CHARTER OF THE
COMPUTER SYSTEM SECURITY AND PRIVACY ADVISORY BOARD
Establishment:
In accordance with the requirements of Section 3 of the Computer
Security Act of 1987 (P. L. 100-235), the Secretary of Commerce
hereby establishes the Computer System Security and Privacy Advisory
Board, pursuant to the Federal Advisory Committee Act, 5 U.S.C. App.
2.
Objectives and Duties:
1. The Board shall identify emerging managerial, technical,
administrative, and physical safeguard issues relative to
computer systems security and privacy.
2. The Board shall advise the National Institute of Standards and
Technology and the Secretary of Commerce on security and privacy
issues pertaining to Federal computer systems.
3. The Board will function solely as an advisory body, in
accordance with the provisions of the Federal Advisory Committee
Act.
Members and Chairperson:
1. The Director of the National Institute of Standards and
Technology shall appoint the Chairperson and the members of the
Board.
2. The membership of the Board shall consist of twelve members and
a Chairperson. The term of office of each member of the Board
shall be four years, except that of the initial membership,
three members will have one-year appointments, three will have
two-year appointments, three will have three-year appointments,
and three members will have four-year appointments.
3. The membership of the Board shall include: (1) four members from
outside the Federal Government eminent in the computer or
telecommunications industry, including at least one
representative of small or medium sized companies in such
industries; (2) four members from outside the Federal Government
who are eminent in the fields of computer or telecommunications
technology, or related disciplines, but who are not employed by
or representatives of a producer of computer or
telecommunications equipment; and (3) four members from the
Federal Government, including one from the National Security
Agency, who have computer systems management experience,
including experience in computer systems security and privacy.
4. The Director of the National Institute of Standards and
Technology shall appoint the Chairperson from among the
membership of the Board.
Administrative Provisions:
1. The Board will report through the Director of the National
Institute of Standards and Technology to the Secretary of
Commerce, and as required by Section 3 of the Computer Security
Act of 1987 to the Director of the Office of Management and
Budget, the Director of the National Security Agency, and the
appropriate committees of the Congress.
2. The Board will meet semi-annually, except that additional
meetings may be called as deemed necessary by the NIST Director
or by the Chairperson. Meetings will be held in the Washington,
D.C., area or at business locations approved by the Director of
NIST.
3. Members of the Board, other than full-time employees of the
Federal Government, will not be compensated for their services,
but will, upon request, be allowed travel expenses in accordance
with Subchapter I of Chapter 57 of Title 5, United States Code,
while otherwise performing duties at the request of the Board
Chairperson, while away from their homes or a regular place of
business.
4. To provide the staff services necessary to assist the Board in
carrying out its functions, the Board will utilize personnel
from the National Institute of Standards and Technology and may
utilize personnel from any other agency of the Federal
Government with the consent of the Head of such agency.
5. The annual cost of operating the Board is estimated at $98,503.
This includes travel and per diem expenses, printing and mailing
costs, and one person year of technical staff support.
6. The Board shall not act in the absence of a quorum, which shall
consist of seven members.
7. The Board may establish such committees and subcommittees of its
members as may be necessary, subject to provisions of the
Federal Advisory Committee Act and the Department of Commerce
Committee Management Handbook.
Duration:
The Board will terminate two years from the date of this charter
unless earlier terminated or renewed by proper authority by
appropriate action.
