  7. License Agreement
  8.  
  9. You should carefully read the following terms and conditions
  10. before using this software.  Unless you have a different license
  11. agreement signed by an official of Edge Publishing, Inc. your use 
  12. of this software you indicates your acceptance of this license 
  13. agreement and warranty.
  14.  
  15. General terms.
  16.  
  17. You may:
  18. 1.  Use the Software (File Dog) evaluation version on one or more 
  19. computers for no more than thirty days.
  20. 2.  Copy the Software for backup purposes, provided any copy must 
  21. contain all of the original Software's proprietary notices.
  22.  
  23. You may not:
  24. 1.  Permit other individuals to use the Software except under the terms 
  25. listed in this agreement.
  26. 2.  Modify, translate, reverse engineer, decompile, disassemble (except 
  27. to the extent applicable laws specifically prohibit such restriction), or 
  28. create derivative works based on the Software.
  29. 3.  Rent, lease, grant a security interest in, or otherwise transfer rights 
  30. to the Software.
  31. 4.  Remove any proprietary notices or labels on the Software.
  32.  
  33. Title.
  34.  
  35. Title, ownership rights, and intellectual property rights in the Software 
  36. shall remain in Edge Publishing and/or its suppliers.  The Software is 
  37. protected by copyright laws and treaties.  Title and related rights in the 
  38. content accessed through the Software is the property of the applicable 
  39. content owner and may be protected by applicable law.  This License gives 
  40. you no rights to such content.
  41.  
  42. Termination.
  43.  
  44. The license will terminate automatically if you fail to comply with the 
  45. limitations described herein.  On termination, you must destroy all copies 
  46. of the Software.
  47.  
  48. Registered Version.
  49.  
  50. One registered copy of File Dog may either be used by a single person 
  51. who uses the Software personally on one or more computers, or installed 
  52. on a single workstation used nonsimultaneously by multiple people, but not 
  53. both.
  54.  
  55. You may access the registered version of File Dog through a network, 
  56. provided that you have obtained individual licenses for the Software 
  57. covering all workstations that will access the Software through the 
  58. network.  For instance, if five different workstations will access 
  59. File Dog on the network, each workstation must have its own File Dog 
  60. license, regardless of whether they use File Dog at different times or 
  61. concurrently.  The registration form has site licensing information.
  62.  
  63. The unlock key provided by Edge Publishing or one of it's authorized
  64. dealers is for use by the registered user only, for the number 
  65. of computers shown on their user license.  Unless you have a reseller 
  66. agreement signed by an officer of Edge Publishing, expressly athorizing 
  67. you to do so, you cannot redistribute, or make public in any way, the 
  68. unlock key.  Report fraudulent distribution of unlock keys by contacting
  69. support@edgepub.com.

  71. Export Controls.
  72.  
  73. None of the Software or underlying information or technology may be 
  74. downloaded or otherwise exported or reexported into (i) (or to a national 
  75. or resident of) Cuba, Iraq, Libya, Yugoslavia, North Korea, Iran, Syria or 
  76. any other country to which the U.S. has embargoed goods; or (ii) to anyone 
  77. on the U.S. Treasury Department's list of Specially Designated Nationals 
  78. or the U.S. Commerce Department's Table of Denial Orders.  By downloading 
  79. or using the Software, you are agreeing to the foregoing and you are 
  80. representing and warranting that you are not located in, under the control 
  81. of, or a national or resident of any such country or on any such list.

  83. Governing Law.
  84.  
  85. This agreement shall be governed by the laws of the State of Montana.
  86.  
  87. Disclaimer of Warranty.
  88.  
  89. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT 
  90. WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES 
  91. WHETHER EXPRESSED OR IMPLIED.  Because of the various hardware and 
  92. software environments into which File Dog may be put, NO WARRANTY OF 
  93. FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.  Good data processing 
  94. procedure dictates that any program be thoroughly tested with non-critical 
  95. data before relying on it.  The user must assume the entire risk of using 
  96. the program.

  98. Limitation of Liability.

  100. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR 
  101. OTHERWISE, SHALL EDGE PUBLISHING OR ITS SUPPLIERS OR RESELLERS BE LIABLE 
  102. TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR 
  103. CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, 
  104. DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR 
  105. MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES.  IN NO 
  106. EVENT WILL EDGE PUBLISHING BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE 
  107. AMOUNT EDGE PUBLISHING RECEIVED FROM YOU FOR A LICENSE TO THE SOFTWARE, 
  108. EVEN IF EDGE PUBLISHING SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF 
  109. SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.  THIS LIMITATION OF 
  110. LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO 
  111. THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION.  FURTHERMORE, SOME 
  112. JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR 
  113. CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO 
  114. YOU.
  115.  
  116. High Risk Activities.
  117.  
  118. The Software is not fault-tolerant and is not designed, manufactured or 
  119. intended for use or resale as on-line control equipment in hazardous 
  120. environments requiring fail-safe performance, such as in the operation of 
  121. nuclear facilities, aircraft navigation or communication systems, air 
  122. traffic control, direct life support machines, or weapons systems, in 
  123. which the failure of the Software could lead directly to death, personal 
  124. injury, or severe physical or environmental damage ("High Risk Activities").   
  125. Edge Publishing and its suppliers specifically disclaim any express or 
  126. implied warranty of fitness for High Risk Activities.

  128. Miscellaneous.

  130. If the copy of the Software you received was accompanied by a printed or 
  131. other form of "hard-copy" End User License Agreement whose terms vary 
  132. from this Agreement, then the hard-copy End User License Agreement 
  133. governs your use of the Software.  This Agreement represents the complete 
  134. agreement concerning this license and may amended only by a writing 
  135. executed by both parties.  If any provision of this Agreement is held to 
  136. be unenforceable, such provision shall be reformed only to the extent 
  137. necessary to make it enforceable.  This Agreement shall be governed by 
  138. the laws of the State of Montana.  The application of the United Nations 
  139. Convention of Contracts for the International Sale of Goods is expressly 
  140. excluded.   Windows is a registered trademark of Microsoft Corp.  WinZip 
  141. is a registered trademark of Nico Mak Computing Inc.  PKZip is a registered 
  142. trademark of PKWare Inc.  All other names are trademarks of their respective 
  143. owners.  Contact Edge Publishing if you have questions about a name used 
  144. in File Dog.
  145.  
  146. U.S. Government Restricted Rights.
  147.  
  148. Use, duplication or disclosure by the Government is subject to 
  149. restrictions set forth in subparagraphs (a) through (d) of the Commercial 
  150. Computer-Restricted Rights clause at FAR 52.227-19 when applicable, or in 
  151. subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer 
  152. Software clause at DFARS 252.227-7013, or at 252.211-7015, and in similar 
  153. clauses in the NASA FAR Supplement.  Contractor/manufacturer is Edge
