  9. 1.     GRANT OF LICENSE. Virgin Interactive Entertainment, Inc. 
  10. hereby grants you (either an individual or an entity), the end 
  11. user, the limited, non-transferable right to use this one copy 
  12. of this software/cartridge product, and any accompanying 
  13. electronic files and printed materials (collectively the 
  14. "Product"), on any single computer or game platform only for 
  15. your personal use and enjoyment. This License is your proof of 
  16. license to exercise the rights granted herein and must be 
  17. retained by you.  Virgin may terminate this License immediately 
  18. if you fail to comply with any of the terms contained herein.

  20. 2.     COPYRIGHT AND RESTRICTIONS.  You have no ownership rights 
  21. to the Product.  The Product is owned by Virgin and/or its 
  22. suppliers and is protected by the United States copyright laws 
  23. and international treaty provisions.  Virgin retains all rights 
  24. not expressly granted herein.  You must therefore treat the 
  25. Product like any other copyrighted material (e.g. a book or 
  26. musical recording).

  28. The Product is licensed to you only for your personal use and 
  29. enjoyment and may not be used for any commercial purpose whatsoever. 
  30.  You may not loan, rent, lease, give, sell, offer for sale, 
  31. sublicense or otherwise transfer the Product, or any portion of 
  32. the Product or anything incorporated therein, including any screen 
  33. display, sound or accompanying documentation, to any third party, 
  34. nor may you permit any other person to use the Product in exchange 
  35. for remuneration.  Further, you may not place the Product on a 
  36. computer system that would allow multiple users to access it. 
  37. Notwithstanding the foregoing, in one case you may transfer your 
  38. rights under this License on a permanent basis provided you 
  39. transfer this License and the Product, including all accompanying 
  40. printed materials, while retaining no copies, and the recipient 
  41. agrees to the terms of this License.  If the Product is an update, 
  42. any transfer must include this update and all prior revisions.

  44. You also may not copy, modify, adapt, translate, create derivative 
  45. works of, publicly perform, publicly display, distribute, transmit, 
  46. decompile, disassemble, or otherwise reverse engineer or attempt 
  47. to reverse engineer or derive source code from, all or any portion 
  48. of the Product or anything incorporated therein, including any 
  49. screen display, sound or accompanying documentation, or permit or 
  50. encourage any third party to do so.  Notwithstanding the foregoing, 
  51. if the Product contains personal computer software, you may either 
  52. (a) make one copy of the software solely for backup or archival 
  53. purposes, or (b) transfer the software to a single hard disk 
  54. provided you keep the original solely for backup or archival 
  55. purposes.  Further, if the Product contains a map or level editor, 
  56. you may use the editor in accordance with the instructions in the 
  57. accompanying documentation to create maps or levels for your 
  58. personal use and enjoyment, and you may allow others to use such 
  59. maps or levels for their personal use and enjoyment, but in no 
  60. event may such maps or levels be exploited commercially in any 
  61. manner, by you or any other person or entity.

  63. Without limiting the generality of the foregoing restrictions, 
  64. specifically you may not offer the Product on a pay-per-play basis 
  65. or on a computer system or network to which you lease or rent 
  66. access to others, electronically distribute the Product, or any 
  67. portion of the Product or anything incorporated therein, including 
  68. any screen display, sound or accompanying documentation, or, if 
  69. the Product contains a map or level editor, sell or permit any 
  70. third party to sell maps or levels you create for use with the 
  71. Product.  Commercial exploitation licenses are available in certain 
  72. circumstances.  Please contact Virgin  in the manner set forth at 
  73. the end of this License for more information.

