32. $5.00 ok). You are not allowed to boundle the SOFTWARE with other
  33. products without prior written permission from ChaoSoft. If you
  34. distribute the SOFTWARE, you agree to:
  35.  
  36.   a) distribute all the associated files on the diskette together
  37.      as a group;
  38.  
  39.   b) send us, at least once a year, a copy of a piece of
  40.      promotional literature that you use to promote our programs;
  41.  
  42.   c) inform the buyer that they are paying not for the software,
  43.      but for your distribution services, and if they (the buyer)
  44.      continue to use the program beyond the evaluation period,
  45.      that they are obligated to pay the registration fee to
  46.      ChaoSoft.
  47.  
  48. 4. Other restrictions. You may not reverse engineer, decompile, or
  49. disassemble the SOFTWARE. You are not allowed to make any
  50. modifications to, or to create derivative works from any of the
  51. files that are used in this software. This includes all the
  52. executable, help, installation, and readme files, as well as
  53. graphics images.

  55. DISCLAIMER OF WARRANTY
  56.  
  57. The SOFTWARE (including instructions for its use) is provided "AS
  58. IS" WITHOUT WARRANTY OF ANY KIND. ChaoSoft further DISCLAIMS ALL
  59. IMPLIED WARRANTIES INCLUDING WITHOUT LIMITATION ANY IMPLIED
  60. WARRANTIES OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR
  61. PURPOSE. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF
  62. THE SOFTWARE AND DOCUMENTATION REMAINS WITH YOU.

  64. IN NO EVENT SHALL CHAOSOFT, ITS AUTHORS, OR ANYONE ELSE INVOLVED
  65. IN THE CREATION, PRODUCTION, OR DELIVERY OF THE SOFTWARE BE LIABLE
  66. FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES
  67. FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF
  68. BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE
  69. USE OF OR INABILITY TO USE THE SOFTWARE OR DOCUMENTATION, EVEN IF
  70. CHAOSOFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  71. BECAUSE SOME STATES/COUNTRIES DO NOT ALLOW THE EXCLUSION OR
  72. LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES,
  73. THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
