  10.           COMMERCIAL  DISTRIBUTION  AND/OR USE  PROHIBITED  WITHOUT WRITTEN
  11.           CONSENT FROM THE AUTHOR.

  13.           Noncommercial distribution  and/or  use is  permitted  under  the
  14.           following terms:

  16.           1)   You may  copy and distribute verbatim copies  of the Maximus
  17.                source,  documentation, and  executable code as  you receive
  18.                it,  in  any medium,  provided  that  you conspicuously  and
  19.                appropriately publish on each  copy a valid copyright notice
  20.                "Copyright 1991 by Scott J. Dudley"; keep intact the notices
  21.                on all files that refer to this Licence Agreement and to the
  22.                absence  of any warranty;   PROVIDE UNMODIFIED COPIES OF THE
  23.                DOCUMENTATION  AS PROVIDED  WITH THE  PROGRAM; and  give any
  24.                other recipients  of  the Maximus  program  a copy  of  this
  25.                Licence  Agreement along with the program.  You may charge a
  26.                distribution  fee for  the  physical act  of transferring  a
  27.                copy, but no more  than is necessary to recover  your actual
  28.                costs incurred  in the  transfer. Under no  circumstances is
  29.                Maximus to be  distributed in such a way  as to be construed
  30.                as  "value added" in a  sales transaction, such  as, but not
  31.                limited to, software bundled with a modem or CD-ROM software
  32.                collections,  without  the  prior  written  consent  of  the
  33.                author.

  35.           2)   You may modify your copy or copies of Maximus or any portion
  36.                of it, and copy and  distribute such modifications under the
  37.                terms  of Paragraph 1 above,  provided that you  also do the
  38.                following:

  40.                a)  cause  the modified  files  to  carry prominent  notices
  41.                stating  that  you changed  the files  and  the date  of any
  42.                change;
  43.  
  44.                b)  cause the  executable code  of such modified  version to
  45.                clearly  identify itself as such in the course of its normal
  46.                operation;
  47.  
  48.                c) if the modified version is  not a "port", but operates in
  49.                the  same  hardware  and/or   software  environment  as  the
  50.                original  distribution, make  the  original version  equally
  51.                available,   clearly  identifying  same   as  the  original,
  52.                unmodified version;

  54.                d)  cause the  whole  of any  work  that you  distribute  or
  55.                publish,  that  in  whole  or  in  part  contains  or  is  a
  56.                derivative of Maximus or any part thereof, to be licensed at
  57.                no charge to all  third parties on terms identical  to those
  58.                contained  in this  Licence Agreement  (except that  you may
  59.                choose to  grant more extensive warranty  protection to some
  60.                or all third parties, at your option); and:

  66.                e)  send the  complete  source code  modifications to  Scott
  67.                Dudley  at the addresses listed  below,  for  the purpose of
  68.                evaluation  for inclusion  in  future  releases of  Maximus.
  69.                Should your source code be included in Maximus, Scott Dudley
  70.                retains all rights for redistribution of the code as part of
  71.                Maximus and  all derivative  works, with appropriate  credit
  72.                given to the author of the modification;

  74.                f) You may charge a distribution fee for the physical act of
  75.                transferring  a copy,  but  no  more  than is  necessary  to
  76.                recover your  actual costs incurred in the transfer, and you
  77.                may at your option offer warranty protection in exchange for
  78.                a fee;
  79.  
  80.                g) when distributing modified  versions of Maximus, you must
  81.                not change the name  of the program or the  official version
  82.                number, except to append  an identifier which indicates that
  83.                modifications have been made.  For ports  to other operating
  84.                systems, the following convention must be followed:

  86.                     Maximus v<v>.<os>.R<r>
  87.  
  88.                ...where <v> is the official Maximus version number, <os> is
  89.                the  name of the operating system which the port runs under,
  90.                and <r> (optional)  is the OS-specific revision number.  For
  91.                example, the second OS/2 revision  of Maximus 1.02 must have
  92.                a version string in this format:  `Maximus v1.02.OS/2.R2'
  93.  
  94.                Similarly, modifications  to Maximus  which are  designed to
  95.                run  under MS-DOS must also follow a naming convention.  The
  96.                version string must read:
  97.  
  98.                     Maximus v<v>.<i>.<r>
  99.  
  100.                where <v>  is the  official Maximus  version number,  <i> is
  101.                three  initials  (indicating  your first,  middle  and  last
  102.                names), and <r>  (optional) is the  revision number of  your
  103.                modifications.
  104.  
  105.                For  example, a version of  Maximus 2.00 modified  by Joe T.
  106.                SysOp must  have a version  string in this  format: `Maximus
  107.                v2.00.jts.1'
  108.  
  109.           3)   Mere  aggregation of  another  unrelated program  with  this
  110.                program and documentation (or  derivative works) on a volume
  111.                of a storage or distribution medium does not bring the other
  112.                program under the scope of these terms.

  114.           4)   You  may  copy and  distribute  Maximus  and its  associated
  115.                documentation  (or  a portion  or  derivative  of it,  under
  116.                Paragraph 2)  in object  code or executable  form under  the
  117.                terms of Paragraphs  1 and 2 above provided that you also do
  118.                one of the following:

  124.                a)    accompany   it   with   the   complete   corresponding
  125.                machine-readable  source  code,  which must  be  distributed
  126.                under the terms of Paragraphs 1 and 2 above; or,

  129.                three  years, to  give any  third party  free (except  for a
  130.                nominal shipping charge) a complete machine-readable copy of
  131.                the corresponding  source code, to be  distributed under the
  132.                terms of Paragraphs 1 and 2 above; or,

  134.                c) accompany  it with  the information  you  received as  to
  135.                where the  corresponding source code may  be obtained. (This
  136.                alternative is allowed  only for noncommercial  distribution
  137.                and  only  if you  received the  program  in object  code or
  138.                executable form alone.)

