Software License Agreement
You should read the following terms and conditions before using this product.
If you do not agree to these terms, a) (direct/retail software) return this
package to the person/company from which it was purchased and your money will
be refunded, or b) (shareware software) erase the software or give it to
someone else for evaluation.
This software is protected by both United States Copyright Law and
International Treaty provisions. Therefore, you must treat this sotware like
a book with the following exception: Transversal Design authorizes you to
make archival copies of the software for the sole purpose of backing up your
software and protecting your investment from loss.
By saying, "just like a book," we mean, for example, that this software may be
used by any number of people and may be freely moved from one computer
location to another so long as there is no possibility of it being used at one
location while it is being used at another. Just like a book cannot be read
by two different people in two different places at the same time, neither can
the software be used by two different people in two different places at the
same time.
Transversal Design has very reasonable policies regarding site licensing of
the software. To protect yourself regarding copyright infringement, you
should license copies of the software for each computer upon which it resides
and/or for each computer terminal on any networks upon which it resides.
This and all products of Transversal Design carry a 30-day money-back
guarantee from date of purchase (direct/retail versions). A valid sales slip
must be included with the original diskette and documentation for any refunds.
No refunds shall be forwarded prior to receiving the above.
All shareware versions carry the same 30-day money-back guarantee from date of
registration. All materials received from Transversal Design must be returned
prior to receiving the refunded registration.
A brief letter describing why the software was returned would be appreciated.
A $5 re-stocking charge may be kept from all refunds to offset the initial
costs of mailing and handling.
For shareware versions only, the following additional licensing is granted:
1. You are free to copy and distribute the software for NONCOMMERCIAL use
if: a) no fee is charged for copying or distribution, and b) it is not
modified in any way. Copying and distribution must include the original
ZIP or self-extracting EXE file in its original form (i.e., no files
removed).
2. Clubs and user groups may charge a nominal fee not to exceed $10 for
expenses and handling while distributing this software.
For shareware, the evaluation period for this software is 30 days. If, after
30 days, you will not be using the software further, you are expected to erase
all copies of the software and/or pass them on to someone else. If you will
be using the software past the 30-day evaluation period, regardless of how
infrequent its use might be, you are expected to register the software.Warranty
With respect to the physical diskette and physical documentation enclosed
herein (or downloaded), Transversal Design warrants the same to be free of
defects in materials and workmanship for a period of 90 days from the date of
purchase. In the event of notification within the warranty period of defects
in material or workmanship, Transversal Design will replace the defective
diskette or documentation of any registered or licensed product. The remedy
for breach of this warranty shall be limited to replacement and shall not
encompass any other damages, including, but not limited to, loss of profit,
special, incidental, consequential, or other similar claims.
Transversal Design specifically disclaims all other warranties, expressed or
implied, including, but not limited to, implied warranties or merchantability
and fitness for a particular purpose with respect to defects in the diskette
and documentation, and the program license granted herein. In no event shall
Transversal Design be liable for any loss of profit or any other commercial
damage, including, but not limited to, special, incidental, consequential or
other damages, even if Transversal Design or an agent of Transversal Design
has been advised of the possibility of such damages or loss. The person or
company using the software bears all risk as to the quality and performance of
the software.
Shareware & Registering Your Software
If you have not done so already, please take the time to complete and mail in
your registration card along with any shareware fees requested. Please
indicate on the registration whether or not you would like to be put on our
mailing list. This list is NOT available to outside sources and will be kept
in the strictest confidence. If you elect to be put on our mailing list, you
will be included in any direct mailing campaigns from our company. This will
generally be announcements of new products. If you elect not to be put on the
list, you will still be notified in any mailings of new updates for the
software you have registered.
If your software was purchased directly from Transversal Design, or through a
retail outlet, you may skip the remainder of this section. Please note that
purchasing the software on a disk from a user group or a company distributing
programs for basically the cost of the disk does NOT constitute retail
purchase of this software. The shareware registration fees are still needed.
