WebRing Terms of Service

What is the WebRing system?

WebRing is the largest, first and fastest growing service of its kind on the Internet, providing one of the easiest ways for Visitors to navigate the web. WebRing is a Site Navigation and Linking Service (the System) for creating your own on-line communities (Rings). We do not host any content, except for the limited content of WebRing's web site and the list of Rings which reside on our own site. The System allows Internet users to find and link to a variety of unaffiliated host computers around the world who choose to link themselves by joining a Ring on a particular subject. The System also allows people who already have web pages to create a Ring, linking pages on a similar subject matter, or to join an existing Ring on the System.

Member web sites have banded together to form their sites into Rings in order to allow more Visitors to reach them quickly and easily. The System primarily services three different groups: Visitors, Member sites and advertisers-merchants. Each Ring was started and is typically maintained by an individual web site owner whose content is not maintained or controlled in any way by WebRing. The System can support a nearly unlimited number of separate and distinct Rings across the Internet. This unique structure allows the creation and evolution of tens of thousands of different "web communities."

Through navigation links found most often at the bottom of Member pages, Visitors can navigate through all or any of the sites in a Ring. Visitors can navigate through a Ring in either direction, going to either the next or previous site, or listing the next five sites in the Ring. Visitors can also jump to a random site in the Ring, or survey all of the sites that make up the Ring.

The quickest way to find a Ring is to visit WebRing's online Directory. There, Visitors can select a category, or initiate a keyword search across the entire system. If you can't find a Ring that suits your needs, you're free to start your own.

Acceptance of Terms of Service

WebRing provides the System subject to these terms of service (TOS), which may be updated by WebRing from time to time without notice to you. You can review the most current version of the TOS at any time at http://www.webring.org/terms.html.

Ownership and Operation of Web Sites Linked by the System

In keeping with the spirit of the Internet, it is the policy of WebRing to offer open and uncensored access to the World Wide Web community. WebRing operates as a navigation service pointing to a variety of unaffiliated host computers around the world. The Web sites you visit through WebRing reside and are operated by those host computers and not by WebRing. The links in the WebRing directory are maintained by individual Ring managers (RingMasters) and not by WebRing. All content on Member sites exists on the web sites' various host computers to which WebRing has absolutely no control or access. This applies to all content including proprietary graphics, trademarks and other intellectual property contained on Member sites.

As such, WebRing cannot and does not take any responsibility for the content of these sites, and WebRing does not actively monitor such content. WebRing does not control the actions of the RingMasters, Members or Visitors. Under no circumstances will WebRing be liable in any way for the content on the Member sites or for the actions of the RingMasters, Members or Visitors. You understand that by viewing Member sites, you may be exposed to content which is offensive, indecent or objectionable. If a particular Web site raises concerns for you, please contact the owner of the site directly. Contact information such as an e-mail address will usually be found on the Web site itself or by the address line in your browser. Contact information for hosts of sites in the United States can be found by accessing Internic's Whois query at www.internic.net.

If the WebRing-related activities of a particular RingMaster raises concerns please contact us at Member Support Form and select the radio button "Disputes." WebRing is the owner of all Rings, all links supplied by WebRing and all WebRing trademarks (including, but not limited to the WebRing mark). WebRing reserves the right to restore, adopt or maintain a Ring and Ring information. Upon leaving the System, Ring Members and RingMasters agree to remove all WebRing data (including links supplied by WebRing) and trademarks from his or her Web site. Although WebRing does not control the content of individual pages that are linked by the System, the System may not be used, directly or indirectly:

For any unlawful activities or the promotion of unlawful activities;

For any commercial purpose related to the System, including, without limitation, selling Rings, WebRing data (including links supplied by WebRing), or membership to a Ring;

To harm minors in any way; or

To display any content that infringes any patent, trademark, trade secret, copyright or other proprietary right of a third party.

WebRing Privacy Notice

Certain information about Visitors to WebRing's web site, RingMasters and Ring Members is subject to the WebRing Privacy Notice. For more information, please see the full WebRing Privacy Notice at http://www.webring.org/privacy.html. WebRing does not discriminate based on sex, age, gender, sexual orientation, ethnicity, culture, religion or socio-economic status. WebRing does not currently collect information regarding the age of RingMasters or Members. However, RingMasters must be over the age of 13 or have their parents or guardians consent. Members of WebRing must be 13 years of age or older. If you are under the age of 13, you must have your parent's consent to be a Member of WebRing. WebRing reserves the right to deny, suspend or revoke any membership or Ring in the event that WebRing learns that a RingMaster, Member or person seeking membership is under the age of 13 and does not have his or her parent's or guardian's permission to be a WebRing Member.

Indemnity

Each RingMaster and Member agrees to indemnify and hold harmless WebRing for any loss, liability, claim, damage, and expenses (including reasonable attorneys' fees) arising from or in connection with the contents of the Member's web page, use of the System, any violation of the TOS, or any violation of the rights of a third party. WebRing also reserves the following rights:

To release current or past RingMaster or Member information: (i) in the event WebRing believes that accounts are in violation of the TOS or used to commit or promote unlawful acts, (ii) if the information is subpoenaed, (iii) to protect the rights of WebRing or others, including the facilitation of the resolution of a dispute concerning the use of the System, or (iv) for administrative and other purposes that WebRing deems necessary to maintain, service, and improve the Service or other products;

To deny, suspend or terminate membership to offenders of the TOS;

To remove RingMasters, Rings, or sites from the System without notice for any reason, including, without limitation, interference with the design or operation of the System;
To use images of RingMaster or WebRing Member pages for promotional and other commercial purposes (for example: news coverage of WebRing);
To use Member personal identifying information for the purposes of informing Members about WebRing's services and additional services that WebRing and its affiliated companies may be able to offer Members;
To utilize third parties to provide services to WebRing Members. These third parties may require limited access to Members' personal identifying information in order to perform the services; and
To discontinue the System, temporarily or permanently, without notice.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

YOUR USE OF THE SYSTEM IS AT YOUR SOLE RISK. THE SYSTEM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WEBRING AND ITS AFFILIATES EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

NEITHER WEBRING NOR ITS AFFILIATES MAKES ANY WARRANTY THAT (i) THE SYSTEM WILL MEET YOUR REQUIREMENTS, (ii) THE SYSTEM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SYSTEM WILL BE ACCURATE OR RELIABLE, AND (iv) ANY ERRORS IN THE SYSTEM WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SYSTEM IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM WEBRING OR THROUGH OR FROM THE SYSTEM SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT NEITHER WEBRING NOR ITS AFFILIATES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WEBRING OR ITS AFFILIATES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SYSTEM; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iii) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SYSTEM (INCLUDING, WITHOUT LIMITATION, THE RINGMASTERS, MEMBERS OR VISITORS); (iv) ANY CONTENT ON ANY MEMBER'S WEB SITE OR THE ACTIONS OR INACTIONS OF THE RINGMASTERS, MEMBERS OR VISITORS, OR (v) ANY OTHER MATTER RELATING TO THE SYSTEM.

EXCLUSIONS AND LIMITATIONS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