  140.                For  an executable file, complete source code means  all the
  141.                source code for all  modules it contains; but, as  a special
  142.                exception, it need not include source code for modules which
  143.                are standard libraries that  accompany the operating  system
  144.                on which the executable file runs.

  146.           5)   You may not copy, sublicense, distribute or transfer Maximus
  147.                and   its  associated  documentation   except  as  expressly
  148.                provided  under  this   Licence  Agreement.     Any  attempt
  149.                otherwise  to  copy,   sublicense,  distribute  or  transfer
  150.                Maximus is void  and your  rights to use  the program  under
  151.                this Licence agreement shall be automatically terminated.

  153.                However,   parties  who  have   received  computer  software
  154.                programs from you with this Licence  Agreement will not have
  155.                their licences terminated so long as such parties  remain in
  156.                full compliance, and notify  Scott Dudley of their intention
  157.                to comply with this Agreement.

  159.           6)   You may  not  incorporate parts  of Maximus  into a  program
  160.                which is NOT  completely free for ALL users. If  you wish to
  161.                use  Maximus   in  such  a  way,  you  must  obtain  written
  162.                permission from Scott Dudley before using any of the Maximus
  163.                code.
  164.  
  165.           7)   You may not incorporate parts of Maximus into a FUNCTIONALLY
  166.                SIMILAR program, including other  bulletin board packages or
  167.                tossers/scanners.  If you are  writing another BBS or remote
  168.                host package, you must contact Scott Dudley before using any
  169.                of the Maximus code.

  171.           8)   The  privileges granted  above apply  only  to noncommercial
  172.                users of the Maximus software.  You are a NONCOMMERCIAL user
  173.                only if you are running Maximus a private individual with no
  174.                "sponsors",  "backers", and only  if your BBS  is not making
  175.                (or helping to make) a profit.  You are a COMMERCIAL user if
  176.                you make  a profit from  running your BBS.   You are  also a
  177.                COMMERCIAL user if  your BBS is  being run  by (or for)  any

  183.                corporation,   government,   company,  foundation,   church,
  184.                school, or any other organization  You are also a COMMERCIAL
  185.                user if your system  is used to advertise such  a commercial

  188.                This licence only governs NONCOMMERCIAL users.  If you are a
  189.                COMMERCIAL  user, you are not  licensed to use or distribute
  190.                this  software without  the prior  written consent  of Scott
  191.                Dudley.   If you wish to  run Maximus as a  commercial user,
  192.                please see the section below on site licences.

  194.           9)   This licence  may be revoked  by Scott Dudley  without prior
  195.                notice.

  199.           BECAUSE  MAXIMUS-CBCS  IS LICENSED  FREE  OF  CHARGE, WE  PROVIDE
  200.           ABSOLUTELY NO WARRANTY.  EXCEPT WHEN OTHERWISE STATED IN WRITING,
  201.           SCOTT DUDLEY  AND/OR OTHER  PARTIES PROVIDE MAXIMUS-CBCS  "AS IS"
  202.           WITHOUT  WARRANTY  OF  ANY  KIND, EITHER  EXPRESSED  OR  IMPLIED,
  203.           INCLUDING,  BUT  NOT  LIMITED   TO,  THE  IMPLIED  WARRANTIES  OF
  204.           MERCHANTABILITY  AND  FITNESS FOR  A   PARTICULAR  PURPOSE.   THE
  205.           ENTIRE RISK  AS TO THE  QUALITY AND PERFORMANCE  OF MAXIMUS-CBCS,
  206.           AND  THE ACCURACY OF  ITS ASSOCIATED DOCUMENTATION,  IS WITH YOU.
  207.           SHOULD  MAXIMUS-CBCS  OR   ITS  ASSOCIATED  DOCUMENTATION   PROVE
  208.           DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR
  209.           OR CORRECTION.

  211.           IN NO EVENT  WILL SCOTT DUDLEY BE RESPONSIBLE IN  ANY WAY FOR THE
  212.           BEHAVIOUR OF MODIFIED VERSIONS OF  MAXIMUS-CBCS. IN NO EVENT WILL
  213.           SCOTT  DUDLEY  AND/OR  ANY   OTHER  PARTY  WHO  MAY   MODIFY  AND
  214.           REDISTRIBUTE MAXIMUS-CBCS  AS PERMITTED  ABOVE, BE LIABLE  TO YOU
  215.           FOR  DAMAGES, INCLUDING ANY  LOST PROFITS, LOST  MONIES, OR OTHER
  216.           SPECIAL, INCIDENTAL  OR CONSEQUENTIAL DAMAGES ARISING  OUT OF THE
  217.           USE  OR INABILITY  TO USE (INCLUDING  BUT NOT LIMITED  TO LOSS OF
  218.           DATA  OR DATA BEING  RENDERED INACCURATE  OR LOSSES  SUSTAINED BY
  219.           THIRD PARTIES  OR A FAILURE  OF THE  PROGRAM TO OPERATE  WITH ANY
  220.           OTHER  PROGRAMS)  MAXIMUS-CBCS, EVEN  IF  SCOTT  DUDLEY HAS  BEEN
  221.           ADVISED OF  THE POSSIBILITY OF SUCH DAMAGES,  OR FOR ANY CLAIM BY
