  4. To avoid unnecessary delays in the processing of your license:

  6. 1.    Type or print (IN CAPITAL LETTERS) all information legibly.
  7.  
  8. 2.    Sign and fill in all the information in the LICENSEE section (right 
  9.     side) only.  Electronic signatures will not be accepted.
  10.  
  11. 3.    VERIFY YOUR EMAIL ADDRESS. Downloading instructions will be sent to 
  12.     ou by email - be sure it is legible.
  13.  
  14. 4.    If you are designating another recipient to receive the source code, 
  15.     you may authorize this by filling in the requested information in the
  16.      LICENSEE section.
  17.  
  18. 5.    Make no additions or changes to the license.

  33. JAVA(tm) INTERNAL NONCOMMERCIAL USE SOURCE LICENSE

  35. 1.0     LICENSE GRANT
  36.  
  37. 1.1     Sun grants to you ("Licensee") a nontransferable, nonexclusive,
  38. royalty-free, limited license to use a copy of the Java Source Code
  39. ("Licensed Software") in the United States, Canada, Japan and the
  40. European Union,  at the location identified below, for internal
  41. evaluation, research and educational purposes only, including the right
  42. to: (i) modify only the Platform Dependent Portion of the Licensed
  43. Software to create ports; and (ii) compile the Licensed Software and
  44. such ports. Other than the limited rights granted in this License,
  45. Licensee acquires no right, title or interest in or to the Licensed
  46. Software, and Licensee shall have no right to distribute the Source
  47. Code of the Licensed Software, except that Licensee may post to the
  48. internet only those modifications to the Source Code created by
  49. Licensee during porting (i.e., diffs). Sun owns all modifications,
  50. enhancements and bug fixes made by or for Licensee to the Licensed
  51. Software.  Licensee shall retain all rights to any software such as
  52. applets and applications that are independently developed by Licensee
  53. without use of the Licensed Software.  In the event that Licensee
  54. creates additional classes or otherwise extends the public programming
  55. interface to the Licensed Software, Licensee must promptly publish an
  56. accurate specification for such extensions for free use by third party
  57. developers of Java-based software. If Licensee desires that its use of
  58. the Licensed Software be for commercial or productive use such as
  59. product development or product or customer support, Licensee must
  60. execute a commercial license agreement with Sun.

  62. 1.2     Sun grants to Licensee the royalty-free right to distribute
  63. binary code developed and compiled from the Licensed Software in
  64. accordance with Subsection 1.1 above ("Derived Binaries"), provided
  65. that: (i) Derived Binaries are not integrated, bundled, combined or
  66. associated in any way with a product, (ii) there is no charge
  67. associated with such distribution, (iii) Derived Binaries are fully
  68. compatible with the then-current version of the publicly available test
  69. suite supplied by Sun which verifies Java compatibility ("JavaTest
  70. Suite") and must remain compatible with subsequent versions of the
  71. JavaTest Suites and upgraded Licensed Software, and (iv) Derived
  72. Binaries are distributed subject to a license agreement containing
  73. terms and conditions at least as protective of Sun as those included in
  74. the binary code license used by Sun for internet distribution of the
  75. Java binaries. In the event that Licensee desires that such
  76. distribution be fee-based, or be associated with a product, Licensee
  77. must execute a commercial license agreement with Sun.
  78.  
  79. 1.3     This License, including any licenses and rights granted
  80. hereunder, the Licensed Software and Derived Binaries may not be sold,
  81. leased, assigned, sublicensed or otherwise transferred, in whole or in
  82. part, by Licensee. Sun is under no obligation to provide maintenance or
  83. support for the Licensed Software, or to notify Licensee of upgrades to
  84. the Test Suites or Licensed Software. If Sun, in its sole discretion,
  85. makes upgrades generally available, use of such upgrades by Licensee
  86. will be subject to the terms of this License.

