  1. W i n N E T   M a i l   &   N e w s (TM)

  3. Terms and Conditions.

  5. 1.  The WinNET Mail & News (TM) software, Core TCP/IP
  6.     protocol stack, and WWW browser installation software is
  7.     distributed freely for the purpose of connecting with
  8.     the WinNET service.  There is no charge for the software
  9.     as long as it is used for this purpose. 
  10.  
  11. 2.  The WinNET service is billed on a monthly flat rate
  12.     basis of 
  13.  
  14.                 $19.95 per month.
  15.                 
  16.     This provides service for up to
  17.  
  18.                 four (4) connect hours per month.
  19.     
  20.     Usage beyond the first four hours is billed at the rate
  21.     of 
  22.  
  23.                 $5.40 per hour.
  24.  
  25.     Service is billed on a calendar month basis.  The flat
  26.     rate and the corresponding four connect hours are
  27.     prorated in the first and last calendar month of
  28.     service. 
  29.  
  30.     Connect time is recorded in increments of one minute. 
  31.     Fractions of minutes are billed as full minutes.  All
  32.     amounts are denominated in U.S. dollars.
  33.  
  34. 3.  Toll free 800 number service access is provided free of
  35.     charge within the U.S.  Canadian toll free 800 number
  36.     service access is also available for a surcharge.
  37.  
  38. 4.  Payment.  As part of your account registration we
  39.     request a credit card number for payment.  You will be
  40.     charged $19.95 when you first establish your account as
  41.     payment of your first month of service.

  44. 5.  You will be sent a statement of account usage via
  45.     WinNET mail after the end of the month.  Your credit 
  46.     card will be charged for the amount on the statement.

  48.     Other payment arrangements are possible, please contact
  49.     us (telephone: 1-800-WIN-NET2 or 502-589-6800).

  51. 6.  Ending Service.  If you choose to terminate your account
  52.     on WinNET, all you need to do is contact us by WinNET
  53.     Mail (accounts@win.net), letter, or telephone.  We will 
  54.     end your service on the date that you request and prorate 
  55.     your charge for that month accordingly.

  57. 8.  WinNET Communications exercises no control whatever over
  58.     the content of the information passing through the
  59.     WinNET system.  WinNET Communications is not responsible
  60.     for the accuracy, quality, or content of the information
  61.     obtained through its service.  WinNET Communications
  62.     makes no warranty, whether expressed or implied, for the
  63.     service it offers.  WinNET Communications disclaims any
  64.     warranty of merchantability of fitness for a particular
  65.     purpose.

  67. 9.  WinNET Communications makes no warranty whether
  68.     expressed or implied for the WinNET software.  No
  69.     warranty of merchantability or fitness for a particular
  70.     purpose is provided for the WinNET software.

  72. 10. WinNET may only be used for lawful purposes.
  73.     Transmission of any material in violation of United
  74.     States law, laws of the nation in which WinNET is used,
  75.     or state law or regulation is prohibited.  This 
  76.     includes, but is not limited to: copyrighted material,
  77.     material legally judged to be threatening or obscene, or
  78.     material protected by trade secret.  You agree to
  79.     indemnify and hold harmless WinNET Communications from
  80.     any claims resulting form your use of the WinNET service
  81.     or WinNET software which damages you or another party.
