  5. End User License Agreement

  7. IMPORTANT - READ CAREFULLY: You must accept the terms
  8. this End User License Agreement ("EULA") before using
  9. this SOFTWARE product ("SOFTWARE"). If you do not accept
  10. the terms of this EULA, you are not authorized to use the
  11. SOFTWARE.

  13. Copyright
  14. ---------
  15. The SOFTWARE is a copyrighted work protected by United
  16. States copyright laws and international copyright
  17. treaties. The SOFTWARE is licensed, not sold.
  18.  
  19. Attempting to reverse engineer, de-compile, disassemble
  20. or otherwise discover the source code of the SOFTWARE is
  21. illegal and shall constitute a violation of this EULA. No
  22. portion of the SOFTWARE, including but not limited to,
  23. programs, algorithms, codes, texts, images, or sounds may
  24. be modified, adapted, translated, copied, stored,
  25. distributed, used or accessed in any way except as
  26. detailed in this EULA.

  28. Evaluation
  29. ----------
  30. This SOFTWARE product is not free. Subject to the terms
  31. below, you are entitled a period of 30 days in which you
  32. may evaluate the SOFTWARE. If you continue to use the
  33. SOFTWARE after the indicated period, you must purchase a
  34. license for continued use. If you do not purchase a
  35. license, you must promptly discontinue using the
  36. SOFTWARE, and remove it from your computer system.
  37.  
  38. Distribution
  39. ------------
  40. Disclosing or making registration codes publicly
  41. available is illegal and shall constitute a violation of
  42. this EULA. The SOFTWARE cannot be re-sold or used in any
  43. profit-making activities, including but not limited to,
  44. distribution as part of a commercial product or service,
  45. without the prior written consent of Partridge Software.

  47. The evaluation version of the SOFTWARE may be freely
  48. copied and distributed as long as Partridge Software is
  49. identified as author of this product; exact and
  50. unmodified copies of both the SOFTWARE and documentation
  51. are provided; and that the evaluation version is not sold
  52. for any cost.

  54. Registered Version
  55. ------------------
  56. One registered copy of the SOFTWARE may only be in use on
  57. a single computer system at any given time. If the
  58. SOFTWARE is being used on more than one computer system,
  59. you must purchase a license for each computer system.

  61. If the SOFTWARE is accessed through a network, you must
  62. purchase a license for each workstation that the SOFTWARE
  63. is accessed on, regardless of whether the SOFTWARE is
  64. used at different times or concurrently.
  65.  
  66. Transfer
  67. --------
  68. An end user license may be transferred to a third party
  69. with their prior agreement to be bound by all the terms
  70. of this EULA.  Upon such a transfer, the previous owner
  71. of the end user license agrees that their rights to it
  72. are terminated and that they will promptly discontinue
  73. using the SOFTWARE.

  75. Governing Law
  76. -------------
  77. The laws of the State of Florida shall govern the terms
  78. of this EULA.
  79.  
  80. Disclaimer of Warranty
  81. ----------------------
  82. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE PROVIDED "AS
  83. IS" WITHOUT WARRANTY, EITHER EXPRESSED OR IMPLIED.
  84. BECAUSE OF THE VARIOUS HARDWARE AND SOFTWARE ENVIRONMENTS
  85. IN WHICH THIS SOFTWARE MAY BE USED, NO WARRANTY OF
  86. FITNESS FOR A PARTICULAR PURPOSE IN OFFERED. GOOD DATA
  87. PROCESSING PROCEDURE DICTATES THAT ANY SOFTWARE BE TESTED
  88. THOROUGHLY WITH NON-CRITICAL DATA BEFORE DEPENDING ON IT.
  89. PARTRIDGE SOFTWARE SHALL IN NO WAY BE HELD LIABLE FOR ANY
  90. DAMAGES OR LOSS OF PROFIT THAT RESULTS FROM THE USE OF
  91. THIS SOFTWARE.