You may find this section informational regarding shareware as an alternate
source of quality software. You may even be using unregistered copies of
shareware software without being aware of the general concepts and
registration expectations.
The concept of shareware is quite simple... you obtain a copy of software
through whatever means (a friend, downloading, etc.), try it for a fixed
period of time and, if you like it or USE it (regardless of how infrequently),
you send the author the requested registration fee. Otherwise, you are
expected to erase the software from your hard drive and/or pass it on to
someone else.
The benefits to you of using/trying shareware and registering it are manyfold.
There are several good programmers out there. Shareware is a means of
marketing whereby users can try the software and judge for themselves whether
it meets their needs, without the expense of advertising to the programmer.
There is never the problem of trying to return the software and obtain a
refund like you would have with "over-the-counter" software since you don't
register and pay for it if you don't like it. Since there are no advertising
expenses (or, generally, overhead), you can purchase the software for a
greatly-reduced rate (as compared to the equivalent product at the retail
level). As of this writing, advertising a product in one of the major
computer magazines for a single-issue run was from $30,000 to $50,000 for a
full page ad. Someone has to pay for that and it is always you, the end-user.
Shareware circumvents this expense by directly marketing the software to you.
For the programmer, shareware is a means of obtaining a direct monetary reward
for their efforts. The registrations paid allow the programmer to continue
creating and improving software. It is important that you register all
shareware which you may be using. It is in your best interests to "reward"
the programmer so that you will obtain better software in the future for
reasonable prices.
How do you know if you are using shareware software? The programmer ALWAYS
puts in a request somewhere for money. The current trend is to print
UNREGISTERED COPY somewhere in the screens produced. If this is seen, it is
usually an indication that you have not registered the software. Please do
so.
One final caveat about shareware, one that, in the minds of the owners of
Tranversal Design is often overlooked or not understood... when you are
registering a copy of shareware by paying the registration fee, you are
registering THAT version of the software, not a life-time registration. When
a later version is released, you should pay some type of update fee,
regardless of if the author requests it or not, even if it is just $5.
Transversal Design will always include an upgrade request with all of our
shareware software.
The reasoning behind this thinking is thus... when an upgrade of commercial
software is released, you do not "automatically" have a right to own it, nor
can you even get it without paying the upgrade fee. The upgrade fee is
offered because of past business with the company. The upgrade usually
represents additional time and/or expense by the company to address your
needs. That, we think, is enough soap-boxing for this pamphlet.
Please see the Registration section for instructions about registering your
software.Tech Support
It is the policy of Transversal Design not to provide support for unregistered
copies of software. An initial telephone call will be accepted regarding
installation of the software; you will be required to "register" via telephone
at that time. For shareware products, Transversal Design will expect, at a
minimum, registration of the software within one month of the initial
telephone call (the evaluation period for the software). If registration and
check is not received within that time period, all technical support for the
software will be denied.
The front page of this documentation lists a hot-line beeper telephone number.
It is to be used only when "immediate" action is needed and is ONLY for
support of this particular product and its use. The initial warranty period
includes up to thirty minutes of time via the hot-line for registered users.
The telephone call will be returned within one twenty-four hour period.
Transversal Design reserves the right to charge for any additional time beyond
the thirty minutes at the rate of $60 per hour, billable in 5-minute
increments. The user will be informed at the time of the telephone call
whether or not this charge will be assessed. If there are any unpaid bills
for the user, technical support may be denied.
Unlimited support for registered software is always available via mail
(registration for shareware to include all registration fees). Transversal
Design will make every effort to respond to correspondence within 24 hours of
receipt. To aid us in determining any problems you may be having and proper
solutions, please include the following in all correspondence:
Product name
Serial number
Description of hardware/sytem upon which the software is running
DOS version (type VER at the DOS prompt)
Description of what you are typing and trying to do
Description of the problem
Return address for reply
Day-time telephone number (optional)
Transversal Design may opt to handle the questions via the telephone; if so,
this will be at no charge to the customer during the initial warranty period.
