  4. Electronic End User License Agreement
  5.  
  6. NOTICE TO USER:
  7. THIS IS A CONTRACT. BY CHOOSING THE ACCEPT 
  8. BUTTON BELOW, YOU ACCEPT ALL THE TERMS AND 
  9. CONDITIONS OF THIS AGREEMENT.

  12. Star Media Systems Corporation grants to you a nonexclusive 
  13. license to use the Software for evaluation and trial use 
  14. purposes only, provided that you agree to the following: 
  15.  
  16. 1. Use of the Software.
  17. You may install the Software in a single location on a hard 
  18. disk or other storage device; and make backup copies of the 
  19. Software. 
  20.  
  21. You may make unlimited copies of the Software and give 
  22. copies to other persons or entities so long as (i) the use of such 
  23. copies is for evaluation and trial purposes only and (ii) al 
  24. copies contain this Agreement and the same copyright and 
  25. other proprietary notices that appear on or in the Software. 
  26.  
  27. 2. Copyright.
  28. The Software is owned by Star Media Systems Corporation, 
  29. and its structure, organization and code are the valuable trade 
  30. secrets of Star Media Systems Corporation. The Software is 
  31. also protected by United States Copyright Law and 
  32. International Treaty provisions. You agree not to modify, 
  33. adapt, translate, reverse engineer, decompile, disassemble or 
  34. otherwise attempt to discover the source code of the Software. 
  35. You may use trademarks only to identify printed output 
  36. produced by the Software, in accordance with accepted 
  37. trademark practice, including identification of trademark 
  38. owner's name. Such use of any trademark does not give you 
  39. any rights of ownership in that trademark. Except as stated 
  40. above, this Agreement does not grant you any intellectual 
  41. property rights in the Software.

  43. 3. Cooperation with Star Media Systems Corporation
  44. During the term of this Agreement, you will provide feedback 
  45. to Star Media Systems Corporation regarding testing and use 
  46. of the Software, including error or bug reports. 
  47.  
  48. 4. No Warranty.
  49. You acknowledge that the Software may be a pre-release 
  50. version, may not represent final product from Star Media 
  51. Systems Corporation, and may contain bugs, errors and other 
  52. problems that could cause system failures. Consequently, the 
  53. Software is provided to you "AS IS", and Star Media Systems 
  54. Corporation disclaims any warranty or liability obligations to 
  55. you of any kind. You acknowledge that any research or 
  56. development that you perform regarding the Software or any 
  57. product associated with the Software is done entirely at your 
  58. own risk.

  60. STAR MEDIA SYSTEMS CORPORATION DOES NOT 
  61. AND CANNOT WARRANT THE PERFORMANCE OR 
  62. RESULTS YOU MAY OBTAIN BY USING THE 
  63. SOFTWARE OR DOCUMENTATION.  STAR MEDIA 
  64. SYSTEMS CORPORATION MAKES NO WARRANTIES, 
  65. EXPRESS OR IMPLIED, AS TO NONINFRINGEMENT OF 
  66. THIRD PARTY RIGHTS, MERCHANTABILITY, OR 
  67. FITNESS FOR ANY PARTICULAR PURPOSE. IN NO 
  68. EVENT WILL STAR MEDIA SYSTEMS CORPORATION 
  69. BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, 
  70. INCIDENTAL OR SPECIAL DAMAGES, INCLUDING 
  71. ANY LOST PROFITS OR LOST SAVINGS, EVEN IF AN 
  72. STAR MEDIA SYSTEMS CORPORATION 
  73. REPRESENTATIVE HAS BEEN ADVISED OF THE 
  74. POSSIBILITY OF SUCH DAMAGES, OR FOR ANY 
  75. CLAIM BY ANY THIRD PARTY.

  77. Some states or jurisdictions do not allow the exclusion or 
  78. limitation of incidental, consequential or special damages, or 
  79. the exclusion of implied warranties or limitations on how long 
  80. an implied warranty may last, so the above limitations may 
  81. not apply to you.

  83. 5. Termination of Use.
  84. The evaluation period for use is limited to 90 days. Also, the 
  85. license will terminate automatically if you fail to comply with 
  86. the limitations described herein.  On termination, you must 
  87. destroy all copies of the Software and Documentation.

  89. 6. Governing Law and General Provisions. 
  90. This Agreement will be governed by the laws of the State of 
  91. California, U.S.A., excluding the application of its conflicts of 
  92. law rules. This Agreement will not be governed by the United 
  93. Nations Convention on Contracts for the International Sale of 
  94. Goods, the application of which is expressly excluded. If any 
  95. part of this Agreement is found void and unenforceable, it will 
  96. not affect the validity of the balance of the Agreement, which 
  97. shall remain valid and enforceable according to its terms. You 
  98. agree that the Software will not be shipped, transferred or 
  99. exported into any country or used in any manner prohibited by 
  100. the United States Export Administration Act or any other 
  101. export laws, restrictions or regulations. This Agreement shall 
  102. automatically terminate upon failure by you to comply with its 
  103. terms. This Agreement may only be modified in writing 
  104. signed by an authorized officer of Star Media Systems 
  105. Corporation.

  107. 7. Notice to Government End Users. 
  108. If this product is acquired under the terms of a: GSA contract - 
  109. Use, reproduction or disclosure is subject to the restrictions set 
  110. forth in the applicable ADP Schedule contract; DoD contract. 
  111. Use, duplication or disclosure by the Government is subject to 
  112. restrictions as set forth in subparagraph (c) (1) (ii) of 252.227-
  113. 7013; Civilian agency contract. Use, reproduction, or 
  114. disclosure is subject to 52.227-19 (a) through (d) and 
  115. restrictions set forth in the accompanying end user agreement.

  117. All rights reserved under the copyright laws of the United 
  118. States.
