  1.                IBM End User Program License Agreement

  3. This is an IBM license agreement for the executable program code portion
  4. of IBM BookManager Library Reader/DOS, IBM SAA BookManager Library
  5. Reader/OS2, or BookManager Library Reader for Windows, hereinafter
  6. "Program", limited for use with selected publications specifically
  7. prepared to permit READ access.

  9. This is a license agreement and not an agreement for sale.  IBM owns
  10. copyrights in the Program.  You obtain no rights other than the license
  11. granted You by this Agreement.  Title to the copy of the Program, and
  12. any copy made from it, is retained by IBM.  IBM licenses your use of
  13. the Program only in the country in which it was acquired.  You assume
  14. all responsibility for the selection of the Program to achieve your
  15. intended results and for the installation of, use of, and results
  16. obtained from, the Program.

  20. DEFINITIONS
  21.  
  22. The term "Program" means IBM BookManager(R) Library Reader (TM) for
  23. Windows (TM), IBM BookManager(R) Library Reader(TM)/DOS or IBM SAA
  24. BookManager(R) Library Reader(TM)/2, limited for use with publications
  25. specifically stamped to enable them to be read by the IBM Library Reader
  26. (TM).

  30. LICENSE

  32. You may:
  33.  
  34.  - Use the Program solely for the purpose of reading those publications
  35.    distributed with the Program or other publications specifically
  36.    prepared to permit access.
  37.  - Make copies of the Program for distribution within your enterprise.
  38.    You shall reproduce and include the copyright notice(s) on all such
  39.    copies of the Program in whole or in part.  You shall provide a copy
  40.    of this license to each person in your enterprise to whom you distribute
  41.    a copy.

  43. You shall not:

  45.  - Modify the Program or merge it into another program;
  46.  - Transfer the Program outside of your enterprise;
  47.  - Copy, modify, merge, or transfer copies of the Program except as
  48.    provided in this Agreement;
  49.  - Reverse assemble or reverse compile the Program;
  50.  - Sub-license, rent, lease, or assign the Program or any copy of the
  51.    Program thereof; or
  52.  - Use the Program to read a softcopy book not authorized by IBM
  53.  
  54. YOU ARE NOT PERMITTED TO MAKE COPIES OF PUBLICATIONS OR PROVIDE ELECTRONIC
  55. ACCESS TO PUBLICATIONS UNLESS PERMISSION IS SPECIFICALLY GRANTED.

  59. DISCLAIMER OF WARRANTY
  60.  
  61. IBM does not warrant that the functions contained in the Program will
  62. meet your requirements, or that the operation of the Program will be
  63. uninterrupted or error free.

  65. THE PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER
  66. EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES
  67. OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The entire risk
  68. as to the quality and performance of the Program is with you.

  70. Some states do not allow the exclusion of implied warranties, so the
  71. above exclusion may not apply.

  75. LIMITATION OF REMEDIES
  76.  
  77. In no event will IBM be liable for any lost profits, lost savings, or
  78. any incidental damages or other economic consequential damages, even
  79. if IBM has been advised of the possibility of such damages.  IBM will
  80. not be liable for any damages claimed by You based on any third party
  81. claim.

  83. Some jurisdictions do not allow these limitations or exclusions, so
  84. they may not apply to You.

  88. GENERAL
  89.  
  90. IBM BookManager(R) is a registered trademark and Library Reader (TM)
  91. is a trademark of International Business Machines Corporation and any
  92. references to the IBM BookManager Library Reader must be properly
  93. identified as such.

  95. Windows (TM) is a registered trademark of Microsoft Corporation and
  96. any references to it must be properly identified as such.

  98. You may terminate your license at any time by destroying all of your
  99. copies of the Program or as otherwise described in this Agreement.
  100.  
  101. IBM may terminate your license if You fail to comply with the terms and
  102. conditions of this Agreement.  Upon such termination, You agree to
  103. destroy all Your copies of the Program.
  104.  
  105. Any attempt to sub-license, rent, lease or assign, or except as expressly
  106. provided herein, to transfer any copy of the Program is void.
  107.  
  108. No action, regardless of form, arising out of this Agreement may be brought
  109. by either party more than two years after the cause of action has arisen
  110. except for breach of the provisions of the Section entitled "LICENSE" in
  111. which event four years shall apply.

  113. If You acquired the Program in the United States, this license is governed
  114. by the laws of the State of New York.  If You acquired the Program in
  115. Canada, this license is governed by the laws of the Province of Ontario.
  116. Otherwise, this license is governed by the laws of the country in which
  117. You acquired the Program.