As Transversal Design grows, we will be installing a bulletin board to help
with frequently asked questions and provide this service at no charge to our
customers. Product upgrades will be available via the bulletin board.
Additional staff will be added to handle technical support and general
information.
These policies may seem "stiff", but please realize that Transversal Design
will make every attempt, on the basis of good will, to provide the technical
support you need. You can save yourself a lot of time if you will consult the
documentation prior to any contact with Transversal Design. Unlike some
companies, Transversal Design believes that you should have complete
documentation and will make every attempt to provide such to you. Your
comments and suggestions are ALWAYS welcome for improvements to our
documentation and products.
Documentation Included
With all shareware versions of the software, Transversal Design may include an
additional file called xxxxxxxx.WP where xxxxxxxx is the program name. This
file is a WordPerfect 4.2 file. This allows you the convenience of having a
"formatted" document and the ability to make whatever formatting changes you
may desire (such as page size, orientation, headers, etc.).
For those organizations licensing this software for multiple computers/sites,
this file, if not generally distributed, may be available from Transversal
Design. When licensing the software, the organization will be given the
option of receiving printed documentation from Transversal Design (up to one
copy per licensed computer) or the option of printing the documentation
themselves as needed. Choosing to print the documentation at the
organization's site may lessen the licensing/purchase fees required. This
option is intended to address those organizations which want to license and/or
purchase large quantities of the software but do not desire to have large
quantities of diskettes and/or documentation. Transversal Design is very
flexible in meeting your needs.

General Information
In the following descriptions, references are made to purchases. Purchases
are defined as: a) ordering the software direct from Transversal Design or b)
mailing of any fees requested for shareware programs.
Transversal Design is coining an in-house phrase known as "the $10 utilities".
These utilities are not "cheap" utilities just because they have such low
purchase price... they perform their functions quite nicely. Generally, the
$10 utilities perform one function and one-function only, without any glitz or
glitter. For instance, FormFeed will force your printer to eject a page. Not
tricky programming, but it comes in handy when you've just copied something to
the printer and don't want to get up to press the form feed button on the
front of the printer. If we thought that you'd pay more than $5 or $10 for
the $10 utilities, we'd ask for more. Generally, the $10 utilities are small
utilities which, for programmers, you would have gotten around to programming
eventually; for other users, they are just handy little utilities to have
around.Due to the nature of the $10 utilities, no pre-printed documentation is
included. All documentation will be on the disk. No disk will be mailed to
you unless the $10 utility(ies) is bundled with other software. If you take a
moment to consider this, all companies are in business to make a profit. If
we ask for $10 (or even $5 on some of the utilities), and spend up to $5
mailing you a disk, another $x to have documentation pre-printed, then another
$x for tech support, there isn't much left by way of profit.
There still remains the problem of "registering" the $10 utilities so that the
obnoxious "*** UNREGISTERED COPY ***" is removed from the screen whenever you
run the program. With the registration of each of the $10 utilities, you will
be mailed a post card with instructions for removing the unregistered message.
Software from Transversal Design
The following is a partial listing of software available from Transversal
Design. If desired, you may use this order blank to purchase additional
software. All sales carry a thirty-day, money back guarantee. A short
description of each program follows. A minimum $20 order is requested.
All products are listed with their DOS name (rather limiting), followed by the
purchase price. Those programs which include printed documentation with their
purchase will have an asterisk ( * ) beside the price. At the minimum, this
documentation will be a printed copy of thedocumentation file(s) done on a
laser printer on 8.5x11 paper. As time permits, all of the documentation will
be laid out on a Macintosh (desktop publishing), and laser-quality stapled
documentation will be produced.
For software companies desiring to include any of these utilities with their
own distributed software, contact Transversal Design regarding licensing fees.
For all licensing fees, whether multi-computer, multi-site or multi-
distribution, Transversal Design will make every attempt to work with you to
determine a fair and equitable fee.
