  20. The PRIVACY Forum is a moderated digest for the discussion and analysis of
  21. issues relating to the general topic of privacy (both personal and
  22. collective) in the "information age" of the 1990's and beyond.  The
  23. moderator will choose submissions for inclusion based on their relevance and
  24. content.  Submissions will not be routinely acknowledged.

  26. ALL submissions should be addressed to "privacy@cv.vortex.com" and must have
  27. RELEVANT "Subject:" lines.  Submissions without appropriate and relevant
  28. "Subject:" lines may be ignored.  Subscriptions are by an automatic
  29. "listserv" system; for subscription information, please send a message
  30. consisting of the word "help" (quotes not included) in the BODY of a message
  31. to: "privacy-request@cv.vortex.com".  Mailing list problems should be
  32. reported to "list-maint@cv.vortex.com".  All submissions included in this
  33. digest represent the views of the individual authors and all submissions
  34. will be considered to be distributable without limitations.

  70. applications.  I'm afraid that she psyched it out right: hope for the best
  71. and trust that you won't be victimized.
  72.  
  73. Actually this is one example of what I referred to 10-15 years ago as
  74. "data puddles" -- small collections of personal and possibly sensitive
  75. information -- that would get created and lie around as a byproduct of
  76. being in some line of business.  My example at the time was the databases
  77. accumulated in the checkout stands of supermarkets or small grocery
  78. outlets.  Another example was bankcard drafts, especially before
  79. California outlawed the collection of driver license numbers by the
  80. merchant who usually also added the fone number as well.
  81.  
  82. There is no law, only the implied behavior of business ethics, that will
  83. provide protection to Ms.  Hirsch.  The big problem with data puddles
  84. which are rapidly becoming major lakes if not inland seas, is that people
  85. handling such information are not trained in or accustomed to protecting
  86. sensitive material.  They are apt to be careless, but then so are banks
  87. which have been known to throw away unwanted copies of sensitive paper in
  88. the dumpster in the alley.

  90. Neither is there any legal protection for it; hence, any enforcement
  91. official can come along and subpoena it or even acquire it
  92. surreptitiously.  PIs and attorneys likewise have easy pickings.
  93.  
  94. The social problem of protecting people against consequences of mis-
  95. handling all such data collections has stymied me for years, especially in
  96. a reactive democratic society and government.  An attractive possibility
  97. would be to bring privacy infractions in under tort law but then one has
  98. to show, and perhaps prove, harm or damages.  All one can do, at the
  99. moment, is accept such things as a risk of living on this planet and try
  100. to minimize the amount of information that gets revealed.

  102. The present situation is worrisome enough, but try applying for a home
  103. loan.  Most places want, in addition to all else, complete copies of last
  104. two years' Federal and State tax returns complete with all enclosures.
  105. There are known instances of there being a secondary market in "used and
  106. filled-out 1040 forms".

  116. Greetings.  One manner in which I hope this digest will be of value is to
  117. help relate the more "theoretical" and "academic" aspects of privacy to the
  118. sorts of events that actually occur in people's lives.  To this end, I
  119. invite those of you who feel comfortable doing so to relate any experiences
  120. which you have undergone that relate to the overall topic area of privacy.
  121.  
  122. Perhaps you've had problems with inaccurate information in a database, been
  123. the victim of credit fraud, or otherwise lived through events the telling of
  124. which might be illuminating to the readership.  Of particular interest is
  125. what steps you took to deal with the situation, or how you believe your
  126. experiences relate to overall privacy topics.

  128. Remember, it's the aspects of privacy in our technological age affecting
  129. *you*, and of interest to *you*, that are an extremely important part of the
  130. PRIVACY Forum.
