This agreement is between you, the end user and/or the entity that owns the software, and Fiore Industries Inc. The down-loading of this file constitutes the commencement of a contract in which you are agreeing to use this software only upon the terms and conditions set forth herein. This license agreement supersedes any prior license agreement between you and Fiore Industries Inc.
Grant of License: Fiore Industries grants you the right to use one copy of DINOSAVER on a single computer. If this is an upgrade from a previous version, you may use either this version or the prior version, you may not use both versions simultaneously nor have this software loaded on two or more computers at the same time. The software is in use if it is loaded into memory or stored on a storage device including disk drives, CD-ROM, tape or any other storage device.
Copyright: DINOSAVER is owned by Fiore Industries and is protected by United States copyright laws. You are however, allowed to make a single copy of DINOSAVER for use as a backup, and you are allowed to copy it to a different storage device provided the originals are used solely for backups. You are NOT allowed to copy the manuals or the art. You may NOT use, decompile, disassemble, reverse engineer, create a derivative work or copy DINOSAVER except as stated in this agreement.
Restrictions: You may not rent or lease DINOSAVER. However you can sell DINOSAVER provided you relinquish all copies and the recipient agrees to the terms of this agreement.
Limited Warranty: Fiore Industries warrants, to the original licensee only, that the diskettes are free from defects in material and workmanship under normal use for a period of 90 days from the date of purchase. The purchase date must be substantiated with the receipt. Return any defective diskettes with substantiation of the date of purchase to Fiore Industries, Inc., and your software will be replaced at no charge. This software is purchased "AS IS". The warranty granted herein is in lieu of any other warranties expressed or implied, including the implied warranty of merchantability and the implied warranty of fitness for a particular purpose. Fiore Industries, and its suppliers, will NOT be liable for any damages whatsoever including, but not limited to loss of business or to any incidental or consequential damages. Irrespective of the foregoing, you should consult local law for any warranty that may apply to you.
