List types of USTs which this rule does NOT apply to.

How much of your tank system's volume is underground -- ìincluding all its piping?
10 percent or more

o for storing motor fuel for non-commercial purposes at a farm or
residence?
o for storing heating oil for use on the premises where the tank
is located?
o a septic tank?
o a pipeline facility?
o a surface impoundment, pit, pond or lagoon?
o a storm-water or waste-water collection system?
o a flow-through process tank?
o a liquid trap or gathering lines for oil or gas production?
o on, or above the floor of an underground area like a basement, shaft ì or tunnel?

If your tank holds more than 110 gallons it may be ìregulated by these rules -- depending on its contents and ìits use. To find out, you must answer some more questions ìabout the contents and use of your tank.

YOU HAVE A REGULATED TANK AND YOU MUST COMPLY WITH THE
HAZARDOUS SUBSTANCE TANK LEAK DETECTION REQUIREMENTS.

o Tanks that are part of equipment or machinery
o USTs smaller than 110 gallons
o USTs with "de minimus" concentrations of regulated substances
o Emergency overflow system USTs
o &Liquid traps and gathering lines
o 'USTs in underground areas
Farm or Residential USTs Smaller than 1,100 Gallons
If your UST is NOT a farm or residential tank, and
it is bigger than 110 gallons, then these rules ìprobably do apply to this tank unless it is listed ìbelow.
Hazardous Waste Tanks
Tanks containing wastes on the RCRA Subtitle C ìlist or meeting any of the specified hazardous ìwaste characteristics.
Tanks that are Part of Equipment or Machinery
(e.g. hydraulic lift tanks and elevator tanks ìare NOT regulated by these rules.)
USTs with "de minimus" Concentrations of ìRegulated Substances
Determinations of "de minimus" concentration ìlevels will be made on a case-by-case basis. ìIf the contents of your UST are highly diluted ìconsult your state or local UST agency or call ìthe EPA Hotline at 1-800-424-9346.

No specific concentration level has been set in these UST ìregulations.
The determination of "de minimus" concentration levels will ìbe made on a case-by-case basis.
If the contents of your UST are highly diluted and you ìbelieve they may be below "de minimus" concentration ìlevels, please consult your state or local UST agency. Or, ìcall the EPA Hotline at 1-800-424-9346. t
Heating Oil USTs
The heating oil must be used on the same ìpremises as the tank.
Call the Hotline at 1-800-424-9346 if you have ìa question about whether your tank's contents ìare heating oil.
Pipelines
All pipelines regulated under:
1. The Natural Gas Pipeline Safety Act; or,
2. Hazardous Liquid Pipeline Safety Act; or,
3. Comparable State laws.
Flow-through Process Tanks
That is, a tank that is an integral part of a ìproduction process.

Liquid Traps and Gathering Lines
Directly related to oil and gas production and ìgathering operations. U
USTs in Underground Areas
An underground room, such as a basement, ìcellar, shaft or vault, providing enough space ìfor physical inspection of the exterior of the ìtank situated on or above the surface of the ìfloor.
Field-constructed tanks are usually ìconstructed of steel or concrete, shaped like ìlike flat, vertical cylinders, and have ìcapacity of greater than 50,000 gallons.
