  1. DEFINITION OF SHAREWARE

  3. Shareware distribution gives users a chance to try software
  4. before buying it. If you try a Shareware program and continue
  5. using it, you are expected to register. Individual programs
  6. differ on details -- some request registration while others
  7. require it, some specify a maximum trial period. With
  8. registration, you get anything from the simple right to continue
  9. using the software to an updated program with printed manual.

  11. Copyright laws apply to both Shareware and commercial software,
  12. and the copyright holder retains all rights, with a few specific
  13. exceptions as stated below. Shareware authors are accomplished
  14. programmers, just like commercial authors, and the programs are
  15. of comparable quality. (In both cases, there are good programs
  16. and bad ones!) The main difference is in the method of
  17. distribution. The author specifically grants the right to copy
  18. and distribute the software, either to all and sundry or to a
  19. specific group. For example, some authors require written
  20. permission before a commercial disk vendor may copy their
  21. Shareware.

  23. Shareware is a distribution method, not a type of software. You
  24. should find software that suits your needs and pocketbook,
  25. whether it's commercial or Shareware. The Shareware system makes
  26. fitting your needs easier, because you can try before you buy.
  27. And because the overhead is low, prices are low also. Shareware
  28. has the ultimate money-back guarantee -- if you don't use the
  29. product, you don't pay for it.

  58. possible.  However, we want the end-users of our software to
  59. be properly informed that it is shareware.

  64. If you are an ASP Vendor or BBS Member, then you have prior permission 
  65. to distribute Mabry Software packages.

  68. DISTRIBUTOR INFORMATION AND LICENSE INFORMATION

  70. The license information and distribution requirements in this 
  71. document supercede all previous license statements. To continue 
  72. to distribute Mabry Software products, you must adhere to the licensing 
  73. and distribution requirements below.

  75. If you are a mail order or BBS-type distributor of shareware 
  76. software, you may distribute these programs as they are, without 
  77. any changes other than expanding files contained in the ZIP 
  78. archives. However, you have a responsibility to check from time to 
  79. time, at a minimum interval of 6 months, for new versions of these 
  80. programs, and to update your copies in a timely manner. Mabry Software 
  81. will gladly send you a diskette containing the current versions 
  82. on request.

  84. You must fully identify all Mabry Software programs in your advertising, 
  85. by the program's full name and version, and indicate the 
  86. registration fee in the program description. The word Mabry Software must 
  87. appear in all program descriptions.

  90. SHAREWARE DISCLOSURE REQUIRED

  92. All advertising and packaging information including references to 
  93. Mabry Software products must contain a statement explaining the shareware 
  94. concept. Specifically, that statement must explain that shareware 
  95. software MUST be registered by the user, after a trial period, by 
  96. paying a registration fee, and that all monies paid for the 
  97. shareware version are duplication and distribution charges only. 
  98. The declaration specified by the Association of Shareware 
  99. Professionals is a good model. All such statements must be 
  100. clearly displayed in a position where they are likely to be read 
  101. by potential customers.

  104. RETAIL RACK AND CD-ROM DISTRIBUTION

  106. If you distribute shareware in a retail setting in racks, store 
  107. displays, vending machines, at computer fairs, or in any way 
  108. other than normal BBS or catalog-based sales, you must contact 
  109. Mabry Software for permission to distribute any Mabry Software program. 
  110. Rack or retail-like sales require a special distribution license, 
  111. normally requiring royalties paid to Mabry Software. If you distribute 
  112. shareware on CD-ROM disks, you must also contact Mabry Software before 
  113. including any Mabry Software shareware program on a CD-ROM disk. 
  114. Normally, permission is granted, but current versions must be 
  115. included and all old versions of any Mabry Software program removed from 
  116. any CD-ROM disk containing Mabry Software products.
