  2.                        IBM EVALUATION AGREEMENT
  3.  
  4. NOTICE:  THE SOFTWARE PROVIDED UNDER THIS EVALUATION AGREEMENT
  5. CONTAINS A TIME DISABLING DEVICE THAT WILL PREVENT THE EXECUTION OF
  6. THE SOFTWARE 60 DAYS AFTER INSTALLATION. ANY TAMPERING WITH THE TIME
  7. DISABLING DEVICE OR SOFTWARE IS STRICTLY PROHIBITED.

  10. International Business Machines Corporation ("IBM") for the evaluation
  11. of IBM's software and related documentation. ("Program")
  12.  
  13. IBM grants you a non-exclusive, non-transferable license to the
  14. Program only to enable you to evaluate the potential usefulness of the
  15. Program to you.  You may not use the Program for any other purpose and
  16. you may not distribute any part of it, either alone or with any of
  17. your software products; or use the program to develop applications for
  18. external distribution.

  20. IBM retains ownership of the Program and any copies you make of it.
  21. You may use the Program on one (1) machine only.
  22.  
  23. You may not decompile, disassemble or otherwise attempt to translate
  24. or seek to gain access to the source code of any portions of
  25. the Program provided in object code format.
  26.  
  27. The term of your License will be from the date of first installation
  28. of the Program, and will terminate 60 days later, unless otherwise
  29. specified.  THE PROGRAM WILL STOP FUNCTIONING WHEN THE LICENSE TERM
  30. EXPIRES.  You should therefore take precautions to avoid any loss of
  31. data that might result.  You must destroy and/or delete all copies you
  32. have made of the Program within ten (10) days of the expiry of your
  33. License.

  35. If you are interested in continuing to use the Program after the end
  36. of your License, you must place an order for a full license to the
  37. Program and pay the applicable license fee. In that event, your use of
  38. the Program will be governed by the provisions of the applicable IBM
  39. license for the Program.

  41. IBM accepts no liability for damages you may suffer as a result of
  42. your use of the Program.  In no event will IBM be liable for any indi-
  43. rect, special or consequential damages, even if IBM has been advised
  44. of the possibility of their occurrence.

  46. YOU UNDERSTAND THAT THE PROGRAM IS BEING PROVIDED TO YOU "AS IS",
  47. WITHOUT ANY WARRANTIES (EXPRESS OR IMPLIED) WHATSOEVER, INCLUDING BUT
  48. NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, QUALITY,
  49. PERFORMANCE OR FITNESS FOR ANY PARTICULAR PURPOSE. Some jurisdictions
  50. do not allow the exclusion or limitation of warranties or consequen-
  51. tial or incidental damages, so the above may not apply to you.

  53. IBM may terminate your License at any time if you are in breach of any
  54. of its terms.
  55.  
  56. This License will be governed by and interpreted in accordance with
  57. the laws of the State of New York.
  58.  
  59. This License is the only understanding and agreement we have for your
  60. use of the Program. It supersedes all other communications, under-
  61. standings or agreements we may have had prior to this License.
