  14. Stone Design Software License Agreement\
  15. The enclosed Stone Design software (the "SOFTWARE") is licensed by Stone Design to you (the "Licensee") for use only on the terms set forth here.  STONE DESIGN IS WILLING TO LICENSE THE ENCLOSED SOFTWARE TO YOU ONLY UPON THE CONDITION THAT YOU ACCEPT ALL THE TERMS CONTAINED IN THIS AGREEMENT.  PLEASE READ THE TERMS CAREFULLY BEFORE INSTALLING THE SOFTWARE, AS INSTALLING THE SOFTWARE WILL INDICATE THAT YOU ACCEPT THE TERMS.  IF YOU DO NOT AGREE TO THESE TERMS, THEN STONE DESIGN IS UNWILLING TO LICENSE THE SOFTWARE TO YOU, IN WHICH EVENT YOU SHOULD IMMEDIATELY RETURN THE UNOPENED PACKAGE TO STONE DESIGN FOR A FULL REFUND.\
  16. GRANT OF LICENSE:  STONE DESIGN grants you the right to a non-transferable, non-exclusive license to use one copy of the SOFTWARE on a single NEXTSTEP computer or computer network. A site license permits more than one user to legally use the SOFTWARE concurrently on a single NEXTSTEP computer network.\
  17. COPYRIGHT:  The SOFTWARE is owned by STONE DESIGN
  18. \b0 or its suppliers and is protected by United States copyright laws and international treaty provisions.\
  19. RESTRICTIONS:  \
  20. (1) You may not rent, lend, transfer or lease the SOFTWARE, except upon the following conditions.  Student and Academic licenses are totally non-transferable.  Full price licenses are transferable if and only if the person transferring the license: a]  destroys all copies of the SOFTWARE, and b]  notifies STONE DESIGN in writing before the transfer.\
  21. (2)  You may not reverse engineer, decompile, or disassemble the SOFTWARE.  You may not modify the materials, with the exception of the files included as samples in the SOFTWARE.\
  22. SUPPORT AND UPDATES:  Minor updates containing major "bug" corrections to the SOFTWARE are included in the purchase price of the SOFTWARE and will be distributed via an electronic bulletin board service.  Technical support via phone and e-mail is available to registered owners for up to one year without charge.  Additional support and update services for the SOFTWARE are not included in the purchase price, but may be obtained from STONE DESIGN for STONE DESIGN's standard fees.\
  23. U.S. GOVERNMENT RESTRICTED RIGHTS:  The U.S. Government acknowledges STONE DESIGN's representation that the SOFTWARE and its documentation were developed at private expense and no part of them is in the public domain and that the SOFTWARE is "Restricted Computer Software" as that term is defined in Clause 52.227-19 (FAR) and is "Commercial Computer Software" as that term is defined in Subpart 227.471 (DFARS).\
  24. RESTRICTED RIGHTS LEGEND:  If this product is acquired under the terms of a government contract, use, duplication, and disclosure are subject to the terms of this license agreement and the following restrictions: subdivision (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at 252.227-7013 (DOD contracts); subdivisions (a) through (d) of 52.227-19 (Civilian agency contract); and the applicable ADP Schedule Contract (GSA contract).  EXPORT LAW ASSURANCES:  The Licensee
  25. \b0  agrees that neither the SOFTWARE nor any direct product thereof will be acquired, shipped, transferred or re-exported, directly or indirectly, into any country prohibited by the United States Export Administration Act and the regulations thereunder.\
  26. STONE DESIGN  warrants that, within the first sixty (60) days from the date of receipt, the media on which the software is furnished and the accompanying documentation will remain free from defects in materials and construction with normal use.  In the case of a defect, so long as the defect did not result from misuse, abuse, or accident, STONE DESIGN at its option will repair or replace the defective item and return it to you by pre-paid post.\
  27. The SOFTWARE is under continual development and testing by STONE DESIGN.  Accordingly, you acknowledge that the SOFTWARE and written materials are likely to contain "bugs" and other errors that could adversely affect the use or performance of the SOFTWARE.  The SOFTWARE may contain inoperable features.  The documentation may contain errors and may be incomplete.  You should take extra care in preserving and checking your data.  STONE DESIGN accepts no responsibility for lost data.\
  28. STONE DESIGN does not warrant that the SOFTWARE will meet your requirements, that the use or operation of the SOFTWARE will be uninterrupted or error-free, or that all the SOFTWARE errors will be corrected.  STONE DESIGN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.\
  29. LIMITATION OF LIABILITY:  REGARDLESS OF WHETHER ANY REMEDY IS SET FORTH IN THE LIMITED WARRANTY FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL STONE DESIGN OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE.  THIS IS TRUE EVEN IF STONE DESIGN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  IN NO CASE SHALL THE LIABILITY OF STONE DESIGN OR ITS SUPPLIERS EXCEED THE PURCHASE PRICE PAID FOR THE SOFTWARE.\
  30. GENERAL: This Agreement will be governed by the laws of the State of New Mexico, U.S.A., except for that body of law dealing with conflict of laws.  \
  31. SOME STATES AND COUNTRIES DO NOT ALLOW THE LIMITATION OF EXCLUSION OF LIABILITY OR THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE LIMITATION OF LIABILITY AND EXCLUSION OF IMPLIED WARRANTY MAY NOT APPLY TO YOU.  IN THAT EVENT, ANY IMPLIED WARRANTIES ARE LIMITED IN DURATION TO SIXTY (60) DAYS FROM THE DATE OF DELIVERY OF THE SOFTWARE.  THE WARRANTY IN THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS.  YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE AND COUNTRY TO COUNTRY.\
  32. STONE DESIGN reserves the right to refuse support to any user who acts in an abusive or demeaning manner while attempting to receive technical support.  STONE DESIGN reserves the right to charge any user for technical support should it be deemed necessary by STONE DESIGN for the above reasons, or for others not mentioned herein.\