  75. 3.     U.S. GOVERNMENT RESTRICTED RIGHTS.  The Product, including 
  76. all accompanying written materials, are provided with RESTRICTED 
  77. RIGHTS.  Use, duplication, or disclosure by the Government is 
  78. subject to restrictions as set forth in Restricted Rights in 
  79. Technical Data and Computer Software Clause at FAR 52.227-7013(c)
  80. (1)(ii) or FAR 52.227-19.  Publisher is Virgin Interactive

  83. 4.     LIMITED WARRANTY.  You expressly acknowledge and agree that 
  84. use of the Product is at your sole risk.  The Product is provided 
  85. "as is" and without warranty of any kind, except that Virgin 
  86. warrants that the software/cartridge will perform substantially in 
  87. accordance with the accompanying written materials for a period of 
  88. ninety (90) days from the date of the Product's initial purchase.  
  89. Any implied warranties on the Product are limited to ninety (90) 
  90. days.  SOME STATES/JURISDICTIONS DO NOT ALLOW LIMITATIONS ON DURATION 
  91. OF AN IMPLIED WARRANTY, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

  93. 5.     NO OTHER WARRANTIES.  VIRGIN DISCLAIMS ALL OTHER WARRANTIES, 
  94. EXPRESS, IMPLIED OR, TO THE EXTENT PERMISSIBLE BY LAW, STATUTORY, 
  95. INCLUDING ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR 
  96. PURPOSE AND NON-INFRINGEMENT, WITH RESPECT TO THE PRODUCT.  
  97. VIRGIN DOES NOT WARRANT THAT THE PRODUCT WILL SATISFY THE REQUIREMENTS 
  98. OF YOUR COMPUTER SYSTEM OR THAT THE PRODUCT IS WITHOUT DEFECT OR ERROR 
  99. OR THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED.

  101. 6.     CUSTOMER REMEDIES.  Virgin's entire liability and your exclusive 
  102. remedy shall be, at Virgin's option, either (a) return of the price 
  103. paid for the Product or (b) repair or replacement of the Product that 
  104. does not meet the Limited Warranty set forth in Section 4, and that is 
  105. returned to Virgin with a copy of your receipt.  In no event shall 
  106. Virgin's liability with respect to this limited warranty exceed the 
  107. cost of replacement of the media on which the Product is recorded.  
  108. The Limited Warranty set forth in Section 4 is void if failure of the 
  109. Product has resulted from accident, abuse, misapplication or any 
  110. wrongful act by you.  Any replacement of the Product will be warranted 
  111. for the remainder of the original warranty period or thirty (30) days, 
  112. whichever is longer.  Neither these remedies nor any product support 
  113. services offered by Virgin are available for this U.S.A. version 
  114. Product outside of the United States of America.

  116. 7.     LIMITATION OF LIABILITY.  IN NO EVENT SHALL VIRGIN OR ITS 
  117. SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT 
  118. LIMITATION, CONSEQUENTIAL, SPECIAL, INDIRECT, DIRECT, INCIDENTAL, 
  119. LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS 
  120. INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR 
  121. INABILITY TO USE THE PRODUCT, EVEN IF VIRGIN HAS BEEN ADVISED OF 
  122. THE POSSIBILITY OF SUCH DAMAGES.  BECAUSE SOME STATES AND/OR 
  123. JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY 
  124. FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT 
  125. APPLY TO YOU.  IN NO EVENT SHALL VIRGIN'S LIABILITY BY OPERATION OF 
  126. LAW, IF ANY, BE GREATER THAN THE PRICE YOU PAID FOR THE PRODUCT.  
  127. THE WARRANTY AND REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU 
  128. OF ALL OTHERS, ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED.  
  129. NO DEALER, DISTRIBUTOR, AGENT OR EMPLOYEE IS AUTHORIZED TO MAKE 
  130. ANY MODIFICATION OR ADDITION TO THIS WARRANTY.

  132. 8.     GENERAL.   This License sets forth the entire agreement between 
  133. the parties with respect to the subject matter hereof and supersedes 
  134. all prior negotiations, understandings and agreements, whether written 
  135. or oral, between the parties hereto concerning the subject matter 
  136. hereof.  This License is governed by the laws of the State of 
  137. California.  This License is severable.  Should any provision of this 
  138. License be held to be void, invalid or unenforceable, the remaining 
  139. provisions hereof shall not be affected and shall continue in effect 
  140. as though such unenforceable provision(s) have been deleted herefrom.  
  141. The name of this License and the headings of the sections of this 
  142. License are inserted merely for convenience and shall not be used or 
  143. relied upon in or in connection with the construction or 
  144. interpretation of this License.  For more information about
