  1.          Virginia's PEN Acceptable Use Policy

  5.      The following policies and guidelines have been established for
  6. the network by a committee of node administrators, university personnel,
  7. and Department of Education representatives.  Members of this committee
  8. also included K-12 classroom teachers, student, and school administrators.
  9. Acceptance of the policies are automatic upon use of the network.

  17. VIRGINIA'S PEN Purpose
  18.  
  19.      The purpose of the Virginia's Public Education Network, VIRGINIA'S
  20. PEN, is to advance and promote a world class public education in
  21. Virginia.  VIRGINIA'S PEN is intended to assist in the collaboration and
  22. exchange of information between and among schools, school offices, the
  23. Virginia Department of Education, and other State and educational entities.
  24.  
  25. VIRGINIA'S PEN Goal
  26.  
  27.      The goal of VIRGINIA'S PEN is to promote innovation and educational
  28. excellence in Virginia's public schools.  To achieve this, the network
  29. must provide quality, equitable, and cost-effective information and
  30. communication resources to the public education community.
  31.  
  32. VIRGINIA'S PEN Mission Statements & Priority Listing
  33.  
  34. 1.   To provide electronic mail service and electronic conferencing
  35.      capabilities to public school professional employees;
  36.  
  37. 2.   To provide basic services at no cost to public education end users;
  38.  
  39. 3.   To provide an intuitive user interface which includes an easy to
  40.      use text editor;
  41.  
  42. 4.   To provide accessibility for the user via multi-vendor
  43.      microcomputers;
  44.  
  45. 5.   After first providing basic services, to provide opportunities for
  46.      wider networking (interstate and international) by promoting the
  47.      addition of full Internet services where economically feasible;
  48.  
  49. 6.   To provide for both administrative and instructional file
  50.      transfer capabilities where feasible.
  51.  
  52.             VIRGINIA'S PEN Use
  53.  
  54.      All use of VIRGINIA'S PEN shall be consistent with the purpose, goal,
  55. mission, and priorities of the network.  Successful operation of the
  56. network requires that its users regard VIRGINIA'S PEN as a shared
  57. resource, and cooperate to form a community of diverse interests with the
  58. common purpose of advancing a world class public education in Virginia.
  59. It is therefore imperative that members conduct themselves in a
  60. responsible, decent, ethical, and polite manner while using the network.
  61.  
  62.      The intent of the VIRGINIA'S PEN acceptable use policy is to ensure
  63. that all uses of VIRGINIA'S PEN are consistent with its stated purpose,
  64. mission, and goal.  The policy does not attempt to articulate all required
  65. or proscribed behavior by its members.  VIRGINIA'S PEN is an open network
  66. in both implementation and spirit.  Each individual's judgment of
  67. appropriate conduct must be relied upon.  To assist in such judgment, the
  68. following general guidelines are offered:
  69.  
  70. I.   Any use of VIRGINIA'S PEN for illegal, inappropriate, or obscene
  71.      purposes, or in support of such activities, is prohibited.  Illegal
  72.      activities shall be defined as a violation of local, state, and/or
  73.      federal laws. Inappropriate use shall be defined as a violation of the
  74.      intended use of the network, and/or purpose and goal.  Obscene
  75.      activities shall be defined as a violation of generally accepted
  76.      social standards for use of a publicly-owned and operated
  77.      communication vehicle;
  78.  
  79. II.  All use of VIRGINIA'S PEN must be in support of a world class
  80.      public education and educational research in Virginia and
  81.      consistent with the purposes of the network.  Private school
  82.      professionals may secure accounts under the guidelines for Non-
  83.      Public School Accounts.  Private school students are not permitted
  84.      accounts at this time.  Use by private school professionals is
  85.      permitted recognizing the finite resources of the network;
  86.  
  87. III. Any use of VIRGINIA'S PEN for commercial purposes is prohibited;
  88.  
  89. IV.  Any use of VIRGINIA'S PEN for product advertisement or
  90.      political lobbying is prohibited;
  91.  
  92. V.   No use of VIRGINIA'S PEN shall serve to disrupt the use of
  93.      the network by other users;
  94.  
  95. VI.  VIRGINIA'S PEN accounts shall be used only by the authorized owner
  96.      of the account for the authorized purpose.  Account owners are
  97.      ultimately responsible for all activity under their account;
  98.  
  99. VII. Unbridled and open-ended use of the network in terms of access time
  100.      can not be accommodated inasmuch as supportive financial resources
  101.      remain finite.  Users are cautioned to exercise prudence in the
  102.      shared use of this resource;
  103.  
  104. VIII.  All communications and information accessible via VIRGINIA'S PEN
  105.      should be assumed to be private property.  Great care is taken by
  106.      the VIRGINIA'S PEN administrators to ensure the right of privacy
  107.      of users;
  108.  
  109. IX.  Any VIRGINIA'S PEN user's traffic that traverses another network may
  110.      be subject to that network's acceptable use policy;
  111.  
  112. X.   * Under prescribed circumstances public school student use may be
  113.      permitted, provided proper supervision is maintained by schools and
  114.      parents;
  115.  
  116. XI.  * Under prescribed circumstances non-educator use may be permitted,
  117.      provided such individuals provide evidence that their use furthers
  118.      the purpose and goal of the network and public education in general;
  119.  
  120. XII. From time to time, the Virginia Department of Education will make
  121.      decisions on whether specific uses of VIRGINIA'S PEN are consistent
  122.      with this policy.  The Virginia Department of Education shall
  123.      remain the final authority on use of the network and the issuance of
  124.      user accounts.

