IRS Steals money from newly Disabled Veterans
The IRS, in its latest outrage, is refusing to refund taxes it collected
from disabled veterans even though another federal agency recouped the
entire amount of money that taxes were paid on.
How did such a state of affairs happen? Let's discuss a typical case.
A man in his second enlistment in the U.S. Marine Corps was involved in a
training accident and was injured. After being released from the Naval
Hospital he was informed that a Board of Medical Survey had been convened
and that, due to the disabling conditions of his injuries, he could no
longer meet the physical requirements of the Corps and was being medically
discharged. As he did not have 10 years of active duty he was ineligible
for a Disability Retirement.
Upon being discharged he was given Disability Severance Pay (DSP) by a
"grateful nation." Income tax was witheld on the full amount of the DSP and
he was required to report it, and include it as taxible income on his tax
return (1040).
This sounds reasonable except for ONE MAJOR thing. The Marine Corps failed
to tell him that upon applying for Disability Compensation to the Dept. of
Veterans Affairs (VA) they would withold any money due him from the VA until
the FULL AMOUNT OF THE Disability Severance Pay was recouped by the VA. In
effect what the Marine Corps (or any other branch of the service) giveth,
the VA taketh away. So now good old Uncle Sam not only has back the full DSP
payment but also the income tax paid on it. The IRS has ruled that the
veteran was not entitled to a refund of taxes paid on the DSP as it was a
lump sum payment. What in hell has that got to do with the issue. The fact
is the government gave him money, the IRS made him pay tax on it, the
government took the money back, the IRS won't refund the tax paid on the
recouped money. If that is legal, moral or ethical then something is
radically wrong with what this government has become.
This particular Marine was taken by the IRS for over $1,800.00. He ain't got
the severence pay and he ain't got the eighteen hundred bucks he paid in
taxes on it.
If you think that newly discharged wounded and injured veterans of Desert
Storm, who will be the next class of disabled veterans to "get the shaft",
deserve better then start writing your Congressman, Senator, President and
every other SOB in Washington you can think of to stop this "Rape of service
members who put their lives on the line for this country."