2ndShift ($49*) 2ndShift is a program designed to automate many procedures
performed on the computer to execute either a) at a certain time,
for instance during the "2nd shift", or b) at a certain date, while
a key person may be on vacation. Its best use would be to have the
computer "type" keys without anyone sitting there watching the
computer, in essence, giving the computer a "to-do" list while the
user is gone. It may alternately be used by anyone providing
technical support or training of users to aid in determining problem
areas by examining the keys typed by the user. Includes Timer (see
below).
AddPath (NC) This is a handy batch file obtained from some source which is
not even remembered. With it, you can temporarily add paths to your
PATH "command". The batch file is free, but only with purchases
and/or shipment of other products. It will not be shipped unless
the box is checked.BinBrowz($25*) This program allows one to browse through files and see their
contents in a variety of formats, including ASCII, hex, DOS text
file and generic word processor. BinBrowz allows one to page
through the file either forwards or backwards. Batch operation and
wild cards are supported for unattended operation along with
filtering of the high-bit for word processors which use this
feature.
BulkCopy ($35*) Bulkcopy allows a software company (or any company needing to
make multiple-copies of files) to copy distribution files to drives
A: or B:. If the disk is not formatted, it will format the disk.
It will check to see if the disk contains other files prior to the
copy/format.
BulkEras ($20*) All companies using computers, regardless of size, will
eventually wind up with several diskettes which are no longer
needed. This may be because of software companies having upgraded
their software and having x number of copies of the previous version
lying around. This may be because of data backups which are old.
It may be temporary disks used to move data from one computer to
another which are no longer needed. The reasons are endless.
BulkEras may be used to erase these disks so they may be re-used.
It alternately will format any unformatted disks. No data is erased
or lost unless the user specifically indicates to erase the data.
EraseTPU ($5) Specifically for Pascal programmers. This little utility will
erase any TPU files found if: a) the corresponding .PAS file is
found and b) if the date and time of the .PAS file is later than the
TPU file. This is useful when making a backup of your data using a
program such as PKZIP when you have TPU files for which you do not
have source code.
FormFeed ($5) A handy little utility to eject a page at your printer. Useful
from the command line or from within a batch file. You'll use this
more than you realize.
Global ($25*) Global performs operations across an entire hard drive. It
allows a user to find all files matching a particular wildcard mask
(as in GLOBAL DIR *.ZIP), allows a user to erase all files based
upon the mask (as in GLOBAL ERASE *.BAK), allows a user to TYPE all
files matching the mask (as in GLOBAL TYPE *.DOC), or shell to other
programs to act globally on the disk (as in GLOBAL BINBROWZ *.DOC).
InlToCom ($20*) For Turbo Pascal and C programmers, there is a program out on
the bulletin boards which will create Inline code (Pascal) or
__emit__ code (C). Originally, Inline was created to address the
need to do assembly-level programming in earlier versions of Turbo
Pascal and C which had no ability to call an assembler to produce
the inline code. Now, Inline is useful for including inline code in
programs where the end-user may not have an assembler, or for quick-
and-dirty assembly programming. InlToCom will take Inline output
files and create a .COM file from the file output by Inline. The
current version of InlToCom is written for Pascal, with a version
for C planned by mid- to late August depending upon interest level.
Watch for potential releases of Inline and/or InlToCom.
Lock ($20*) Asks for a password and locks out any user until the password
is re-entered. Useful for setting up a semi-secure system.PrintOne($20*) PrintOne will take any file and create a print file, with the
options of specifying the lines per page and an optional padding to
put in the left margin. Line numbers are added to each line; the
program name and date printed is added as a header for each page.
PrintOne is useful for taking either program or DOS text files and
obtaining "formatted" print files.
PrintScr ($5) PrintScr prints the current screen. It is intended for
inclusion within a batch file to print the screen during off-hours
showing the screen at the time. This is useful from a diagnostic
standpoint.
QuickDir ($10) QuickDir displays diskette directories and disk space
available. It is intended for those times when the user has several
disks to view and eliminate the need to type DIR x: every time.
Software companies may find it useful as an intermediary step to
verifying disk copying for distribution. Others may find it useful
to determine the contents of several diskettes which have
accumulated over the days/months/years, such as backup disks.
