Please read the following licence agreement carefully - the Dancer DNA software including any on-line or electronic documentation is subject to the terms and conditions of the following limited licence and limited warranty.
1. Licence. Notting Hill Publishing Limited ("Notting Hill") hereby grants you a non-exclusive personal licence to use and display this software on a single computer on a single screen. The software may not be installed on a network, or otherwise accessed or made accessible by more than one computer or computer screen. None of the material contained in the software either in whole or in part may be copied onto the hard disc except for its set-up program which may not be installed on more than one computer at any one time. All rights not expressly granted to you under this agreement are expressly reserved to Notting Hill.
2. Restrictions. Except as expressly authorised herein you may not rent, lease, sublicence, use for public performance, load, copy, modify, adapt, merge, translate or otherwise exploit the software and the accompanying materials ("the Accompanying Materials") or any part of them nor permit any third party not expressly authorised under this agreement to do so. You may not decompile, disassemble or reverse engineer the software except to the extent allowed by the applicable law.
3. Warranties. Notting Hill warrants that the software will perform substantially in accordance with the Accompanying Materials. Notting Hill makes no warranties or representations either express or implied in relation to the software and the Accompanying Materials, including but not limited to implied warranties of completeness, accuracy, merchantability and fitness for a particular purpose. You accept that the software and the Accompanying Materials on an "as is" basis.
4. Limitation of Liability. Except for death and personal injuries arising from or in any way connected with the supply, failure to supply, use or inability to use the software and Accompanying Materials either in contract, tort, negligence, or in any other statutory duty or otherwise including, but without limitation to damages or loss of profits, business interruption, loss of information or any other pecuniary or special damage or loss even when Notting Hill has been advised of the possibility of such loss or damage.
5. Customer Remedy. Notting Hill's entire liability and your exclusive remedy shall be at Notting Hill's option either (a) the replacement of the Software and the Accompanying Materials or (b) a refund of the purchase price paid for the software and the Accompanying Materials.
6. Termination. This agreement is effective until terminated. You may terminate this agreement at any time by destroying the software and the Accompanying Materials. This agreement will terminate immediately without notice from Notting Hill if you fail to comply with any provision of this agreement. Upon termination you must destroy the software and the Accompanying Materials and any copy thereof in any form that is in your possession, whether or not the copy is authorised.
7. Personal. This agreement is personal to you and you may not assign, sub-licence or alienate your rights hereunder in any ways whatsoever without the prior written consent of Notting Hill.
8. Intellectual Property. The software and all data, software, documentation and other materials contained in it together with the Accompanying Materials and all intellectual property therein are the property of Notting Hill and its licensors are protected by law.
9. Law and Severability. To the extent permissible by local law this agreement shall be governed by the laws of England and Wales and shall be subject to the nonexclusive jurisdiction of the English Courts. This agreement shall not affect your statutory rights.
10. Interpretation. "Software" means the Dancer DNA product and all materials stored or contained therein. "Accompanying Materials" means all accompanying materials supplied together with Dancer DNA.