  126.      * Such prescribed circumstances and uses shall be defined in
  127.      writing by the Virginia Department of Education, and from
  128.      time to time be subject to change.

  133.         Guidelines for Non-Public School Accounts

  135.         Virginia's Public Education Network
  136.  
  137. 1.   The primary purpose of the VIRGINIA'S PEN Network is for use by
  138.      the public school professional staff.  The use of an individual
  139.      non-public school account is considered to be a privilege.
  140.  
  141. 2.   Accounts for non-public school persons may be granted for up to
  142.      one academic year at a time, provided they read and agree to
  143.      follow the Acceptable Use Policy.  This agreement is formalized
  144.      through their signature on the application form.
  145.  
  146. 3.   This provision applies only to adults who can demonstrate a close
  147.      tie to public school education.  Furthermore, the applicant must
  148.      demonstrate how his/her use of the network will further the goals
  149.      of world class education for students in the public schools of
  150.      the Commonwealth of Virginia.
  151.  
  152. 4.   Only the director of the network (or designee) may issue accounts
  153.      for special situations which he/she feels appropriate, but which
  154.      may not fall under existing guidelines.
  155.  
  156. 5.   Accounts for all non-public school persons will be issued by the
  157.      local node administrators and will receive final approval by the
  158.      Department of Education which will maintain a list of approved
  159.      applications.  No persons in this category shall be permitted to use
  160.      the network without Department of Education approval.
  161.  
  162. 6.   The above-mentioned use is subject to revision in policy.  In
  163.      all cases, use by professional public education staff shall take
  164.      precedence.  The Virginia Department of Education reserves its
  165.      right as final authority on use of the network.

  223.          Guidelines for Student Accounts
  224.         on Virginia's Public Education Network
  225.  
  226. 1.   The primary purpose of the VIRGINIA'S PEN Network is for the use
  227.      of the public school professional staff.  The use of an individual
  228.      student account is considered to be a privilege and is permitted to
  229.      the extent that available resources allow.
  230.  
  231. 2.   Students in grades 6-12 may be granted an account for up to one
  232.      academic year at a time provided they:
  233.      a. Read and agree to follow the Acceptable Use Policy.  This
  234.         agreement is formalized through their signature on the
  235.         application form;
  236.      b. Have at least one teacher sign the application form as a sponsor;
  237.      c. Obtain the signature of a parent on the application form.
  238.  
  239. 3.   Students in grade five and below are not allowed individual
  240.      accounts.  Teachers of these grades, however, may apply for a
  241.      class account, but are obligated to directly supervise these
  242.      students with its use according to the Acceptable Use Policy.
  243.      The teacher holding this account is ultimately responsible
  244.      for use of the account and is required to maintain
  245.      confidentiality with the password (not giving it to
  246.      students) and is advised to change the password frequently.
  247.  
  248. 4.   Students may not maintain accounts upon graduation unless they
  249.      otherwise qualify under one of the other acceptable use provisions.
  250.  
  251. 5.   Generally, students are not permitted to enter professional
  252.      Virginia's PEN or Usenet discussion groups.   Under certain
  253.      conditions, posting privileges to specific newsgroups may be granted.
  254.  
  255. 6.   All public school student accounts will be issued by the local
  256.      node administrators and will receive final approval by the
  257.      Department of Education which will maintain a list of approved
  258.      applications.  No students shall be permitted to use the network
  259.      without Department of Education approval.
