  1. IDG BOOKS WORLDWIDE, INC.
  2. END-USER LICENSE AGREEMENT
  3.  
  4. READ THIS. You should carefully read these terms and 
  5. conditions before opening the software packet(s) included 
  6. with this book ("Book"). This is a license agreement 
  7. ("Agreement") between you and IDG Books Worldwide, Inc. 
  8. ("IDGB"). By opening the accompanying software packet(s), 
  9. you acknowledge that you have read and accept the following 
  10. terms and conditions. If you do not agree and do not want to 
  11. be bound by such terms and conditions, promptly return the 
  12. Book and the unopened software packet(s) to the place you 
  13. obtained them for a full refund.

  15.    1.   License Grant. IDGB grants to you (either an 
  16. individual or entity) a nonexclusive license to use 
  17. one copy of the enclosed software program(s) 
  18. (collectively, the "Software") solely for your own 
  19. personal or business purposes on a single computer 
  20. (whether a standard computer or a workstation 
  21. component of a multiuser network). The Software is 
  22. in use on a computer when it is loaded into 
  23. temporary memory (i.e., RAM) or installed into 
  24. permanent memory (e.g., hard disk, CD-ROM, or other 
  25. storage device). IDGB reserves all rights not 
  26. expressly granted herein.

  28.    2.   Ownership. IDGB is the owner of all right, title, 
  29. and interest, including copyright, in and to the 
  30. compilation of the Software recorded on the CD-ROM. 
  31. Copyright to the individual programs on the CD-ROM 
  32. is owned by the author or other authorized copyright 
  33. owner of each program. Ownership of the Software and 
  34. all proprietary rights relating thereto remain with 
  35. IDGB and its licensors.

  37.    3.   Restrictions on Use and Transfer.
  38.  
  39.    (a)   You may only (i) make one copy of the Software for 
  40. backup or archival purposes, or (ii) transfer the 
  41. Software to a single hard disk, provided that you 
  42. keep the original for backup or archival purposes. 
  43. You may not (i) rent or lease the Software, (ii) 
  44. copy or reproduce the Software through a LAN or 
  45. other network system or through any computer 
  46. subscriber system or bulletin-board system, or (iii) 
  47. modify, adapt, or create derivative works based on 
  48. the Software.

  50.    (b)   You may not reverse engineer, decompile, or 
  51. disassemble the Software. You may transfer the 
  52. Software and user documentation on a permanent 
  53. basis, provided that the transferee agrees to accept 
  54. the terms and conditions of this Agreement and you 
  55. retain no copies. If the Software is an update or 
  56. has been updated, any transfer must include the most 
  57. recent update and all prior versions.

  59.    4.   Restrictions on Use of Individual Programs. You must 
  60. follow the individual requirements and restrictions 
  61. detailed for each individual program in the "About 
  62. the CD" section of this Book. These limitations are 
  63. contained in the individual license agreements 
  64. recorded on the CD-ROM. These restrictions may 
  65. include a requirement that after using the program 
  66. for the period of time specified in its text, the 
  67. user must pay a registration fee or discontinue use. 
  68. By opening the Software packet(s), you will be 
  69. agreeing to abide by the licenses and restrictions 
  70. for these individual programs. None of the material 
  71. on this disk(s) or listed in this Book may ever be 
  72. distributed, in original or modified form, for 
  73. commercial purposes.

  75.    5.   Limited Warranty.
  76.  
  77.    (a)   IDGB warrants that the Software and CD-ROM are free 
  78. from defects in materials and workmanship under 
  79. normal use for a period of sixty (60) days from the 
  80. date of purchase of this Book. If IDGB receives 
  81. notification within the warranty period of defects 
  82. in materials or workmanship, IDGB will replace the 
  83. defective CD-ROM.

  85.    (b)   IDGB AND THE AUTHOR OF THE BOOK DISCLAIM ALL OTHER 
  86. WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT 
  87. LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND 
  88. FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO 
  89. THE SOFTWARE, THE PROGRAMS, THE SOURCE CODE 
  90. CONTAINED THEREIN, AND/OR THE TECHNIQUES DESCRIBED 
  91. IN THIS BOOK. IDGB DOES NOT WARRANT THAT THE 
  92. FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR 
  93. REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE 
  94. WILL BE ERROR FREE.

  96.    (c)   This limited warranty gives you specific legal 
  97. rights, and you may have other rights which vary 
  98. from jurisdiction to jurisdiction.

  100.    6.   Remedies.
  101.  
  102.    (a)   IDGB's entire liability and your exclusive remedy 
  103. for defects in materials and workmanship shall be 
  104. limited to replacement of the Software, which may be 
  105. returned to IDGB with a copy of your receipt at the 
  106. following address: Disk Fulfillment Department, 
  107. Attn: Internet Directory For Kids & Parents, IDG Books 
  108. Worldwide, Inc., 7260 Shadeland Station, Ste. 100, 
  109. Indianapolis, IN 46256, or call 1-800-762-2974. 
  110. Please allow 3-4 weeks for delivery. This Limited 
  111. Warranty is void if failure of the Software has 
  112. resulted from accident, abuse, or misapplication. 
  113. Any replacement Software will be warranted for the 
  114. remainder of the original warranty period or thirty 
  115. (30) days, whichever is longer.
  116.  
  117.    (b)   In no event shall IDGB or the author be liable for 
  118. any damages whatsoever (including without limitation 
  119. damages for loss of business profits, business 
  120. interruption, loss of business information, or any 
  121. other pecuniary loss) arising from the use of or 
  122. inability to use the Book or the Software, even if 
  123. IDGB has been advised of the possibility of such 
  124. damages.

  126.    (c)   Because some jurisdictions do not allow the 
  127. exclusion or limitation of liability for 
  128. consequential or incidental damages, the above 
  129. limitation or exclusion may not apply to you.
  130.  
  131.    7.   U.S. Government Restricted Rights. Use, duplication, 
  132. or disclosure of the Software by the U.S. Government 
  133. is subject to restrictions stated in paragraph (c) 
  134. (1) (ii) of the Rights in Technical Data and 
  135. Computer Software clause of DFARS 252.227-7013, and 
  136. in subparagraphs (a) through (d) of the Commercial 
  137. Computer--Restricted Rights clause at FAR 52.227-19, 
  138. and in similar clauses in the NASA FAR supplement, 
  139. when applicable.

  141.    8.   General. This Agreement constitutes the entire 
  142. understanding of the parties and revokes and 
  143. supersedes all prior agreements, oral or written, 
  144. between them and may not be modified or amended 
  145. except in a writing signed by both parties hereto 
  146. which specifically refers to this Agreement. This 
  147. Agreement shall take precedence over any other 
  148. documents that may be in conflict herewith. If any 
  149. one or more provisions contained in this Agreement 
  150. are held by any court or tribunal to be invalid, 
  151. illegal, or otherwise unenforceable, each and every 
  152. other provision shall remain in full force and 
  153. effect.
