  9. The Universal VESA VBE is not public domain software. It is copyrighted
  10. software, Copyright (C) 1992,1993 Kendall Bennett. It is however free
  11. software (with the restrictions noted below), or what some people term
  12. "Freeware". There are no restrictions on the usage of the program. You
  13. may use it for whatever you wish, on as many systems as you desire
  14. (within the bounds of the duplication restrictions below).

  16. Duplication and distribution restrictions

  19. 1. If you are an end user, or a corporation, you have an unlimited license
  20.    to copy and use the program on as many machines as you desire. You may
  21.    also distribute copies to your friends and colleagues for no charge
  22.    providing you do not accept a fee for this service.

  24. 2. Software distribution companies that distribute shareware and freeware
  25.    software may charge their normal distribution fee for the software if
  26.    provided in diskette form. No distribution fee is permitted to be
  27.    charged for electronically distributed copies (except the usual
  28.    connection fees associated with the distribution channel).

  30. 3. If you are the author of a shareware or commercial application and wish
  31.    to distribute the Universal VESA VBE with your package, you must
  32.    purchase a Software License Agreement from the Author. The following
  33.    conditions must also be met: a) If any reference to the program is made
  34.    in your user documentation, reference to the fact that the program is
  35.    Copryright (C) 1993 Kendall Bennett MUST be made. b) This copyright notice
  36.    (this file) MUST be distributed along with the package in electronic form.
  37.    c) The distributed archive shall be one of the official executable only
  38.    distribution archives released by the author. d) No restriction shall be
  39.    placed on users duplicating the Universal VESA VBE distributed with your
  40.    application. e) Any modifications made to the code will be forwarded to
  41.    the Author for inclusion in a future release. g) You may NOT distribute
  42.    the program until a Software License Agreement between youself (or you
  43.    company) and the Author has been signed. You may include information
  44.    regarding the installation and use of the Universal VESA VBE from the
  45.    file 'univbe.doc' in your applications user's guide. Please contact the
  46.    author directly for Software Licensing information and pricing.

  48. 4. If you are a video card manufacturer, you may distribute the program
  49.    with your products or make the program available to your customers
  50.    for no charge, under the following conditions: a) You MUST test
  51.    and debug the Universal VESA VBE on your video cards and provide
  52.    modifications and updates to the author. b) You may NOT distribute
  53.    modified versions on the executable until the updates have been
  54.    processed and included in the next release. c) The package MUST be
  55.    provided in the original executable only archive format, even if
  56.    distributed on floppy diskette with your products, containing this file
  57.    and all online user documentation.

  59. 5. You may NOT re-distribute modified versions of the source code or
  60.    executables, nor may you distribute any part of the source code
  61.    for a profit. If you make any worthwhile changes to the source code,
  62.    you can send them to the author to be included in a future release.
