  9.  This file contains important license information regarding the distribution
  10.  and use of the WAVmaker Evaluation Package (henceforth, "WAVmaker EP") and
  11.  of the WAVmaker Registered Package. If neither Evaluation Package (EP) nor
  12.  Registered Package are specified, the term "WAVmaker" refers to both.
  13.  
  14.  WAVmaker is NOT in the public domain, nor is it freeware. It is Copyright (C)
  15.  Tommy Anderberg, 1995. All rights reserved worldwide. This software and all
  16.  the accompanying data and documentation files are protected by national and
  17.  European laws and by International Treaty provisions. You must treat WAVmaker
  18.  like any other copyrighted material, except that you may copy the WAVmaker EP
  19.  and give to others (subject to the limitations outlined below). Any use or
  20.  distribution of this software, data and documentation in violation of
  21.  Copyright law or of the terms outlined in this document will be prosecuted to
  22.  the best of our ability.

  24.  The conditions under which you may copy and distribute the WAVmaker EP are
  25.  described below under "Limited Distribution License Agreement".

  33.  Limited Distribution License Agreement

  36.  This Limited Distribution License Agreement (throughout this section, the
  37.  "Agreement") is a legal agreement between you, the distributor, and Tommy 
  38.  Anderberg. By copying any part of WAVmaker, you are agreeing to be bound by 
  39.  the terms of this Agreement.
  40.  
  41.  As the copyright and trademark holder for WAVmaker, Tommy Anderberg authorizes
  42.  individuals and organizations to copy the files contained in the WAVmaker EP
  43.  for their own use or for giving to others, ONLY when the following conditions
  44.  are met:
  45.  
  46.  ■ The WAVmaker EP - including all related program, data and documentation
  47.    files - may not be modified in any way and must be distributed together,
  48.    as a complete package, without exception. You may not distribute corrupted
  49.    or otherwise damaged files.
  50.  
  51.  ■ No price or other compensation may be charged for the WAVmaker EP. A
  52.    reasonable distribution cost may be charged for the distribution media, 
  53.    shipping and handling. BBS systems may not charge beyond their normal 
  54.    rates for downloads of the WAVmaker EP.
  55.  
  56.  ■ WAVmaker is designed to be easily extended by the addition of new program
  57.    and data modules. You may not, however, distribute an extended version of
  58.    the WAVmaker EP without prior written permission from Tommy Anderberg.

  60.  ■ You may not distribute any file contained in the WAVmaker Registered
  61.    Package, either with the WAVmaker EP, by itself, or as part of another
  62.    public domain, freeware, shareware, or commercial packaging offer,
  63.    without prior written permission from Tommy Anderberg.

  65.  ■ Neither this Agreement nor any part or portion hereof shall be assigned or
  66.    sublicensed, except as described herein. Should any provision of this
  67.    Agreement be held to be void, invalid, unenforceable or illegal by a court,
  68.    the validity and enforceability of the other provisions shall not be
  69.    affected thereby. If any provision is determined to be unenforceable, you
  70.    agree to a modification of such provision to provide for enforcement of the
  71.    provision's intent, to the extent permitted by applicable law. Failure of a
  72.    party to enforce any provision of this Agreement shall not constitute or be
  73.    construed as a waiver of such provision or of the right to enforce such
  74.    provision. If you fail to comply with any terms of this Agreement, your
  75.    license is automatically terminated, and you may be prosecuted at any time
  76.    under national and European laws and under International Treaty provisions.

  78.  ■ You acknowledge that you have read this Agreement, you understand this
  79.    agreement, and understand that by copying any part of WAVmaker, you agree
  80.    to be bound by this Agreement's terms and conditions. You further agree
  81.    that, except for written separate agreements between Tommy Anderberg and
  82.    you, this Agreement is a complete and exclusive statement of your 
  83.    distribution rights. This agreement supersedes all prior oral agreements,
  84.    proposals or understandings, and any other communications between Tommy
  85.    Anderberg and you relating to the subject matter of this Agreement.

  88.  Limited User License Agreement
  89.  ──────────────────────────────

  91.  This Limited User License Agreement (throughout this section, the "Agreement")
  92.  is a legal agreement between you, the user, and Tommy Anderberg. By installing
  93.  WAVmaker, by loading or running any part of it, or by placing or copying any 
  94.  part of it onto your computer hard drive, you are agreeing to be bound by the 
  95.  terms of this Agreement.
  96.  
  97.  For the purposes of this section, "use" means loading the software into RAM,
  98.  as well as installation on a hard disk or other storage device.
  99.  
  100.  As the copyright and trademark holder for WAVmaker, Tommy Anderberg 
  101.  authorizes individuals or organizations to use WAVmaker, ONLY when the 
  102.  following conditions are met:
  103.  
  104.  ■ You shall not: modify, translate, disassemble, decompile or reverse
  105.    engineer the compiled executables contained in WAVmaker.
  106.  
  107.  ■ You may not exploit running copies of WAVmaker commercially, e.g. by
  108.    renting, leasing or selling access to a computer running WAVmaker.
  109.  
  110.  ■ The WAVmaker EP is intended for evaluation purposes. You may not
  111.    distribute or otherwise exploit the output produced by WAVmaker if you
  112.    have not purchased your own personal copy of the WAVmaker Registered
  113.    Package.

  115.  ■ You are free to distribute and exploit the output produced by WAVmaker,
  116.    provided that you have purchased a personal copy of the WAVmaker Registered
  117.    Package, and that the output in question is not part of a competing product
  118.    (e.g. a sound data base for use with WAVmaker itself, and hence in direct
  119.    competition with the WAVmaker Registered Package), in which case you must
  120.    have prior written permission from Tommy Anderberg.

  122.  ■ The user accepts sole and full responsibility for any damage or loss arising
  123.    from the use or the inability to use WAVmaker. While this software has been
  124.    extensively tested and is believed to be safe, Tommy Anderberg disclaims
  125.    any warranties, either expressed or implied, including but not limited to
  126.    warranties of fitness for ANY particular purpose and of uninterrupted,
  127.    error free operation. Under no circumstances shall Tommy Anderberg be
  128.    liable for loss of data, loss of profits, lost savings, special, incidental,
  129.    consequential, indirect or other similar damages arising from the use or
  130.    the inability to use WAVmaker.

  132.  ■ Neither this Agreement nor any part or portion hereof shall be assigned or

  149.    Agreement's terms and conditions. You further agree that, except for written
  150.    separate agreements between Tommy Anderberg and you, this Agreement is a
  151.    complete and exclusive statement of the rights and liabilities of the
  152.    parties involved in the use of WAVmaker. This agreement supersedes all
  153.    prior oral agreements, proposals or understandings, and any other
  154.    communications between Tommy Anderberg and you relating to the subject
  155.    matter of this Agreement.
