  2.   These are the Zipcon policies.  They may appear rather harsh at times.
  3. We find them necessary as protection, and hope that they don't affect
  4. your opinion of our service in a negative way.

  10. ZIPCON TERMS AND CONDITIONS EFFECTIVE DATE:
  11. Current as of September 1995

  13. 1.   You (the customer) understand these Terms and Conditions and
  14. agree to abide by them. You further agree to pay for  these  ser-
  15. vices according to the Billing Policies currently in effect.
  16.  
  17. 2.   If  we  (Zipcon) do not receive your payments when due, your
  18. account may be terminated. Termination of your account  will  not
  19. remove your obligation to pay all charges incurred up to the date
  20. of termination. In addition you will be liable for any collection
  21. costs incurred by Zipcon in conjunction with your account.

  23. 3.   Zipcon makes no warranties of any kind, whether expressed or
  24. implied, including any implied  warranty  of  merchantability  of
  25. fitness  of  these  services  for  any particular purpose. Zipcon
  26. takes no responsibility for any damages suffered by  you  includ-
  27. ing, but not limited to: loss of data from delays, nondeliveries,
  28. misdeliveries, or service interruptions, even if caused by Zipcon
  29. negligence or your errors and/or omissions.

  31. 4.   Zipcon services may only be used for lawful purposes. Trans-
  32. mission of any material in violation of any US or  state  regula-
  33. tion  is  prohibited. This includes, but is not limited to: copy-
  34. righted material, threatening or obscene  material,  or  material
  35. protected by trade secret.

  37. 5.   At  our  discretion,  Zipcon  may revoke your account at any
  38. time. Unused credit or payments will be refunded on  a  pro-rated
  39. basis.  If it is determined that you are participating in illegal
  40. activity, Zipcon will notify the proper law-enforcement  authori-
  41. ties.

  43. 6.   You may cancel your account at any time with written notice.
  44. You will be responsible for any charges up to the date of  termi-
  45. nation of service. Any unused payments will be refunded, based on
  46. pro-ration of your system usage.
  47.  
  48. 7.   Use of any information obtained through these services is at
  49. your  own risk. Zipcon specifically denies any responsibility for
  50. the accuracy or quality of any information obtained  through  the
  51. use of our services.

  53. 8.  Zipcon will not give out personal information on  anyone.
  54.  
  55. 9.   If  you connect to other organizations or networks using our
  56. facilities, you are subject to their respective  permissions  and
  57. usage policies.

  59. 10.  You agree to notify us in writing of any changes in your ac-
  60. count information, such as your address or contact phone  number.
  61.  
  62. 11.  Per  session  time limits may be set to two hours when phone
  63. lines are busy. You may log back in after a 5 minute period.

  65. 12.  Disk space is initially set at 10 megabytes per user.  Addi-
  66. tional  disk  space may be alotted if necessary. Please send mail
  67. to "support@zipcon.net" for more information.

  69. 13.  These Terms and Conditions are subject to change without no-
  70. tice.  A  copy of the current Terms and Conditions will always be
  71. available on the system through the use  of  the  login  menu  or
  72. "menu" command. Continuing to use your account after new policies
  73. have gone into effect will constitute your agreement to abide  by
  74. said policies. Please check the policy statement on a regular ba-
  75. sis.

  77. 14.  These Terms and Conditions supersede all previous agreements
  78. or understandings.

  80. 15.  Certain  materials  available on our system are copyrighted.
  81. You agree not to disseminate or publish or make available in  any
  82. other manner, any copyrighted material.

  84. 16.  Personal  accounts  are  for the use of the subscriber only.
  85. Sharing your  account  with  anyone,  including  your  family  or
  86. friends, is not allowed.

  88. 17.  On  personal PPP/SLIP accounts, using an artificial means to
  89. keep your line in use, when you are not  actively  using  it,  is
  90. prohibited.   Unmetered use is not unlimited use. If you need un-
  91. limited use, please contact us about purchasing a dedicated  cir-
  92. cuit.

  94. 18.  Unsolicited advertising via email or posting to UseNet news-
  95. groups not meant for advertising is prohibited and will result in
  96. account termination.   Several short documents with general rules
  97. and frequently asked questions are located at:

  99. Its the subscriber's duty to be aware of and abide by these rules
