McDougal Littell, a Division of Houghton Mifflin Company, License Agreement
Before using the product CD-ROM, you should carefully read the following questions and answers regarding your use of this product. Using the software indicates your acceptance of the terms and conditions contained in the answers. If you do not agree with them, you should return the entire package, including the unused software.
Q: WHAT DOES THIS PRODUCT INCLUDE?
A: This product includes a CD-ROM; software recorded on the CD-ROM; contents delivered by the software; and printed documentation.
Q: HOW MAY I USE THE PRODUCT?
A: You may use the product as follows:
1. You may only copy the software onto a single computer for use on that computer and you may make one archival copy of the software for backup purposes only. If you want to use the software on more than one computer at a time, you must purchase separate copies for each computer location or purchase a Site License from McDougal Littell, a division of Houghton Mifflin Company. If you have purchased a Site License for this product, you may install the software on an unlimited number of computers in your school building only.
2. You may not remove or obscure any copyright, trademark, proprietary rights, disclaimer, or warning notice included on or embedded in any part of the product.
3. It is illegal to reverse compile, reverse assemble, reverse engineer, modify, or merge the software. You may not rent, lease, loan, distribute or create derivative works based upon the software in whole or in part.
Q: MAY I USE THE PRODUCT ON A NETWORK?
A: If you have purchased a Site License for this product, you may provide access to the product via your network (rather than copying the software) as long as you have a reasonable mechanism in place to ensure that only users in your school building will have access to the software.
Q: WHO OWNS THE PRODUCT?
A: You own the CD-ROM on which the software and its contents are recorded. McDougal Littell, a division of Houghton Mifflin Company, grants you a license to use the software and its contents in accordance with the terms and conditions set forth in this License Agreement. McDougal Littell, a division of Houghton Mifflin Company, and its licensors own and retain all title, copyright, trademark, and other proprietary rights in and to the software and its contents.
Q: WHAT CAN I DO IF THIS PRODUCT IS DEFECTIVE?
A: You may return a defective CD-ROM within 30 days after you acquire it by calling 1-800-462-6595 for mailing instructions. Provided the CD-ROM has not been physically damaged, McDougal Littell, a Division of Houghton Mifflin Company, will replace the defective CD-ROM.
LIMITED WARRANTY. EXCEPT AS STATED ABOVE, MCDOUGAL LITTELL, A DIVISION OF HOUGHTON MIFFLIN COMPANY, AND ITS LICENSORS MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
REMEDY. Your sole remedy is the replacement of a defective CD-ROM, as provided above. NO LIABILITY FOR DAMAGES. IN NO EVENT SHALL MCDOUGAL LITTELL, A DIVISION OF HOUGHTON MIFFLIN COMPANY, ITS LICENSORS, OR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THE PRODUCT BE LIABLE FOR ANY DIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, SUCH AS, BUT NOT LIMITED TO, LOSS OF ANTICIPATED PROFITS, BENEFITS, USE, OR DATA RESULTING FROM THE USE OF THE PRODUCT, OR ARISING OUT OF ANY BREACH OF ANY WARRANTY.
OTHER RIGHTS. Some states do not permit exclusion of implied warranties or exclusion of incidental or consequential damages. The above exclusions may not apply to you. This warranty provides you with specific legal rights. There may be other rights that you may have which vary from state to state.
Q: ARE THERE ANY RESTRICTIONS ON U.S. GOVERNMENT USE OF THE PRODUCT?
A: McDougal Littell, a division of Houghton Mifflin Company, provides this product to Government Agencies subject to restricted rights. Notice Notwithstanding any lease or license agreement that may pertain to, or accompany the delivery of, this software, the rights of the Government regarding its use, reproduction or disclosure are set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 and subparagraph (c)(1) and (2) of the Commercial Computer Software Restricted Rights clause at FAR 52.227-19.