Reboot ($5) Allows one to reboot the system from within a batch file.
Register (--) Specifically for programmers, a unique little program for
"registering" software at the user's site without any additional
downloading or diskette mailing. Contact Transversal Design for a
specifications sheet and licensing for inclusion of this program
with your software. Send $5 for the specifications sheet.
ScanMem ($10) ScanMem scans memory, showing which programs are currently in
memory. It is useful from the standpoint of determining potential
conflicts in memory, or from a diagnostic standpoint. Software
companies should contact Transversal Design directly regarding
licensing and inclusion with their own software.
Search ($20*) Allows one to search for text in all of the source code of a
program, regardless of how many files might be involved (via USES or
the $I compiler directive). Versions for C and ASM should be
available by mid- to late-August.
SetKey ($5) Allows the user to set or clear the CAPS, NUM, SCROLL or INS
key status from within a batch file. Useful for turning off the NUM
lock key, etc., which many of the newer computers seem fond of
setting at startup.
ShowColr ($5) Intended for all programmers. ShowColr will display the full
range of screen colors from $00 through $FF (0x00 through 0xFF for C
programmers). The blink bit is disabled. The program is useful for
determining possible color combinations when designing software.
Timer ($10) Timer makes the computer wait until a specified time and/or
date before it returns control to the next command to the computer.
It is intended for batch file operation. Assuming a multiple-site
company with sales people "uploading" information by 10:00 p.m., a
user might use Timer in a batch file to wait until 11:00 p.m., then
copy the files to tape, floppy disk, or the printer.VerCon($35*) VerCon stands for version control. For any individuals or
organizations making several revisions to a) documents (such as
grant proposals, contracts, etc.) or b) programs, VerCon allows you
to maintain a revision "database". Through daily entry, one could
track changes to any of these documents at any given point. Allows
up to 1296 records (one per version) and 16 screen lines per record.
ZipNew ($25*) Primarily designed for those who want to do daily backups of
only the files modified on a given day. ZipSorce will check all
files' date and time, create a batch file containing the "newer"
files and shell out to PKZIP to compress the files to a specified
output destination and/or file. This utility would be most useful
to those individuals who would like to back up their work (such as
any changed databases or any wordprocessing documents), or by
programmers to backup any source files which were modified on the
day in question. Allows specification of a date and time range to
be included in the zipping. PKZIP must be in the default path.
PKZIP is copyrighted by PK Ware and is not included with the
software. It is up to the user to obtain a copy and properly
register PKZIP. PK Ware should be contacted directly at the address
included below.
ZipSorce ($30*) ZipSorce will take any Turbo Pascal source file and create an
@ file for PKZIP to make a backup/zip file of the complete source
code, including any USES files. Through specific remark statements,
any additional program-necessary files which are not a part of the
program file(s) will be included in the files to be zipped. PKZIP
will then be executed to create the zip file. Versions for C and
ASM are intended for mid- to late August or early September based
upon user interest and registrations.
TDUtil1 ($79) (The Tech Support Utilities) Includes 2ndShift, BinBrowz,
PrintScr, ScanMem and Timer. 2ndShift would be used to record a
user's keystrokes for diagnostics, BinBrowz, to "debug" files,
PrintScr and Timer, for use in batch files for post-evening
diagnostics and ScanMem to determine any potential memory conflicts.

TDUtil2 ($80) (The Batch Utilities) Includes FormFeed, Global, Lock,
PrintScr, Reboot, SetKey, Timer and ZipNew. You save $20 over
purchasing the items separately.
TDUtil3 ($85) (The Productivity Utilities) Includes 2ndShift, Timer, Global,
QuickDir and ZipNew. You save $24 over purchasing the items
separately.
TDUtil4 ($129) (The Programming Utilities) Includes EraseTPU, InlToCom,
PrintOne, ZipNew, ZipSorce, ShowColr, Search, and VerCon. You save
$36 over purchasing the items separately.