  88. 2.0     COPYRIGHTS AND TRADEMARKS
  89.  
  90. 2.1     Licensee shall reproduce and apply any copyright or other
  91. proprietary rights notices included on or embedded in Licensed Software
  92. to any copies of Licensed Software or Derived Binaries, in whole or in
  93. part, in any form.
  94.  
  95. 2.2     Licensee acknowledges that Sun owns all Java-related
  96. trademarks, logos and icons ("Java Marks") and agrees to: (i) not use
  97. Java Marks in the names of internet domains or businesses, or applets,
  98. applications implementations, ports, modifications, classes,
  99. extensions, Derived Binaries or other software, developed with or from
  100. the Licensed Software ("Apps"); (ii) not use Java-related logos or
  101. icons in Apps, webpages or other marketing materials, except as may be
  102. authorized separately by Sun; (iii) follow the Java Trademark
  103. Guidelines (see http://java.sun.com/trademarks.html); and (iv) assign
  104. to Sun any rights acquired by Licensee in any Java Mark.
  105.  
  106. 3.0     FEES
  107.  
  108. Use of Licensed Software in accordance with the terms of this License
  109. shall not require payment of a license fee.
  110.  
  111. 4.0     TERM AND TERMINATION
  112.  
  113. 4.1     This License shall commence on the date it is signed by Sun,
  114. and expire three (3) years thereafter.
  115.  
  116. 4.2     Sun may immediately terminate this License upon written notice
  117. to Licensee, if Licensee fails to comply with any of the material terms
  118. or conditions of this License. Upon termination of this License, use of
  119. all Licensed Software by Licensee shall be immediately discontinued,
  120. all copies of Licensed Software shall be destroyed by Licensee, and the
  121. License granted hereunder shall expire.

  124. 5.0     DISCLAIMER OF WARRANTY
  125.  
  126. 5.1     Licensed Software is provided "AS IS" and without any warranty
  127. of any kind, and Licensee accepts all risks and liabilities associated
  128. with its use of Licensed Software.
  129.  
  130. 5.2     SUN DOES NOT MAKE AND HEREBY DISCLAIMS ANY EXPRESS OR IMPLIED
  131. WARRANTIES RELATING TO THE LICENSED SOFTWARE, INCLUDING BUT NOT LIMITED
  132. TO, WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A
  133. PARTICULAR PURPOSE, OR ANY WARRANTIES THAT MIGHT ARISE FROM A COURSE OF
  134. DEALING, USAGE OR TRADE PRACTICE.

  136. 6.0     LIMITATION OF LIABILITY
  137.  
  138. 6.1     In no event will Sun be liable for any lost revenues, data, or
  139. profits, or direct, indirect, special, punitive or consequential
  140. damages, even if Sun has been advised of the possibility or probability
  141. of such damages.
  142.  
  143. 6.2     Licensed Software is not fault-tolerant and is not designed,
  144. manufactured or intended for use in on-line control equipment in
  145. hazardous environments requiring fail-safe performance, such as in the
  146. operation of nuclear facilities, aircraft navigation or communication
  147. systems, air traffic control, direct life support machines, or weapons
  148. systems, in which the failure of Licensed Software or Derived Binaries
  149. could lead directly to death, personal injury, or severe physical or
  150. environmental damage ("High Risk Activities").  Sun specifically
  151. disclaims any express or implied warranty of fitness for High Risk
  152. Activities. Licensee will not use, distribute or resell the Licensed
  153. Software or Derived Binaries for High Risk Activities and will ensure
  154. that its licensees of Derived Binaries are provided with a copy of the
  155. notice specified in the first sentence of this Subsection 6.2.
  156.  
  157. 7.0     CONFIDENTIAL INFORMATION
  158.  
  159. Licensed Software is the confidential and proprietary information of
  160. Sun Microsystems, Inc. ("Confidential Information").  Licensee shall
  161. not disclose Confidential Information and shall use it only for
  162. purposes specifically permitted by this License. This License will not
  163. affect any other confidential disclosure agreement between the
  164. parties.
  165.  
  166. 8.0     EXPORT
  167.  
  168. Licensee shall not export, re-export or transfer, whether directly or
  169. indirectly, Licensed Software or Derived  Binaries or direct products
  170. thereof, to any person or company who is a legal resident or is
  171. controlled by a legal resident of any proscribed country listed in the
  172. U.S. Export Administration Regulations (or any equivalent thereof)
  173. unless properly authorized by the U.S.  Government.
  174.  
  175. 9.0     U.S. GOVERNMENT RESTRICTED RIGHTS
  176.  
  177. Licensed Software is provided with RESTRICTED RIGHTS. Use, duplication,
  178. or disclosure by the Government is subject to the restrictions as set
  179. forth in subparagraph (c) (1) (ii) of the Rights in Technical Data and
  180. Computer Software Clause as DFARS 252.227-7013  and FAR 52.227-19, as
