  14. TO THE TERMS OF THIS AGREEMENT, PROMPTLY REMOVE THE SOFTWARE
  15. TOGETHER WITH ALL COPIES FROM YOUR COMPUTER.  USER'S USE OF THIS
  16. SOFTWARE IS CONDITIONED UPON COMPLIANCE BY USER WITH THE TERMS OF
  17. THIS AGREEMENT. THE SOFTWARE MAY BE EVALUATED FOR THIRTY  DAYS
  18. ON A ROYALTY FREE BASIS. CONTINUED USE AFTER EVALUATION IS CONDITIONED
  19. UPON PAYMENT BY USER OF THE REGISTRATION FEE SPECIFIED IN THE FILE:
  20. REGISTER.TXT FROM MCAFEE, INC. ("MCAFEE").

  22. 1. LICENSE GRANT. McAfee grants to you a non-exclusive, non-transferable
  23.    right to use the SOFTWARE on file servers connected to a maximum
  24.    number of user computers, or on a maximum number of user computers,
  25.    not exceeding the number of user computers specified on the packaging
  26.    for this product. This license to use the SOFTWARE is conditioned
  27.    upon your compliance with the terms of this Agreement. You agree you
  28.    will only copy the SOFTWARE into any machine-readable or printed form
  29.    as necessary to use it in accordance with this license or for backup
  30.    purposes in support of your use of the SOFTWARE. This license
  31.    is effective until terminated. You may terminate it at any point by
  32.    destroying the SOFTWARE together with all copies of the SOFTWARE.
  33.    Also, McAfee has the option to terminate if you fail to comply with
  34.    any term or condition of this Agreement. You agree upon such
  35.    termination to destroy the SOFTWARE together with all copies of
  36.    the SOFTWARE.

  38. 2. COPYRIGHT. The SOFTWARE is protected by United States copyright law
  39.    and international treaty provisions. You acknowledge that no title to
  40.    the intellectual property in the SOFTWARE is transferred to you. You
  41.    further acknowledge that title and full ownership rights to the
  42.    SOFTWARE will remain the exclusive property of McAfee or its
  43.    suppliers, and you will not acquire any rights to the SOFTWARE
  44.    except as expressly set forth in this license. You agree that any
  45.    copies of the SOFTWARE will contain the same proprietary notices
  46.    which appear on and in the SOFTWARE.

  48. 3. REVERSE ENGINEERING. You agree that you will not attempt to reverse
  49.    compile, modify, translate, or disassemble the SOFTWARE in whole or
  50.    in part.

  52. 4. LIMITED WARRANTY. McAfee warrants that the SOFTWARE will perform
  53.    substantially in accordance with the accompanying written materials
  54.    for a period of thirty (30) days from the date of purchase. Any
  55.    implied warranties relating to the SOFTWARE are limited to thirty
  56.    (30) days.

  58. 5. CUSTOMER REMEDIES. If the SOFTWARE does not conform to the limited
  59.    warranty in Section 4 above ("Limited Warranty"), McAfee's entire
  60.    liability and your sole remedy shall be, at McAfee's option, either
  61.    to (a) correct the error or (b) help you work around or avoid the
  62.    error. The Limited Warranty is void if failure of the SOFTWARE has
  63.    resulted from accident, abuse, or misapplication. Any replacement
  64.    SOFTWARE will be warranted for the remainder of the original Limited
  65.    Warranty period.

  67. 6. NO OTHER WARRANTIES. McAFEE DOES NOT WARRANT THAT THE SOFTWARE IS
  68.    ERROR FREE. EXCEPT FOR THE EXPRESS LIMITED WARRANTY IN SECTION 4
  69.    ("LIMITED WARRANTY"), McAFEE DISCLAIMS ALL OTHER WARRANTIES WITH
  70.    RESPECT TO THE SOFTWARE, EITHER EXPRESS OR IMPLIED, INCLUDING BUT
  71.    NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR
  72.    A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS.
  73.    SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES
  74.    OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY MAY LAST, OR THE
  75.    EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES,
  76.    SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
  77.    THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO
  78.    HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION.

  80. 7. SEVERABILITY. In the event of invalidity of any provision of this
  81.    license, the parties agree that such invalidity shall not affect the
  82.    validity of the remaining portions of this license.

  84. 8. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL McAFEE OR
  85.    ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL,
  86.    INCIDENTAL OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE
  87.    DELIVERY, PERFORMANCE OR USE OF THE SOFTWARE, EVEN IF McAFEE HAS
  88.    BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT
  89.    WILL McAFEE'S LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT,
  90.    TORT OR ANY OTHER THEORY OF LIABILITY, EXCEED THE LICENSE FEE
  91.    PAID BY YOU, IF ANY.
  92.  
  93. 9. GOVERNING LAW. This license will be governed by the laws of the
  94.    State of California as they are applied to agreements between
  95.    California residents entered into and to be performed entirely
  96.    within California. The United Nations Convention on Contracts
  97.    for the International Sale of Goods is specifically disclaimed.

  99. 10.ENTIRE AGREEMENT. This is the entire agreement between you and
  100.    McAfee which supersedes any prior agreement or understanding,
  101.    whether written or oral, relating to the subject matter of this
  102.    license.

  104. U.S. GOVERNMENT RESTRICTED RIGHTS
  105. If this product is acquired under the terms of a (i) Civilian Agency
  106. Contract - use, reproduction or disclosure is subject to
  107. FAR 52.227-19(a) through (d) and restrictions set forth in the
  108. accompanying end user agreement; and (ii) DoD Contract - use,
  109. duplication or disclosure by the Government is subject to the
  110. terms of this license unless superseded by 252.227-7013(c)(1)(ii).
