  8. The following program license is to be shipped with IBM reference,
  9. feature and option diskettes.  This license should be used to cover
  10. Initial Machine Load (IML - BIOS) and Device Drivers that are
  11. preloaded on Systems or recorded on reference, feature or option
  12. diskettes.
  13.  
  14. For information on the use of this license, contact US Business
  15. Practices.  This license is not to be modified or changed without
  16. the approval of US Business Practices, R. E. Howe, T/L 443-8287.

  21.                      NOTICE TO CUSTOMERS

  23.             IBM SYSTEM PROGRAMS LICENSE AGREEMENT

  26. BEFORE OPENING THIS PACKAGE OR USING YOUR SYSTEM, YOU SHOULD READ
  27. THE FOLLOWING TERMS AND CONDITIONS.  OPENING THIS PACKAGE OR
  28. INITIAL USE OF THE SYSTEM PROGRAMS INDICATES YOUR ACCEPTANCE OF
  29. THESE TERMS AND CONDITIONS.

  31. LICENSE
  32.  
  33.   This is a license agreement ("Agreement") for IBM system programs
  34. ("Programs") which are provided on the enclosed IBM diskette(s), or
  35. may be recorded on other media included in this package, or on an IBM
  36. system ("System").  A System includes IBM machines, features,
  37. conversions, upgrades, and options, either separately or in any
  38. combination.
  39.  
  40.   IBM may also include other programs in this package which may be
  41. licensed under different terms and conditions.  Please refer to the
  42. license agreement(s) accompanying such other programs for the terms
  43. and conditions governing their use.
  44.  
  45.   International Business Machines Corporation ("IBM") owns or has
  46. rights to the Programs which are protected by copyright and licensed,
  47. not sold.  If you are a rightful possessor of a System, or if you have
  48. obtained Programs for the purpose of maintaining a System, IBM, or the
  49. applicable IBM country organization, grants you a license to use the
  50. Programs as part of or in conjunction with a System, or to restore and
  51. maintain the Programs.  You obtain no rights other than those granted
  52. to you under this license. IBM retains title to the Programs and all
  53. copies you make of them.

  55. YOU MUST REPRODUCE THE IBM COPYRIGHT NOTICE AND ANY LEGENDS ON EACH
  56. COPY OF A PROGRAM YOU CREATE.
  57.  
  58. This license authorizes you to:
  59.  
  60. 1)  use the Programs as part of, or in conjunction with, a System as
  61.     specified in the IBM documentation;
  62.  
  63. 2)  modify or adapt only the SETUP and ADAPTER DESCRIPTION FILES
  64.     (@XXXX.ADF), if applicable, to enable a System to operate in
  65.     accordance with IBM's Official Published Specifications;
  66.  
  67. 3)  copy the Programs for backup, or archival purposes;
  68.  
  69. 4)  make copies of the Programs and distribute them to a rightful
  70.     possessor of a System and to install the Programs for a rightful
  71.     possessor (but only to the extent necessary to restore or maintain
  72.     the System), provided that you supply such party a copy of this
  73.     Agreement.  Initial use of the Programs by such party shall
  74.     indicate acceptance of this Agreement; and
  75.  
  76. 5)  transfer possession of these Programs and diskette(s) to another
  77.     party in conjunction with the transfer of a System, provided that
  78.     you supply a copy of this Agreement to such party.  Initial use of
  79.     these Programs by such party shall indicate acceptance of this
  80.     Agreement.  Such transfer of possession of the Programs shall
  81.     terminate your license from IBM, and you must, at the same time,
  82.     either transfer to such party or destroy all your other copies of
  83.     the Programs.

  85. You may NOT:
  86.  
  87. 1)  use, merge, copy, display, adapt, modify, execute, distribute or
  88.     transfer the Programs, except as authorized by this license;
  89.  
  90. 2)  reverse assemble, reverse compile, decode, or translate the
  91.     Programs; or
  92.  
  93. 3)  sublicense, rent, lease, or assign Programs.

  96. WARRANTY
  97.  
  98.   IBM warrants the Programs in accordance with the Statement of
  99. Limited Warranty that accompanied your System, which is hereby
  100. incorporated by reference.

  103. GENERAL
  104.  
  105.   You may terminate your license at any time.  IBM may terminate your
  106. license if you fail to comply with the terms and conditions of this
  107. Agreement.  In either event, you must destroy all your copies of the
  108. Programs.
  109.   You are responsible for the payment of any taxes, including personal
  110. property taxes, resulting from this Agreement.
  111.   Neither party may bring an action, regardless of form, more than two
  112. years after the cause of action arose.
  113.   If you acquire the Programs in the United States, this license is
  114. governed by the laws of the State of New York.  If you acquired the
  115. Programs in Canada, this license is governed by the laws of the
  116. Province of Ontario.  Otherwise, this license is governed by the laws
  117. of the country in which you acquired the Programs.
