  1. License Agreement for the IBM techexplorer Hypermedia
  2. Browser, Version 1.0 (a plug-in that runs with Netscape
  3. Navigator for Windows NT/Windows95).  Before
  4. downloading or using this Program, you must agree to
  5. the terms and conditions of this license agreement.
  6.  
  7. 1.  Ownership and License
  8.  
  9. This Program is owned by International Business
  10. Machines Corporation or one of its subsidiaries ("IBM")
  11. or an IBM supplier and is copyrighted and licensed, not
  12. sold.  This Program is subject to U.S. Government
  13. Restricted Rights - Use, duplication, or disclosure
  14. restricted by GSA ADP Schedule Contract with the IBM
  15. Corporation.
  16.  
  17. IBM grants you a non-exclusive license of the Program
  18. in the country in which you acquired the Program.  The
  19. term "Program" means the original program and any whole
  20. or partial copies of it, including portions merged into
  21. other programs.  A Program consists of machine-readable
  22. instructions, audio/visual content (such as images,
  23. text, recordings or pictures), and related licensed
  24. materials.
  25.  
  26. Under this license, you may: (1) use the Program on
  27. only one machine, or if it is inoperable, on a backup
  28. machine; (2) copy the Program for backup purposes; (3)
  29. merge the Program into another program.  You must
  30. reproduce the copyright notice and any other legend of
  31. ownership on each copy or partial copy of the Program.

  33. You may not: (1) copy, merge, distribute, sublicense,
  34. lease or rent the Program except as specifically
  35. permitted by this license; (2) reverse assemble,
  36. reverse compile, or otherwise translate the Program.

  38. You may transfer all your rights and obligations under
  39. this license for the Program to another party.  To
  40. transfer such rights and obligations, you must transfer
  41. a copy of this license, all other documentation
  42. (including proof of entitlement), and at least one
  43. complete, unaltered copy of the Program to the other
  44. party.  Upon transferring your rights, your license is
  45. then terminated and you agree to destroy any copies
  46. remaining in your possession.

  48. 2.  No Charge

  50. IBM is offering the Program to you at no charge under
  51. this license.

  53. 3.  Warranty Disclaimer and Limitation of Liability

  55. IBM is not providing any program services under this
  56. license.

  58. Regardless of the basis on which you may be entitled to
  59. recover damages from IBM, for any claim (including
  60. fundamental breach, negligence, misrepresentation or
  61. other tort), IBM's liability will only be for the
  62. amount of any actual direct damages or loss, up to the
  63. equivalent of U.S. $5,000.00.

  65. IBM license this Program to you on an "AS IS" basis,
  66. without warranty of any kind.  IBM HEREBY EXPRESSLY
  67. DISCLAIMS ALL WARRANTIES OR CONDITIONS, EITHER EXPRESS
  68. OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED
  69. WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS
  70. FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.  The
  71. entire risk arising from the use of the Program remains
  72. with you.  Some jurisdictions do not allow for the
  73. exclusion or limitation of implied warranties, so the
  74. above limitations or exclusions may not apply to you.

  76. IBM WILL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR
  77. INDIRECT DAMAGES OR FOR ANY CONSEQUENTIAL DAMAGES
  78. (INCLUDING LOST PROFITS OR SAVINGS), EVEN IF IBM, OR
  79. ITS DISTRIBUTOR, HAS BEEN ADVISED OF THE POSSIBILITY OF
  80. SUCH DAMAGES.  IBM will not be liable for the loss of,
  81. or damage to, your records or data, or any damages
  82. claimed by you based on a third party claim.  Some
  83. jurisdictions do not allow for the exclusion or
  84. limitation of incidental or consequential damages, so
  85. the above limitations or exclusions may not apply to
  86. you.

  88. 4.  General
  89.  
  90. You may terminate your license at any time.  If you do
  91. so, all your license rights to the Program are
  92. terminated.  IBM may terminate your license if you fail
  93. to comply with the terms of this license.  If IBM does
  94. so, all your license rights to the Program are
  95. terminated and you must destroy all your copies of it.
  96.  
  97. Neither party may bring legal action under this license
  98. more than two years after the cause of action arose.
  99.  
  100. If you acquire the Program in the United States, this
  101. license is governed by the laws of the State of New
  102. York.  If you acquire the Program in Canada, this
  103. license is governed by the laws of the Province of
  104. Ontario.  Otherwise, this license is governed by the
  105. laws of the country in which you acquire the Program.
  106.  
  107. This license is the only agreement between you and IBM
  108. regarding your use of the Program.  It supersedes all
  109. other communications, understandings or agreements you
  110. and/or IBM may have had outside of this license.
  111.  
  112. If you do not agree with this license agreement, you
  113. may not download this Program.
